The relief sought in the above entitled cause is among
other things, a decree of this Court, directing and ordering the
said Defendant,Laura Kedsy Day,individually and as Executtix
of the Estate of Alfred Bryant Day,deceased., to pay all of said
sums secured by said mortgage deeds, and each of them, to Plain,.
tiff herein within time to be fixed by a decree of above Court,
together with all costs of foreclosure and solicitor's fees and
in default of such payment and in default of the redemption of
said property from under said mortgage liens by said Defendants,
a decree authorizing sale of said premises for the purpose of
paying total amount found to be due under terms and conditions of
sald mortgage deeds and of each of them, and in the event of sale
a decree forever barring and foreclosing said Defendants and
each of them and all persons claiming by,through or under them

by the said Defendants,Laura Kedsy Day,individually and as Executrix

are in default for the failure of the said Laura Kedsy Day,individually
and as Executrix of the estate of Alfred Bryant Day,deceased,to pay
and satisfy the said promissory note introduced into evidence as
Plaintiff's Exhibit No. 1 and by her failure to pay and satisfy the
taxes on the property herein being foreclosed upon particularly describ-
ed in the mortgage deed introduced as Plaintiff's Exhibit No. 2 for
the years 1932 through 1935,and by her failure to pay the taxes on the
property herein being foreclosed upon the particularly described in the
mortgage deed introduced as Plaintiffs Exhibit No. 3 for the years 1934
and 1935; that on account of the aforesaid defaults in the covenants
of said mortgage deeds the Plaintiff has elected to exercise his option
to foreclose the said mortgage deeds and each of them.
4. That there is now due the Plaintiff,as of September ,8,1935,
the date of making of Special Master's Report in this cause,-bysaid
Defendant,Laura Kedsy Day,individually and as Executrix of the Estate
of Alfred Bryant Day,deceased,on the said promissory note introduced
in evidence as Plaintiff'sExhibit No.l,the principal sum of $8,500.00
with interest thereon at the rate of 8% from May 18,1936,amounting to
$245.44; that there is also due to Plaintiff by said Defendant the
sum of $425.00 as and for a reasonable attorney's fees for the services
of Plaintiff'sSolicitor rendered in the bringing and prosecution of the
