Subject: SWUCA Advisory Group of Experts ("SAGE")

Dear Dr. Stewart:

Enclosed are the two stamps which we have prepared for
your use. Please use a red ink pad for these stamps.
These include the "Confidential/Work Product" stamp and
the "Draft" stamp. Based upon some comments made at
the last SAGE meeting, I thought it advisable to write
to clarify the use of these stamps.


Only those documents which are intended to remain
confidential within SAGE should be stamped with the
Confidential/Work Product stamp. If you prepare a
document which you intend to circulate, or which you
expect will likely be circulated outside SAGE, please
donot stamp the document with the Confidential/Work
Product stamp.

As for the Draft stamp, you should use it in every case
where your document is not considered by you to be
"final." This is true whether or not the document will
be disclosed to persons outside of SAGE and, therefore,
whether or not it also bears the Confidential/Work
Product stamp.

Finally, one or more of you have asked whether you are
free to discuss SAGE business and to disclose
documentation to Pete Hubbell, Executive Director, and
Mark Farrell, Assistant Executive Director. I hasten
to inform you that there is no restriction on
disclosure to these gentlemen. As the chief executives
of the District, they have ultimate responsibility and
control over SAGE.

Subject: SWUCA Advisory Group of Experts ("SAGE")

Dear 2-:

I am enclosing a revised Exhibit A to the October 13,
1993 letter to you concerning Work Product and Attorney
Client Privilege. Revised Exhibit A contains the names
of additional SAGE members. The list includes a
District hydrologist, Harry Downing. Most of the
others are consultants to the District concerning the
economic impact statement to be formulated in
connection with the promulgation of SWUCA rules.
Please add them to your SAGE mailing list.

During our meeting at the Brooksville office last week,
we mentioned our desire to compile existing work
product for filing in Room 219 on the second floor of
the Brooksville office. Please send to my attention
copies of all of your existing work, such as opinion
letters, papers and other documents reflecting your
professional work for the District in regard to the
SWUCA. I am not looking for drafts, but only those
items which should be made available for review by SAGE
members. The items forwarded to me should bear the
Privileged and Confidential language furnished to you
in my October 13, 1993 letter. If possible, please
provide a diskette copy of any such items.

We also wish to identify all existing professional
letters, papers and reports done by you, other SAGE

As we discussed, all correspondence or communication between the District and IFAS on this
project is done at the direction of the Office of General Counsel in anticipation of imminent
litigation and adversarial administrative proceedings. Therefore all correspondence or other
written communication with the District should be addressed to me and to you. If you have not
"already received a letter with these types of instructions in detail, you will shortly. In the mean
time, the following is a summary of what that letter will describe.

Any draft or preliminary report that IFAS submits to the District should be stamped with the
following language:

THIS IS A DRAFT AND IS NOT INTENDED TO BE A PUBLIC
RECORD UNTIL FINALIZED.


The final report prepared pursuant to the contract should bear the following legend:
