On December 17, the Department conducted the second workshop
on the standardization of water management district and DER
rules. A list of those in attendance is attached.
The purpose of the standardization workshops is to develop a
standard format for all rules written under the authority of
Chapter 373,,F.S. At the first workshop, a general outline
for the sequence of parts and related subheadings was developed.
This was reviewed at the second workshop and several modifica-
tions were made to it. Attached is a copy of the general-out-
line, as revised.
Also at the second workshop, DER presented revisions to Chapter 17-1,
FAC, (DER's rules of administrative procedures) which would be
compatible with the proposed standard format. The draft of
these revisions is to be reviewed by each WMD and discussed
r at the next workshop. DER also presented reordered versions
of Chapter 17-20 (Water Well Contractors) and 21 (Rules and
Regulations Governing Wells in Florida), FAC. The SFWMD and
SWFWMD submitted drafts of their existing reordered rules in
the proposed standard format. The SJRWMD and NWFWMD have
recently adopted several rules in accordance with the standard
Adoption of a standard format will require a revised chapter
numbering system. Participants at the workshop felt that
all WMD rules should be changed to chapter number 17 (instead
of renumbering within the 16 series) and that each WMD should
keep their designated letter. This would mean that WMD rules
adopted under the standard format would begin as follows:
NWFWMD Chapter 17G-..., FAC.
SRWMD Chapter 17H-..., FAC.
SJRWMD Chapter 171-..., FAC.
SWFWMD Chapter 17J-..., FAC.
SFWMD Chapter 17K-..., FAC.
It is the intent that once the format is standardized and all
WMD and DER rules under Chapter 373, F.S. are in this format,
that the rules will be analyzed to determine content changes
which can be made so that rules are as similar as possible.
A draft application form for possible use by the WD's for all types of
permitting was presented for review and cement.
