Dear Joe,

I am upset over the notice in the agenda package that there
will be no discussion of the proposed new rules for the
Southern Water Use Caution area at the October meeting. And
I am seriously concerned over the manner in which that
decision was reached.

In my opinion, the board publicly made, by formal, recorded
vote, a definite decision--which is to say a commitment--to
take final action on the SWUCA rules at the October meeting.

I believe a review of the tape of the discussion at the
August meeting would confirm my clear recollection that we
agreed to (1) republish the proposed rule, (2) hold one more
(clearly referred to as the last one) work shop in mid-
September for all critics to tell us, without time limit,
what they wanted changed, (3) to discuss all of those
proposals and act on proposed changes at the regular
September board meeting, and <4) take a final vote on the
rule at the October meeting.

We did the first three.

When Mark Farrell called me about your wish to hold still
another last meeting, I did not understand that you were
taking a vote, which is how one reporter told me it was
described by one of our public information people, and I
think I would have protested if I had realized that's what
he was doing for you.

My understanding from Mark's comments was that your wishes
for an additional meeting and further delay would be voted
on at the October meeting--which is why I asked him to tell
you that I would vote against any further delay.

And therein lies my concern with the manner in which you
arranged to privately void a decision which the board had
publicly made at its August meeting.

To the best of my recollection, in all other scheduling
matters concerning the SWUCA rules, the board has discussed
and voted openly,' in a setting where those concerned about
the rule changes were aware in advance of where we would be
and what we would be doing.

I believe strongly that this,is the way it ought to be.

I suggest to you that the decision to close the October
meeting to all discussion of the SVUCA rules and to convene
in mid-November to do so was improperly achieved, and was in
no way in keeping with our past policies on such matters.

I therefore respectfully request that you return the
proposed adoption of a revised 40D-2, including proposed
rules fOde the Southern Water Use Caution Area, to the agenda
for the October 31 meeting of the board, and,that any
additional postponements in adopting the rule be made by the
board, in open session, at that meeting.
