Re: SWFWMD v. J. W. Baker (Baker Hide & Fur)


Dear Buddy:


With further reference to the above styled matter,
and our letter to you of July 23, 1976, please be advised
that we desire to put SWFWMD on notice that we intend to
hold them directly responsible for any damages attributable
to flooding of Mr. Baker's residential and/or business proper-
ties.


The action taken by SWFWMD to correct past instances
of flooding of Mr. Baker's land are totally inadequate, and
it is readily apparent that such steps will not prevent flood-
ing should we experience heavy rains, but on the contrary will
result in severe flooding of Mr. Baker's land. I need not
call your attention to the law on this subject in this state,
but it is well established under the law of Florida that no
person or instrumentality of government has the right to flood
the land of a property owner or to gather and divert waters,
thereby causing them to flow onto the lands of the adjoining
property owner. See, for example: Lawrence v. Eastern Air-
lines, 81 So.2d 632, and New Homes of Pensacola v. Mayne,
169 So.2d 345.


Rather than awaiting the inevitable damages and subse-
quent litigation, we urge SWFWMD to take prompt and adequate













steps to correct a potential
