0 Dear Jim,
1' I am amazed by your proposal to back up and start over on
40D-2 and the SWUCA rules.
In part this is because you were even more impatient than I
in insisting two years ago that we get on with it and do it
quickly. But much more amazing is the matter of attitude.
On several occasions, you have upbraided, criticized or
gently Dutch-uncled me about what you perceive as my overly
critical and disrespectful attitude toward some members of
the staff. And somewhere or other in the September meeting
you told the board at large that "we must support the staff"
even though you disagreed with it on something or other.
3 Proposing issue-specific amendments is one thing. But the
proposal in your letter to board members is nothing but a
0 call for a vote of no confidence in the staff and Its more
than two years of work on proposed rules to try to rescue
=P the resource--which you have often insisted we must do.
Y No Rule is perfect. All Rules are amendable. I still believe
there is an urgent need to get on with doing snnUthin~
So, I want you to understand that unless you are prepared to
convince me publicly, speaking clearly into the microphone,
that the results of the years of staff work encompassed in
that document are so thoroughly faulty as to be irredeemably
flawed (this explanation should include guidance as to
whether those who did the studies and the work are simply
incompetent or have wilfully tried to mislead us) I will not
vote for your motion to recall and remand.
