Port-of-Spain Carnage licenses.

No. 57-1912.

AN ORDINANCE relating to Carriage Licenses in Port-
of-Spain.

BE it enacted by the Governor of Trinidad and Tobago
with the advice and consent of the Legislative Council
thereof as follows :
1. This Ordinance may be cited as the Port-of-Spain short 'te.
Carriage Licenses Ordinance, 1912.
2. This Ordinance shall apply to the Town of Port-of- Applcation of
Spain as defined in the Port-of-Spain Ordinance, No. 211. Ordnaieoo
3. In this Ordinance, the term Interpret.-
tion.
"Carriage" means any vehicle (except a hackney
carriage) drawn by any animal, and also any motor car, but
does not include a waggon, cart, motor or other vehicle
which is used solely for the conveyance of any goods or
'burden for hire or m the course of trade.

"Motor Car" means any mechanically drawn or pro-
pelled vehicle solely or mainly adapted for the conveyance
of persons, not being a motor bicycle or motor tricycle and
not plying for hire or exclusively kept or let for hire.

"Motor Bicycle" means any mechanically propelled
bicycle.
Motor Tricycle means any mechanically propelled
tricycle.
The Board" means the Port-of-Spain Town Board as
constituted under the Port-of-Spain Town Board Ordinance,
1907.

The Town Clerk and Treasurer means the person
holding the office of Town Clerk and Treasurer for the time
being, and includes any person for the time being performing
the duties of Town Clerk and Treasurer.

The Town" means the Town of Port-of-Spain, as
defined by the Port-of-Spain Ordinance, No. 211.

to be ee any carriage, motor-car, motor-bicycle or motor-tricycle
kept in the Town or within two miles from any part of the
limits thereof unless he has a license in force for the same;
and there hall be paid to the Port-of-Spain Town Board
in respect of every such license a license fee according to
the rate specified in the first schedule to this Ordinance.

zEvery person offending against this section shall be
liable to a penalty not exceeding Forty Shillings for each day
that he keeps or uses any such carriage, motor car, motor-
uivycle or motor tricycle in the Town, and in default of
payment to imprisonment for any term not exceeding one
month.
Term of and 5. Every such license shall be granted either for one year
i e..en. or for three, six or nine months, and there shall be paid to
the Town Clerk and Treasurer in respect of such licenses
such sums of money as are specified in the First Schedule
to this Ordinance.

office of business of every owner, the number of every such
license, the date whereon and the time for which such
license shall have been granted and the sum paid for the
same.

7.-(1.) Bdfore any license under this Ordinance is l ms~niAwfo
granted a requisition for the same shall be made and signed a Ie.

(a.) By the owner or one of the owners of the
carriage, motor-car, motor-bicycle or motor
tricycle in respect of which such license is
applied for; or

(b.) In the case of a body corporate or public com-
pany, by an officer or by the secretary thereof.

(2.) In every such requisition there shall be set forth
the Christian name and surname of every owner of such
carriage, motor-car, motor-bicycle or motor tricycle, or in the
case of a body corporate or public company the title or name
thereof, and in every case of a partnership the firm thereof,
and in every case the place of residence or office of business
of every such owner, body corporate, company or firm.
Every requisition for a license for a motor-car shall specify
the seating capacity of such motor-car. Every such requisi-
tion shall be left at the office of the Town Clerk and
Treasurer.

(3.) Every such requisition shall be received as evidence Evidence.
and be deemed proof of all matters therein contained as
against the party applying for such license.

(4.) Every person who on applying for a license does Fal
not set forth fully in such requisition any of the particulars
hereby required to be set forth shall be guilty of an offence,
and on summary conviction thereof shall be liable for every
such offence to a penalty not exceeding Forty Shillings and
in default of payment to imprisonment for any term not
exceeding one month.

Fom of 8. Every license shall bear date the day on which it is

(a.) A distinguishing number.
(b.) The full name of everyowner of the carriage,motor-
car, motor-bicycle or motor tricycle in respect of
which such license is granted, except in the case of
a body corporate or public company, in which case
it shall be sufficient to name an officer or the
Secretary thereof.
(c.) The place of residence or office of business of
such owner, body corporate or company.
(d.) The term for which such license is granted.
(e.) The fee paid for such license.

Forgigor 9. Every person who shall forge or counterfeit or cause
counteeiting to be forged or counterfeited any license under this Ordi-
S nance shall be guilty of felony, and being convicted thereof
shall be liable to be imprisoned with or without hard labour
for any term not exceeding twelve months.
Procedure. 10. The form and manner of procedure in all cases aris-
ing under this Ordinance shall be that prescribed by the
Summary Conviction Offences (Procedure) Ordinance, No. 1.
Government 11. Nothing in this Ordinance contained shall be con-

be payable in respect thereof.

the Port-of-Spain Town Board.
Passed in Council this Twenty-seventh day of Novem-
ber, in the year of Our Lord one thousand nine hundred and
twelve.

THE FIRST SCHEDULE.

Fees Payable for Licenses.

For every Carriage, at the rate of Five Shillngs per wheel per annum.
For every Motor Car capable of seating two persons, at the rate of Two
Pounds per annum.
For every Motor Car capable of seating more than two persons, at the rate
of Three Pounds, Ten Shillings per annum.
For every Motor Bicycle, or Motor-Tricycle, at the rate of One Pound
per annum.
