Dear Judge:-

I have your of 4th inst., and have carefully noted

contents. The matter of remittances made on claims vs. Williams

and other parties, is, of course, not entirely clear in my memory,

but r r recollection is that we checked over all of the claims for

which you remitted at one time,- or within two or three days,-to

be sure that they were all straight before mailing. But on one

point I am more positive, and that is that we kept after the par-

ties to whom remittances were made until acknowledgements were

received from every one on whose claims you recovered, and I remem-

ber that one of the last things I did in your office before leaving

Brooksville was to check over our claim-book and report to you that

all were acknowledged,- as you had asked me to do.

Were the books all burned as well as letter-files, in your

office? The collection-book marked "Tickler" would show this claim

checked as acknowledged. If this is also last, and you have nothing

but the letter accompanying remittance,copied, this, I should

think, coupled with my statement that remittance was mailed in

proper shape, should induce Glaser, Kuder & Ottensoser, or the

agency from wi;hori the claim came, if it was not sent direct, to

make a thorough investigation of their files, etc,- when I think

the matter will clear itself up. I cannot say that we received

acknowledgement from this particular firm, but am quite positive

that all that lot of claims were remitted for and all acknowledge-

ments in before Sept.3rd, 1896,- the date I left Brooksville.

This is the best I can do for you, and I sincerely hope it

will be of some service in settling the matter satisfactorily.

It seems to me that this matter should have been brought up sooner

if no remittance or report on claim was received by these people,

and the delay in taking it up seems to indicate that it was

settled and not properly recorded in their office, or something of

the kind. If there is anything further that I can do in this

connection, command me.
Hope you are all in good health and enjoying life as you should.
Your name still appears quite frequently in Fla.papers, I see,
which seems to indicate that you are "running smoothly".
Please rieneriier me to Mrs.Jennings and Bryan, and friends.

At last, after much correspondence and annoyance, I have

succeeded in collecting the wuount of money for the McKeovrn heirs. The

net amount as I wrote you was $370/45 and the final cost of Judgment, fil-

ing &c. in the Ordinary's Office was $4.55. This leaves a net balance in

my hands as collected of $365.90. You have previously remitted ime 25.00

for expenses in this connection, all of which was about consumed therefore.

I think a reasonable charge in the matter would be $60.00 as fee for the

collection. I therefore retain $30.00 of the amount and remit you the

balance, thus making an equal division of the fee ($30.00 to each).

Dear Sir:--
Your favor of the 9th inst. is at hand with the let-
ters enclosed, which we return to you herewith enclosed. We
have carefully noted the contents of the same. Our Cash book
and papers on file would show that you had paid us our dividend on
the account of Messrs. Knight & Cobb, but as there is no entry to
that effect it clearly shows that you never remitted us the amount
and taking this into account we can make affidavit, that we never
received the money. You will therefore be obliged to send us
the amount, which is due us. Please send us a Money Order or a
Sdrift for this amount.
We would have never known that a dividend was declared
had not our Mr. Ottensoser run across Mr. Knight anda-'ought that
the claim was worthless. This accounts for our apparent neg-
ligence in not asking you for our share of the claim paid you.
We therefore hope that you will remit us the amount with-
out any further correspondence as we never received it.

We have a note, of S. R. A. Kemp of Riverland, Fla. This
note has been in the hands of Mr. Hendley at one tire but he found
that Kemp was not in his county, therefore sent it over to Mr. G.C.
Martin of your town. He collected, as you will see on the back of
the note herewith enclosed, $6.10 on July 4th and ;5.00 on July 19th
last. Martin charged us 15% for sitfly collecting without any ef-
fort whatever on his part and we objected. He refused to ;.ake it
10% and we asred him, to return the note which he did. He holds
5$.00 costs of ours which he hat not returned, but this maatt r we '
will settle with him,we think, afs we heve written him twice for the '
$5.00.
Now will you take the note for us and collect from Kemp.
He is paying other people-and had the gadl to offer us a note payable
the latter -part of 1900 for this small amount, which, of course, we
refused to accept. We have hundreds of attorneys and we have never
ha-. one to ask us more than 10% for ordinary collections yet,until
we struck :'.artin, in years. If he had suit and had the various oth-
er troubles such ae attorneys are liable to- in making collections '
outside of their irrmdiate vicinity, we would not have objected as
we have often paid v\ory mrach higher fee thah this when we thought A
the cilcumsalines warrant. .

My dear Judge:-

Ool. J. L. Young and myself have just filed a bill in the

case of Duval, Trustee, v. Lastinger et.al. I am informed that you rep-

resent the defendants. I have given notice of an application for in-

junction before Judge Malone at Quincy, Florida, on the 14th inst.

Judges Hooker, Call, and T'hte are all out of the State, and owing to

the existence of yellow fever at Miami and the possibility of its spread

among our east coast towns I did not desire to go before Judge Jones,

and I presume that you will fullyagree with me in this, especially in

view of the fact that the schedule to Quincy is much more satisfactory

than it is to Titusville. I will go on the F. C. & P. Road, leaving

here Wednesday night, and hope to have the pleasure of going with you.

Judge Malone has stated that he will hear us on the date named.
