Meeting to Discuss Amendments to 40D-2 Rule

Date: September 7, 1994

This meeting is for public supply, agricultural and industrial
water users to organize and divide the rule into relevant sections
for the proposal of amendments for each user group. In addition,
in the event that the amendments are not adopted by the District,
the strategy for the potential rule challenge.
Our first meeting has lead to a successful result of having
the proposed 40D-2 Rule published on August 26, 1994 withdrawn.
Due to the combined efforts of the counties, agricultural and
industry groups through both letters to each Governing Board Member
and presentations at the meeting, the Governing Board unanimously
approved a motion withdrawing the current proposed rule with the
instruction to staff to republish it within thirty days.
The motion to withdraw the proposed rule and republish it in
30 days was made by Roy Harrell (Pinellas County Board member)
after he discussed the need to move forward quickly to institute
the rule. A number of other Governing Board members echoed Mr.
Harrell's statements opposing the delay of the rule but ultimately
the Governing Board adopted the motion by unanimous vote.
The Governing Board set the September 19, 1994 meeting on the
economic impact statement to include consideration of amendments to
the rule language. The Governing Board requests the public to send
its amendments to the rule directly to each of them by September 14
in order to allow time for review prior to the meeting. The

Governing Board plans to act on the Distriot staff's
recommendations on the rule amendments at its September 28
Governing Board Meeting. The Governing Board is scheduling the
final hearing for adoption of the rule for its October 26 Meeting.
Mr. Harrell's motion calls for the August 26 version of the
rule to be republished in 30 days. If District staff and the Board
approve any further amendments, those will not be published until
after the September 28 Governing Board Meeting. This will require
the rule to be published twice; therefore, the Distriot staff may
recommend publication only after the September 28 meeting to reduce
publication costs.
