WHEREAS, the Fifth Judicial Court of Hernando County has ruled that, if

implemented, said boundary amendments would so materially revise the configu-
ration of the Southwest Florida Water Management District that it would no
longer be the special taxing district it was before the Florida Constitution
was revised in 1968 and would, therefore, be subject to loss of its ad valorem
taxing authority; and

WHEREAS, loss of said taxing authority would cause vitally important water
management problems now being faced by the Southwest Florida Water Management
District and the Central and Southern Florida Flood Control District to con-
tinue to worsen unabated, unless other sources of funding could be obtained;
and

WHEREAS, there is no apparent alternative source of such funding, esti-

mated this year to be approximately $30 million; and

WHEREAS, the general intent of the Legislature, as expressed in the Water

Resources Act of 1972, is that ad valorem taxes be the primary source of fund-
ing for water management districts; and

WHEREAS, the Legislature of the.State of Florida has determined that a

viable method of resolving the aforementioned problems is through a constitu-

tional amendment that would enable the Legislature to authorize ad valorem tax
levies.for water management purposes throughout the State; and

WHEREAS, said constitutional amendment will be placed on the March 9,
1976 Special Election Ballot pursuant to authority provided by the Florida
Legislature at its 1975 Session for consideration by Florida registered voters.

RESOLUTION NO. 630

EXPRESSING THE BOARD'S POSITION IN SUPPORT OF AN AMENDMENT
-. .TO THE CONSTITUTION OF THE STATE OF FLORIDA TO AUTHORIZE
AN AD VALOREM TAX FOR WATER MANAGEMENT PURPOSES



WHEREAS, the Water Resources Act of 1972, as amended, mandates a change

in the boundaries of the Southwest Florida Water Management District and the
Central and Southern Florida Flood Control District; and.. .

NOW, THEREFORE, BE IT RESOLVED that the Board of Governors of the South-
west Florida Water Management District hereby sets forth its position as being
strongly in favor of said amendment; and

BE IT FURTHER RESOLVED that the Board of Governors of the Southwest Florida
Water Management District urges all Florida voters to vote in favor of said
amendment on March 9, 1976.
