Pretty soon, ve are going to be available. The price? Theyre free. Carysfort, Sand Key, Alligator, Sombrero and American Shoal, all built in the 19th century, none younger than 138 years, were designated excess property last month by the U.S. Coast Guard. They are now in the hands of the General Services Administration, which holds and manages government property and will give the lighthouses away if it can. Not just anybody can have one. You have to have a government agency federal, state, or local or an educational agency or community development organization, to take one over. Then your outt has to be able to take care of the lighthouse if you get it, and to make it available for education, park, recreation, cultural, or historic preservation purposes for the general public, at reasonable times and under reasonable conditions, according to the National Park Service, which has a lot of online info about historic lighthouses. Those requirements are in the National Historic Lighthouse Preservation act of 2000. Some people might be discouraged by that, considering how expensive and technical such a project seems so sure to be all with little to no hope of making a buck off it. It is not discouraging to Lighthouse Larry Herlth. He is well known in the Keys for building those ubiquitous replica lighthouses that visitors notice standing like cigar store Indians of old, in front of businesses along the Overseas Highway. One marks the entrance to the city of Marathon. David Goodhue at Florida Keys News Bureau reports that Herlth is starting a non-prot outt to acquire Alligator Reef Light, which stands off Islamorada more precisely 4 nautical miles east of Indian Key on a shallow bank north of the true Alligator Reef. Heath is founder of a signature Middle Keys nThe mourning period for the late Bug Light is beginning to come to an end. A new articial reef, four years in conception and planning, is almost ready for construction off the southeast shore of Key Biscayne. The location is 2.25 nautical miles north-northeast of where Bug Light popular nickname of the Biscayne Channel marker for 85 years marked the ocean entrance to the channel running alongside the southern shoreline of Key Biscayne. Its the same distance due east of the beach at Bill Baggs Cape Florida State Park. The water there is about 23 feet deep. The top of the reef should be 15 feet b elow the surface at low tide. Can there be a suitable atonement for the sneaky total desecration of Bug Light? It was akin to a shrine, standing 16 feet tall, ashing its red light every two and a half seconds. There, shing pilgrims prayed for and were given gazillions of baitsh between its commissioning in 1929 and its demolition in 2014. A moment of silence, please, in its memory. Amen. Charter captains, baitmongers and individual anglers wept, wailed, gnashed their teeth and rented their garments. If they had known ahead of time, it might have made a difference. Maybe not. Eighty-ve years is a long life for any channel marker. Bug Lights rusty, barnacled legs were event, the annual (in September) Swim for Alligator Lighthouse. It raises money for student scholarships and awareness of the lighthouse. It would make it quite difcult to have the event if there was no lighthouse there, Herlth was quoted. Thats not his only motive: The reason I feel we need to save these lighthouses is that, number one, they are a major part of our maritime history of the Florida Keys. They are the reason we enjoy the Overseas Highway. Early attempts to replace it at the same spot began at once and failed. Everybody got mad. Bruce Marx did too, but then he got going and created the Bug Light Shoal Articial Reef Project. Marx is the Miami maritime lawyer whose further crusades would prevent destruction of the Bent Range Marker (another great bait site) in 2015 at Government Cut, establish the South Florida Marina & Boat Watch group this year on Facebook to ght theft and then start a related movement to make marine electronics manufacturers thief-proof their devices. Marx said Miami-Dade Countys Department of Environmental Resources Management (DERM) was preparing in late October to start a contract bidding process. Federal, state and local permits had been obtained. A 125-ton load of donated concrete pipes and scraps was stockpiled. Thats to be surrounded by a box-like border of lime rock, 300 feet by 300 feet on a bottom about 23 feet down at mean low water. The top of it will be 15 feet or lower below the surface Marks said the cost of building it looks like $30,000 to $40,000. The moneys already in hand, as excess from fund-raising to repair vandalism at the Bent Range Marker project. No one can know for sure if the new Bug Light reef will attract the schools of pilchards, threadn herring, speedo and other baitsh that the true Bug Light used to harbor. And theres no plan to stand a lighted marker on it, so bait hunters will have to use the GPS coordinates to nd it. The center is at north latitude 25.40.765 and west longitude 80.06.765. With no light, will Bug Light still be an appropriate name? Why not? We often name things money, for example, and courthouses and highways, after something or someone we admired in life and remember fondly. There is no guarantee that the new reef, named or not, will live up to its generic name Fish Attracting Device, or FAD. It likely wont right away, but if and when it does we can decide what to call it. Probably then, its name and the reason behind it will be well documented so that 85 years in the future it can be written about authoritatively. We are tempted to assume now that Bug Light earned its nickname as a good spot to nd lobster, which are nicknamed bugs, but beware of assumptions. When published, they are bound to be wrong. We asked Marx if he knows, but he is more activist than historian. That is a very good question, he answered. I don't know where that came from. (954) 424-3844 FAX (954) 424-9899 Fishing buddies blend together like mismatched socks fntbbntHeadwind and Justin Casey came back from the Ten Thousand Islands (as those two usually do) with a shing/boating report that made some of us wish we had gone with them and some of us glad we had not. Us and we are members of the Fish or Cut Bait Society, a motley lot of shing-doers, like a dresser drawer full of unmatched socks. An outsider would suppose no two of us could tolerate one another, much less sh together, but we can and do. These two, Headwind and Justin Casey, are a particularly peculiar pair. Headwind is the type who grabs a tackle bag with his left hand and all the rods and reels he can carry with his right, drops the stuff into his pickup and takes off. Sure, hes tried keeping checklists, only they keep getting lost. Planning and preparation are not his style. Spontaneity is. Just before he gets to I-95, Headwind pulls off at a 7-11 store and studies the tackle hes brought, as though he hadnt seen it before. Depending on what it is, he drives north, south or west, to saltwater or freshwater. I know it looks helter-skelter, he says, but I like to wing it and do things the hard way. Thats why theres no kind of trouble I cant get out of. They dont call me Headwind for nothing. That is one reason we call him Headwind. Another is that weve all forgotten his real name. Justin Casey is the opposite type, ready for anything and overlooking nothing. Just in case of something, he carries at least two of everything. I do mean everything. You carry one spare tire, right? Right, you and everyone else, but that Justin Casey, he has two spare tires just in case he gets two ats. In his mind, its Headwind whos the nut. Oh, that Headwind! Justin exclaims, I swear he purposely creates a crisis, just to prove he can squirm out of it. Maybe Im a little crazy too, but theres method in my madness. Headwinds got madness in his method. They went over to the Gulf Coast to sh for two days on Headwinds little boat, 15 feet, four inches long, 39 inches wide with a 9.8 hp outboard, a cross between a skiff and a canoe, ideal for the mostly shallow inshore territory of Everglades City and Chokoloskee. The Ten Thousand Islands, between Marco and Everglades National Park, are infested with oyster bars, mangrove deadfall and surprise mudats. You dont need much water under you with that boat. She draws scarcely more than a canoe, a good thing over there. Almost all the Ten Thousand Islands are where the marine chart says they are, and so is all the water, and sometimes the depth is what the charts say its supposed to be. Sometimes, maybe most times, it seems to me that it isnt. Im pretty sure last years Hurricane Irma altered the bottom a lot, not that it was charted accurately before. Going by what was left of Everglades City a year ago, Headwind and Justin were surprised the storm surge didnt carry off the whole bottom of Chokoloskee Bay. Tangled in mangroves there and well upstream on Turner River, they saw pieces of houses that are likely to remain there until they disintegrate. In some places (but not enough) on the chart it says local knowledge required, and thats correct, but nothing tells you what the local knowledge is. You learn it by hitting bottom, bumpity bump, gouging your outboards skeg, nicking your propeller blades and dinging your hull. Headwind keeps a patching kit in his little boats little storage compartment. Justin Casey bought him a second kit, just in case. Because Headwind hates planning and preparation, he let Justin do all that. It was part kindness on Headwinds part, and part cruelty. Justin was glad to do it, but doing it drove him up the walls, Headwind told us. Other than rods and reels in the racks, if you put two of anything on my boat then you cant put one of something else on it. Justin fretted constantly about all the spare stuff we didnt have room for, except when sh were biting. When he paused for breath, Tiller, whos chairman of the steering committee, leapt into the breach. Tell us about the shing, Tiller commanded, and Justin told. On day one the weather forecast was kind of windy for the boat, so we went up the Turner and got a few hard strikes that missed our lures, he said. The water was dirty and we couldnt see the sh. They probably were sea trout or small snook. We boated one snook, about 18 or 20 inches. What do you mean, we? Headwind said. I caught

rf that snook. Anyway, Justin continued, that was the only sh brought to hand that day. The next day, nearly breezeless on calm open bay water, there was more action, a lot more, but not a single keeper-size sh was caught. Headwind blamed Justin for that because Justin was on the bow, running the trolling motor and mis-positioning them all day. Justin said it was Headwinds fault because he was the captain and should have realized their tipster was wrong if not outright misleading them. Thus stalemated, they agreed to blame another guy theyd met in a restaurant, who had advised them where to go for their second days shing. Tiller asked where that was. We shouldnt say where. Those are that guys spots. What if nobody else knows them? Justin said. What if nobody else shes there anyway because everybody knows all the sh are small? Headwind answered. Tiller ruled for compromise to just say it was Chokoloskee Bay, no other speci cs, with the emphasis on the sh, not the location. Thus relieved of ethical burden, our friends spoke freely of hauling aboard and setting free numerous sea trout, most of them about a foot long and the longest about 14 inches. Thats an inch short of keeper size bad because keeping the sh would be illegal, good because neither man would feel like lleting anyhow at the end of a long day. The highlight of that day was an eye-bulging sh that came about halfway out the water to smack a soft plastic white lizard that Justin had on his hook. It looked like either a tarpon or a big snook, he said. Probably a tarpon, Headwind said. I think it was a snook, Justin Casey said. It was a tarpon because I want it to be a tarpon, Headwind said. I appreciated their story enough to print it, so I went to the cooler and pulled beers for the three of us, on my tab. Played with perfect comedic timing by the late Phil Hartman, heres how Caveman Lawyer gave his closing arguments: I am but a simple caveman. All your ways are strange and confusing to me. There is so little about your world I understand, except this one thing My client is entitled to compensation for his loses!! Behind his feigned confusion, Caveman Lawyer seemed to understand legal doctrines better than most people. Considering how confusing the law can be, I wonder how he would interpret maintenance and cure, which addresses a seamans right to care for injuries and illnesses occurring while in the service of a vessel. This is a perplexing legal concept, even among many in the maritime profession. Designed to protect a specic type of worker, for those who toil at sea it just might be the most important legal right a seaman has. Perhaps the best way to review what maintenance and cure is would be by acknowledging what its not First and foremost, its not workers compensation, though often its explained that way to the uninitiated. They are both two completely different doctrines created for different purposes. Heres some background: in the latter 19th century workers comp contracts were crafted as an incentive to recruit factory workers by offering compensation for injuries. For companies, these agreements also limited their liabilities regarding such injuries. Realizing the benets of this system in a fast-growing industrial economy, workers compensation was rst codied and made mandatory for large corporations in imperial Germany under Chancellor Otto von Bismarck. Workers compensation was soon adopted by most U.S. states thanks in part to the progressive movement early in the 20th century. While injured workers found a quick remedy, workers comps real purpose was to limit the amount of money that employees could collect from their employers for work-related injuries. By contrast, maintenance and cure is afforded to seamen not through agreement but as a recognized right granted by their special status as they who go down to the sea in ships. This right has existed in most maritime cultures since the days of the Phoenicians, and subsequently became part of British and thereby American law since the reign of Henry II in the 12th century. Unlike workers comp, treatment is not limited to work-related injuries. Usually cure applies to most injuries, maladies or illnesses befalling a mariner while in the employ of a vessel even while on shore leave. Moreover, the burden is on the ships captain and owner to care for the ill or injured seaman as quickly as the situation becomes known, without undue burden to the mariner. As such, maintenance and cure is a much broader doctrine than workers comp. Further, the seaman who accepts maintenance and cure still has the right to seek remedies for liabilities on the part of the vessel, its owners or the seamans employer (which in some cases can be different entities). This means that even when a seaman receives maintenance and cure, claims for unseaworthiness can still be pursued under maritime common law and negligence as addressed under the Jones Act. Keep in mind that these are, in fact, three separate doctrines, even though they are very commonly brought together when legal suits are led, if only to ensure that all the rights of the seaman are being addressed. Also, a seamans right to cure and maintenance extends to the end of their maximum medical cure, which courts tend to interpret broadly. Take the case of Crociere v. Rose, heard in 1996 before the United States District Court for the Southern District of Florida. A seaman was diagnosed with an incurable kidney disorder. Ship owners argued that they were not obligated to pay for continued dialysis or an organ transplant since the seaman had reached the maximum medical improvement from the care already provided. In essence, the seaman was as good medically as he was ever going to be, so their obligation had been fullled, their argument went. Yet without more treatment, the seaman would soon die. Ultimately the court declared that a shipowners obligation continues until it is determined that the seamans overall medical condition can not be improved not just the specic disease or ailments from which he suffers. In other words, treatment that prevents further deterioration or death fall within the scope of a shipowners obligation when providing maintenance and cure. I hope its clear that maintenance and cure is indeed a far more complex, broad doctrine than workers compensation. They are too different to be accurately compared.
