Dear Mr. Dunn:


I will be unable at this time, to give you the letter you
that the temporary easement encumbering D.O.T.'s proposed
referenced parcels is "no longer needed by the District".

I have been advised by our Project Development Section that the land can not
be released until our Structure 159 has been completed and accepted. In
addition, the Corps of Engineers to whom the land is certified for construct-
ion does not expect completion until August 1981 which is, of course, subject
to change and further that the parcel is required for drainage for the project
during construction.

The certification to the Corps of Engineers for this portion of the project is
scheduled to expire on January 1, 1982; therefore, I would suggest that you
recommend that D.O.T.'s contract document state.that the referenced lands will
not be available for use until January 2, 1982 and/or until such time as the
Corps' work is complete and the District has accepted the same which may be
sooner than January 2, 1982 as mentioned above.
