GUIDELINES FOR SITE SELECTION AND ACQUISITION





I. AIM: It shall be the aim of this guideline to provide a sound

method by which sites may be selected and acquired ensuring

that:

1.1 the acquired site meets the defined needs of the

Using Agency;

1.2 the proposed use of the site is within the

general land use established in the community;

1.3 there is no State or other governmental property

available which will serve the purpose equally

well;

1.4 the site is acquired under fair and equitable

conditions to the State.

II. SITE SELECTION AND ACQUISITION CRITERIA: To provide a sound

basis for the selection and acquisition of a site or sites, the

Using Agency shall develop site selection criteria, which shall

be submitted to the Department of General Services, Division of

Building Construction and Maintenance, for approval prior to

proceeding with site selection. The criteria shall include, but

shall not be limited to:

2.1 General Description a detailed description of

the purpose of the project, providing sufficient

data to fully define the scope of the proposed

development.

2.2 General Location and Area Criteria: A definition

of the general area and location in which the

proposed development will be located and the

reasons therefore.







2.3 Specific Location Criteria: A detailed definition

of a specific site location deemed necessary due

to the Using Agency's program.

2.4 PROPOSED DEVELOPMENT (PROJECT INFORMATION): A general

description of the proposed development of the pro-

ject for the proposed site should be given. It

should include:

(1) an estimate of the gross area of the pro-

posed development;

(2) a general indication as to the type of

development, i.e. compact, campus;

(3) the number of stories;

(4) the approximate ground area required for

the development.

Data should also include general circulation require-

ments, parking requirements, service requirements,

special security provisions, special utility pro-

visions, special recreational and athletic areas,

and special communications provisions.

2.5 Size Criteria The size of the proposed acquisition

shall be delineated as to minimum acceptable,

optimum, and maximum. Please note that there is

a certain point at which too much area will be

detrimental to a project.

2.6 Site Characteristics Required and desirable

characteristics of a site should be delineated.

These will include the proximity to desirable

facilities, preferred zoning, preferred access,

utilities, services, and any other information

affecting the selection of a site for the project







in question.

2.7 Special Constraints or Limitations Any special

constraints or limitations concerning the acquisi-

tion of a site for this project shall be given,

be they economic, political, social, etc.

2.8 Review and Approval Selection and Acquisition

criteria shall be forwarded to the Department of

General Services, Division of Building Construction

and Maintenance, for review and approval prior to

commencing the site search and selection phase.

III. SEARCH EVALUATION AND SELECTION: The following guidelines shall

be applicable in searching and locating a site for evaluation and

selection:

3.1 Search An all encompassing search shall be initiated

by the Using Agency to determine all State, public

and private property available and/or suitable for

use as determined by the Selection Criteria pre-

viously approved.

3.2 Evaluation The Using Agency shall evaluate all

sites identified in accordance with the criteria

previously developed, as to suitability for the

intended purpose. Generally this criteria would

evaluate:

(1) location criteria

(a) physical criteria

(b) conditional criteria such as:

1. proximity to desired facilities;

2. proximity to undesirable facil-

ities;

3. zoning; and








4. community climate of opinion.

(2) physical characteristics

(a) description including size, shape,

legal description, site plat, and

map, topography easement, mineral

rights, etc.

(3) environmental characteristics of the

site

(4) environmental characteristics of the

area

(5) site access

(6) utilities available

(7) services available

(8) definition of any other assets or

liabilities.

3.3 Selection Based upon the evaluation conducted on

all sites identified, the three most suitable sites

will be identified in order of priority and pre-

ference.

3.4 Review and Approval The Using Agency will then

forward the selections to the Department of General

Services, Division of Building Construction and

Maintenance, for review and approval.

IV. PUBLIC OPINION: Pursuant to approval of the site selection by the

Department of General Services, and if it is deemed necessary by

the Department, the Using Agency shall hold a public hearing to

obtain the climate of opinion concerning this project in its

selected location. The results of this hearing shall be reviewed

by the Department of General Services and the staff of the Using

Agency.

V. TITLE SEARCH: After approval of the site selection and upon the

request of the Using Agency, a title search will be conducted

concerning the property selected by the Using Agency. The company

conducting the title search must have the prior approval of the

Department of Building Construction and Maintenance. The title

will be subjected to review by the Department of General Services,

Division of Building Construction and Maintenance, the Using Agency,

and the Board of Trustees of the Internal Improvement Trust Fund.

VI. APPRAISAL: Upon receipt of a satisfactory title search and upon

request of the Using Agency, the Department of General Services,

Division of Building Construction and Maintenance, will obtain an

appraisal of the property in question. As an alternate procedure

the Using Agency may contract for the appraisal, however, the

appraisal must be approved in advance by the Department of Building

Construction and Maintenance. Said appraisal will be subject to

review by the Using Agency, and the Department of General Services.

VII. SURVEY: Upon request of the Using Agency, the Department of

General Services, Division of Building Construction and Maintenance,

will obtain or authorize the Using Agency to obtain a boundary and

area. Said survey shall established property corners by concrete

monuments.

VIII. ESTIMATE OF CURRENT MARKET VALUE: Upon receipt of the title

S search, the appraisal, and the survey, the Using Agency and the

ir/ Department of General Services will jointly establish a fair

market value for the property in question.

IX. NEGOTIATION: Upon authorization of the Department of General Services,

the Using Agency will conduct negotiations with the owner pursuant to

obtaining the selected property, at or under the estimated fair

market value determined.








Upon successful conclusion of the negotiation or if the negotiation

proves to be unsuccessful, and eminent domain proceedings are nec-

essary, the Department of General Services shall submit the selection

to the Board of the Department of General Services.

X. BOARD ACTION: The Department of General Services shall submit to

the Governor and Cabinet, sitting as the Board of the*Department

of General Services, a request to obtain the selected property,

in accordance with the price, as negotiated, or to acquire said

property by eminent domain.

XI. ACQUISITION: Upon authorization of the Governor and Cabinet,

sitting as the Board of the Department of General Services, the

Department shall acquire the designated property either by

conclusion of previous negotiations, or by eminent domain, on

behalf of the Board of Trustees of the Internal Improvement

Trust Fund, for use by the Using Agency. Condemnation action

shall be initiated and coordinated by the Department of General

Services.

XII. NOTICE TO VACATE: Upon successful legal acquisition of the

property inquestion, the Department of General Services shall

issue a notice to vacate, which shall be delivered by the Using

Agency to the Owner.

XIII. TITLE: The Department of General Services shall obtain proper

title to the property in question and shall forward same to the

Board of Internal Improvement Trust Fund.
