San Fernando Wheel Tax.

No. 32.-1912.

2nd July.

AN ORDINANCE relating to Wheeled Vehicles in San
Fernando.

BE it enacted by the Governor of Trinidad and Tobago
with the advice and consent of the Legislative Council
thereof as follows :-
1. This Ordinance may be cited as the San Fernando Short Title.
Wheels Ordinance, 1912.
2. This Ordinance shall apply to the Borough of San ;,flPctiOie of
Fernando as defined in the Municipal Corporations Ordi-
nance, No. 210, or any Ordinance amending or repealing the
same.
3. In this Ordinance the term Interpreta-
tion.
"Mayor and Burgesses" means the Mayor and
Burgesses of San Fernando.
"Carriage means and includes all vehicles on springs
drawn by a horse or other animal.
"Motor-Car" means and includes all mechanically
propelled vehicles.

"Motor-Van" means and includes all mechanically
propelled vehicles and machines used for the conveyance
or porterage of goods, wares, merchandise or other burden,
and traction engines.
Motor-Omnibus means and includes all mechani-
cally propelled vehicles used for the conveyance of
passengers standing or plying for hire.
Motor-Bicycle" means and includes all mechanically
propelled bicycles.
Licenses 4. Unless the license from the Mayor and Burgesses
under the hand of the Town Clerk and Treasurer shall
have first been obtained, it shall not be lawful for any
person
(1.) Being the owner of any carriage, motor-car,
or motor-bicycle to keep or allow to be kept
any such carriage, motor-car, or motor-bicycle
within the limits of the said Borough.
(2.) Being the owner of any motor-omnibus to keep
or allow to be kept or to ply or cause to ply any
such motor-omnibus for hire within the limits
of the said Borough.
(3.) Being the owner of any motor-van to keep or
allow to be kept any such motor-van within the
limits of the said Borough or to use or allow
to be used such motor-van for the conveyance
of goods, wares, merchandise or other burden
from or to any place within the limits of the
said Borough.
Any person acting in contravention of this section shall
be guilty of an offence and on summary conviction shall be
liable for each offence to a penalty not exceeding Ten
Pounds, and in default of immediate payment shall be
imprisoned with or without hard labour for any term not
exceeding three months.
Term of and 5. All such licenses shall be granted either for one year
icns. or for three, six or nine months and there shall be paid to
the Town Clerk and Treasurer of the Borough in respect of
such licenses such sums of money as are specified in the
Schedule to this Ordinance.

6. The Town Clerk and Treasurer shall in a proper book Register of

license, the date whereon and the time for which such
license shall have been granted and the sum paid for
the same.
7. Before any license under this Ordinance is granted a Requisitionfor
requisition for the same shall be made and signed sense.
(1.) By the owner or one of the owners of any
carriage, motor-car, motor-van, motor-omnibus,
or motor-bicycle in respect of which such license
is applied for; or
(2.) In the case of a body corporate or public com-
pany by an officer or by the secretary thereof.
In every such requisition shall be set forth the Christian
name and surname of every owner of such carriage, motor-
car, motor-van, motor-omnibus, or motor-bicycle or in the
case of a body corporate or public company the title or name
thereof, and in every case of a partnership the name of the
firm, and in every case the place of residence or office of
business of every such owner, body corporate, company or
firm. Every requisition for a license for a motor-car shall
specify the seating capacity of every such motor-car.
Every such requisition shall be left at the office of the
Town Clerk and Treasurer.
8. Every such requisition shall be received as evidence Evidence.

against the party applying for such license.
Every person who on applying for a license wilfully False
omits to set forth fully and correctly in such requisitionparticulars.
any of the particulars hereby required to be set forth shall
be guilty of an offence and on summary conviction shall be
liable for each offence to a penalty not exceeding Forty
Shillings, and in default of payment thereof shall be
imprisoned with or without hard labour for any term not
exceeding one month.
9. Every license shall bear date the day on which it is Form of

(2.) The full name of the owner of the carriage,
motor-car, motor-van, motor-omnibus, or motor-
bicycle in respect of which such license is
granted.
(3.) The place of residence or office of business of
such owner.
(4.) The term for which such license is granted.
Procedure. 10. The form and manner of procedure in all cases aris-
ing under this Ordinance shall be that prescribed by the
Summary Conviction Offences (Procedure) Ordinance, No. 1.
Government 11. Nothing in this Ordinance contained shall be con-

Majesty keeping or allowing to be kept any carriage, motor-
car, motor-van, motor-omnibus, or motor-bicycle used and
employed exclusively in His Majesty's service, and no
license shall be required in respect thereof.
Commence- 12. This Ordinance shall come into force on a day to be
ient. proclaimed by the Governor.

of Our Lord one thousand nine hundred and twelve.
