3. Pinellas County's Petition to Initiate Rulemaking to Adopt Minimum Levels and Flows

Florida law in Section 120.54(5), Florida Statutes, allows persons to petition the
Governing Board to initiate rulemaking to adopt or amend agency rules. Pursuant to that
law, Pinellas County has filed a petition requesting that the Governing Board initiate
rulemaking to adopt a schedule for establishing minimum flows and minimum water
levels for all surface and ground waters within the District's jurisdiction. The petition
proposes that by July 1, 1995, the District adopt by rule the following schedule:

(1) By January 1, 1996 adopt minimum levels for Floridan aquifer in Northern
Tampa Bay Water Use Caution Area;

(2) By January 1, 1997 adopt minimum levels for Floridan aquifer for the rest of the
District;

(3) By January 1, 1998 adopt minimum flows and levels for each discrete waterbody
and watercourse within the District; and

(4) By January 1, 2000 adopt minimum levels for all remaining aquifers District-
wide.

Copies of the petition and a proposed final order will be provided in the supplemental
mailing.
