l I. Government in the Sunshine/Sunshine Act
A. Intent to promote open government Let public see how
and why public officials act
B. Liberally construed by Attorney General and courts in favor
of open government
C. Requirements:
1. Open public meetings of governing boards
a. Two or more members
b. Includes all phases of decision-making process
c. Can include telephone conversations or written
communications
2. Reasonable Public Notice
a. Usually 7 days publication FAW takes 2-3 weeks
b. Exception for emergencies
3. Staff Exception can be lost if move from fact-finding
and advising to decision-making
4. Violations -
a. Any violation fine
b. Meeting violation 2nd Degree to misdemeanor


II. Public Records
A. Includes all documents, papers, letters, maps, books, tapes,
photos, recordings, or other materials, prepared in
connection with agency business intended to communicate
or formalize knowledge of some type.
B. Are open to personal inspection by any person
SC. Can include communications to and from Board members
