Doctor Porter has forwarded me copy of yur letter dated
22nd. instant to him and his reply for my consideration .
I think that you will discover in my letter referred to by olose
examination that I do not read in the law the power or right for the
State Board of Health to take charge of isolated-or sporatio cases of
small pox, and this is my reason for calling the attention of the Board
to the fact that this part of their expenditures would not meet my ap-
proval or be paid by the State The Board expended in round num-bers
on ancount of small pox oases Thirty-six Thousand Dollars last year.
I found the Board (in round numbers) Fo/rty -five Thousand Dollars over
drawn. I did not. and do not believe that the Legislature intended for
the Board to construe the law as libera.llr as the Board's action would
indicate, I do, not understand that veni the County or C.it is called
upon to treat care for and pay for ugards &o. of every oase of smala
pox reported within its territory I believe that the intention of the
Health laws and the duty of the State County and pity is limited to
threatened epidemics or here the publlo health is in danger, and
therefore I do not encourage any expenditure' by County with the hope
of asking the Legislature of 19o3 to reimburse a County or City for

such expenditures.. If on the other hand a County or City should have
an epidemic, had.extraordinary demand made upon it for the eare of aueh
eases, then I think that the legitimate expenses under such immergenoy
will be properly submitted to the Legislature of 19o3 for relief.
I do not adopt the policy of fastening expenses due and payable by
the State upon the Counties of the State. Neither am I willing for ex-
pense to be fastened upon the State that in my opinion ae not author-
ized by law and should be borne by individuals

prisoner now in jail I have had this matter under advisement for
thirty days as you are aware the sentence stayed and had a very thore
ough investigation made by the States' Attorney who has furnished me
with an elaborate report giving in details the evidence, and I am
thoroughly convinced that Robt. Lee is guilty and I have ordered the
Sheriff to proceed to execute the death warrant I appreciated your
feelings and interest in the matter and shared them until I beeame con-
