7. The proposed plant site will be fenced with four-strand
barbed wire by Ballenger and all materials and wastes
generated by the plant shall be contained within the
fenced enclosure.

8. Access road(s) to and from plant will be stabilized with
six (6) inches of lime rock compacted to 95% density by
Ballenger before commencement of construction, and used
jointly by Ballenger and the District. The estimated cost
to Ballenger to accomplish this would be $10,000.

9. There will be no solid discharge in connection with plant
operation and water discharge and runoff control practices
will be performed. Ballenger shall comply with Section 104,
"Prevention, Control, and Abatement of Erosion and Water
Pollution," of the Florida Department of Transportation
Standard Specification for Road and Bridge Construction."

10. All areas disburbed by construction operations shall be
graded (if necessary), seeded and fertilized in accordance
with Section 570, "Seeding and Mulching," of the Florida
Department of Transportation Standard Specification for
Road and Bridge Construction and Ballenger shall assume
full responsibility for the maintenance of the seeded areas
until grassing has been fully established and accepted by
the District.

11. Ballenger shall not remove any trees, brush or vegetation
without permission from Land Management.

12. The integrity of the canal shall be maintained and no
modifications made to the canal banks or bottom without
prior written permission.

13. The District reserves the right to terminate the Right-of-
Entry after ten (10) days prior written notice to Ballenger
Corporation.
STAFF RECOMMENDATION:

1. Approval for staff to prepare a Right-Of-Entry including the terms
and conditions outlined above.

2. Appoint a member of the Board to review the document prior to
execution.

3. Authorize the Executive Director to execute the document on
behalf of the Basin subject to Legal Department's review of
same.
