BASIS OF REVIEW FOR
SURFACE WATER MANAGEMENT PERMIT APPLICATIONS
WITHIN THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT
JANUARY 1988 APRtt 1980
3.1.2 Land Use Considerations In order to receive a conceptual approval
and/or construction and operation permit from the District, the proposed land use
to be served by a surface water management system for which a letter of conceptual
approval and/or a construction and operation permit is requested is not required to
be consistent with the affected local government's comprehensive plan and/or
existing zoning for the site. However, this does not relieve a permitted of the
responsibility for obtaining the required local government land use and other
approvals prior to initiation of construction. Therefore, it is strongly recommended
that an applicant obtain the necessary land use approvals from the affected local
government prior to permit application since these approvals often contain
conditions which impact the overall project design and, hence, the type of surface
water management system design which is proposed. By obtaining these local
government approvals first, the applicant can reduce or eliminate the need for
subsequent permit modifications which may be necessary as a result of conditions
imposed by the local government.
Should these local land use approvals be-obtained subsequent to the issuance
of the District's letter of conceptual approval and/or construction and operation
permit, the applicant should be aware that a modification to the letter of
conceptual approval and/or construction and operation permit may be necessary
prior to initiation of construction in order to bring the permitted surface water
management system design into conformance with the overall project design
approved by the local government. Due to the amount of time which may be

involved in processing such a modification, the applicant is encouraged to initiate a
mod fication application as soon as possible in order to prevent construction delays.

3.1.2.1 For projects which are or presumptively may be a Development
of Regional Impact (DRI) pursuant to Section 380.0651, F.S., it is recommended that
the applicant obtain a final approved (all appeals resolved or all appeal times
expired) Development Order (DO) prior to permit application for the same reasons
noted above. Exceptions to this recommendation would be mostrave beer, issued

have been granted, site plan and/or subdivision approvals have been
granted, final plats have been recorded, building or construction

Department of Community Affairs to allow a portion of the DRI to
proceed prior to the issuance of a DO, provide a copy. If the DRI
Application is being filed concurrently with a request for conceptual
agency review and/or a local government' comprehensive plan
amendment, indicate the status under the DRI process and, if
appropriate, include a copy of the comprehensive plan amendment
