On the 1.th inst. I wrote you requesting information on
certain points therein specified, which informat.on.o'" rather a more
perfect knowledge of the facts inquired about, would have aided in
preparing sy ttb"a a demi.'"'er and the pleas, but no reply to that
latter has been received. Having wai tied until it appears that no re-
ply will be received, have concluded not to wait longer and therefore
send you herewi th, the draft of a demurrer, and also a draft of pleas,
that you may examing and caefully consider each, having time to deter-
mine as to whether they properly fit the facts of the case, and also
whether it is advisable to Pile the demurrer at the August nule day,
and let that be disposed oF before th pleas are filed. It. has been
with some doubt and hesitancy that I have p"epa'rd the denmu'rrer. For
some reasons it would be better not to call attention to any defects
in the declaration but to leave them, to tak advantage of at a iiture
state of th- case, in the admission or objecti-on to evidence, in a-rest
of ludgmient etc., but 'there is some risk in this, in that a bad dec-
laration is sometimes cured by a. teredict. Another view of the demurrer
is that i f the judge should sustain the demur"er, and the plainti Pf
i should be unable to mak~ a stronger ease than has been made, it might /
4 di spose of the case entirely. iou will note that the first nat 'er of
f ],aw to be argiad is that no cause of action is shown against the de-
fendants. On the argument of the denvrrer- this fact must.appear on the
face of the papers. By reading each of the fou counts of the declara-
tion carefully, you will find that it is alleged that there were two
tram tracks upon which cable cars were operated for the purpose of con-
veying the phosphate from the pit to the surface; that the plainti ff
was employed at that place; that the customary and usual way for the
employees to pass out o C the pit was upon the tramw tracks. It is then
charged that on the speci fied day the agents P d defendants carelessly,
will~illy and negligently rolled a c C. upor ant track w~rhe-"eon pJa in-
ti ff was attempting to leave th- pit, which was rolled upon and struck
against him, whereby he was injured. This is his case. The'e are sev-
eral reasons why this does not state a cause of action against defIrnd-
ants. Plaintiff was engaged in this business with full knowledge of the
entire modus operandi; that the passage to and from the pi t was over
the tram way, that the-e wA-"e two tram. ways, and that when a car w"as
moving upon one the other was open and free to his use; that when he
explod-d the mine and left it, although the declaration changes that
a car was on the track that he was on, yet the declaration shows that
there was another track open for him to use, and that his going upon
the track upon which th- car was then running was his voluntary act
and in no way the failt of deFendants, as the declaration alleg-s that
the tracks were used for the purpose of removing the rocks from the
pit, and for the purpose of entering and leaving the pit. The declara-
tion does not show that he was obliged to leave the pit upon th- track
chosen by him, but i t shows upon its face that the"e '%as another
track open for his use at that time. HI could( not se eat the track
then being used in removing the phosphate as the one whichh he might
choose to leave the pit, and hold the defend nts responsible for his
own negligent act. The facts stated in the declaration do not show
any liability of the defendants. It is not alleged in the declaration
that the plaintiff did not know that the car was on that partlojiUr
track chosen by 6hAtat the time that he selected that track upon which
to make his ekit. ahe gist of this case is in the negligence4 charged
in sending the ear upon that track at that time, but the allegations
of the declaration rather show thE negligence of the plaintiff in se- .

neglect. No presumptions of negligence e ar authorized in actions by em-
ploypes against their masters, The statute, Chap, 4071, Acts of 1891,
Fla* do not apply to employees of other than railroad companies, and
heno- have no application in this case.

ized representative of the said lessor of any and all shipments of phos-

11. In the event of default in the payment of any rentals or part

thereof, at the time tno snre tayf become due and payable, or in the

evont of failure of tro said lessees to comply with any of the terms of

this lease upon their part for a period of three (5) months, the said

lessor may, at its option, terminate this lease, and be entitled to

rents.

12. It is further understood un.i earned between the parties ito this

lease, that then the said lessees shall have carried out their covenants

and undertakings as above set out, they shall have the ri-ht to remove

all the machinery, railroad iron, and buildings which they may have

placed thereon of any description.

We confirm the recent conversation had
between yourself and our M Gaucher, concerning the
phosphate at White place, Sec. 21, by which you author-
ized Mr. Gaucher as representative of J. Buttgenbach &
Co. to wash at the otr plant` situated on the lands of the
Floral City Phosphate Company the phosphate coming from
the above mentioned White Place.
Mr. Gaucher proposed to you to send
you a man to assist at this washing and to keep account
of the exact quantities of phosphate coming from White place
so as to avoid any difference or contention as to settle-
ment of accounts .
While we thank you for the confidence
you hav-- displayed tow a.r2ds us by refusing to control this
washing, w? think it would pcrh..ps be preferable for both
parties that you place someone there as Mr. Gaucher pro-
posed to you. As we don't wish to cause you any expense
we accept to pay the salary of this person at. the rate
of $1.ooPper day,, during the times that such wrshing is
done. ,*;s phosphate coming from White place, whether
boulder or gravel will anyway be placed on separate kilns.
We would also ask you to extend this
authorization so that in case we ~ase the lands belonging
to yourself which we are now prospecting in Sec. 9, we will
also have the right to wash at the mill which we would erect
upon these lands the phosphate from the White lands which
we hold in the same section.
