FLORIDA SUPERINTENDENTS OF SCHOOLS


Research Report 99 provides a complete list of superintendents

of schools who have served in the various counties of Florida since the

beginning of the State system of public schools in 1869. Records of com-

missions issued in the office of the Secretary of State form the primary

source of information. In addition, each present district superintendent

was given an opportunity to review the list for his county and make corrections

known to be needed. Errors may have occurred in the spelling of names or in

initials. Entries in the Commission Book are made in longhand and there

seems to have been instances in earlier periods when legibility was sacrificed

in the interest of embellishment. The spelling of names was not always

consistent.


Florida's long history of county unit organization for the administration

of schools is unusual. Since the organization of the State system of public

schools in 1869, the county has been the administrative unit. Even before this

time, the county rather than the township of independent school districts

served as the administrative unit although, admittedly, little had been

accomplished in the way of an operating public school system.


A considerable amount of background information for the period leading up

to the Constitution of 1885 was obtained from an unpublished Master's thesis,

"The Florida Constitution of 1885," July 22, 1939, written by E. R. Collins,

former Consultant in School Administration in the Florida Department of

Education.








The steps leading up to the establishment of the State system of public

schools in 1869 and to the development of the superintendency as it is known

today were documented by Dr. T. E. Cochran in his HISTORY OF PUBLIC-SCHOOL

EDUCATION IN FLORIDA (Bulletin, 1921, No. 1, State Department of Education,

Tallahassee, Florida). The paragraphs which follow, illustrating this develop-

ment, are largely condensed from Dr. Cochran's work.


In 1822 every sixteenth land section was reserved to aid in the support

of primary schools through the creation of a permanent school fund. In 1827

Congress passed an act giving the Governor and Territorial Legislature control

over the school lands, and in 1828 another act authorized the appointment of

three trustees of the school lands in each county. During the four years that

this law was in effect, only $101.50 was realized in income from the rental of

the school lands.


In 1832 the people in each township were empowered to elect three com-

missioners to take charge of the public school lands. Two years later, in 1834,

county judges were authorized to appoint two commissioners of school lands but

little attention was given to the law.


In 1835 the Register of the Land Office was authorized to supervise the school

lands, and in 1836 and 1837 control was transferred to the Territorial Treasurer.

Since his office was in the Territorial Capitol, little or nothing was ever done.


In 1839 an act was passed providing for the election of three trustees in

each township who were to lease school lands and apply the proceeds to the support

and establishment of common schools. The tax assessor was directed to prepare a

census of the orphans in each county, and the county judge was to supervise the

expenditure of the school funds.










In 1843, the county sheriff was directed to assume control of the school

lands and to look after the education of the poor children. This arrangement

lasted but one year, and again the electors were empowered to elect three

trustees and a treasurer to do the same thing.


In 1845, an act was passed designating the county judge as superintendent

of common schools. The trustees were required to report to the judge, and the

latter consolidated their reports into a county school report. Thus the county

judge assumed some of the responsibilities and duties of the present-day county

superintendent. The Secretary of the Territory served in much the same capacity

as a State Superintendent.


Control of the school lands passed into the hands of the State Register

of Public Lands in 1847 after Florida became a State, and in 1848, the State

was for the first time authorized to sell the school lands and establish a

permanent State common-school fund. Prior to this time the school lands could

be leased only; they could not be sold.


A law providing for a State system of public education open to all white

children between the ages of 5 and 18 was passed in 1849. The Register of

the Land Office was designated to act as State Superintendent of Schools, the

county probate judges as county superintendents, and local boards of trustees

were to be elected by the taxpayers of the various districts. Under this law

the chief duties of the county superintendent (probate judge) were:

1. to divide the county into school districts;
2. to apportion the school money among the various districts when
received from the State;
3. to examine and certificate teachers;
4. to visit the schools annually and promote an interest in public
education;
5. to make reports to the State Superintendent.








The actual employment of teachers and their payment was left in the hands

of the school district trustees who were also authorized to purchase school sites,

to set tuition fees, and to have custody of school property.


In 1851 counties for the first time were authorized to levy a tax on

real and personal property "not to exceed four dollars for each child of school

age." This year also saw the beginning of an equalization program of State

support. In all counties where the interest on the school fund did not provide

at least two dollars per child, the State would make up the deficiency. To be

eligible, a child must have attended school at least three months the previous

year.


In 1853 another school law was passed naming the county commissioners in

each county as a county board of education. The judge of probate remained as

county superintendent and was to serve as president of the county board of

education. His duties and responsibilities were changed to include the following:

1. to examine and employ teachers
2. to pay teachers
3. to discharge teachers found to be incompetent,
immoral, or otherwise unfit to teach
4. to make reports to the State Superintendent.


Although the county commissioners (county school board) were authorized

to supplement school funds from the general county treasury, evidently this

was done only in Monroe and Franklin counties. Actually, very few schools were

organized and operated. During the early fifties, it seems that much of the

public money went to favored private schools rather than to the establishment of

public schools.


The establishment of the present system of public schools was made possible

by the Constitution of 1868. Under this constitution the State Superintendent









of Public Instruction was established as a separate State officer, appointed

by the Governor, and a State Board of Education ex-officio was established.


Superintendents of public instruction in each county were appointed by

the Governor. This prevailed until the Constitution was revised in 1885. The

appointment of county superintendents by the Governor opened the office of

county superintendent to abuses as a result of patronage during the Recon-

struction Period. This may account, in part, for much of the difficulty that

the public school system in Florida had in getting support of the general

public. The people, often with good cause, had little confidence in the State

and local administrative officials appointed by the carpetbag regime.


Speaking of county superintendents in general, Secretary of State

Samuel B. McLin, who served as Acting State Superintendent from August, 1874

to March, 1875, had this to say in his report for the school year 1873-74:

There is another method of increasing the efficiency of our
common schools, which we fear has not had the consideration it
deserves in this state, and that is the appointment of properly
qualified men as county superintendent. For a long time, the
value of this office was not understood, and in the school system
of some of the states, does not appear; but the propriety of pro-
viding county superintendents is no longer considered a debatable
question by the most experienced educators. This office is the
necessary agent between the State Superintendent and the county
schools, and in his hands are largely the details of the whole
organization. He is the medium through which all the operations
of the entire system are carried on. Such being his position, it
is important that a wise discretion should be displayed in his
selection. In other positions, custom, precedent, or routine will
often enable ordinary men to do their work with fair success; but
in school matters almost everything depends on the personal qualities
and fitness of those who manage them. One indispensable qualification
in a county superintendent is intelligence and culture. It is sheer
folly to suppose that an ignorant man can successfully manage school
interests. His obvious duties are to visit, to note methods of
instruction, judge of textbooks and discipline, give direction in the
science and art of teaching, be adviser and assistant to the teacher,
as well as examiner of them; and to do this requires intelligence of
a high order, and a practical knowledge of schools. How can a man
conduct the examination of teachers unless he has the necessary
literary qualifications; and how can he counsel and aid the teachers
except he be familiar with the work?...










Public spirit is also a necessary qualification. Though not a
charitable institution, the school system has the public good immediately
in view, and a county superintendent lacking public spirit can hardly be in
sympathy with it, or properly promote its interests. A county superintendent
should also be a man of moral uprightness. The character of all school
officers should be models, which the pupils might safely imitate; otherwise,
the schools will become a moral contagion. Every parent or guardian has
a right to demand that the school influences to which his child is subjected,
shall be ennobling. The school system that takes upon itself the training
of the young upon any other assumption than that it will lead them to paths
of integrity and virtue, is a fraud and an evil. To sum up; a county
superintendent should be a man well qualified as to knowledge of books,
especially such topics as are generally taught in our common schools; he
should be well acquainted with practical school-room work, especially with
primary teaching, as his efforts can be best expended in schools of the
elementary branches; he should be a man of energy, and also a man of un-
exceptional habits and character, that he can command the esteem of the
scholars, teachers, and public generally; he should be capable of withstanding
the influences sometimes brought to bear upon such officers to induce them
to give certificates to candidates unworthy or unqualified to become teachers;
he should be enterprising and public spirited, and, in short, known as a
live, qualified, faithful, honest man before entrusted with the responsi-
bility of this position. When we contrast this picture of what a county
superintendent ought to be with the actual state of affairs in regard to
those officers here, it will be found a matter of wonder that the system
had so much vitality and vigor as to enable it to survive so long. While
a few of our county superintendents are in every way worthy, qualified, and
efficient officers, a large majority of them are notoriously unfit for the
position, and utterly incapable of performing their duties. The literary
qualifications of some of them, if we may be permitted to judge from the
letters and annual reports sent to this office, are of a very primitive
type, and some of them are so indolent, incompetent, or uninterested, as to
omit the making of an annual report .at all. The truth is, that this and all
other offices in any way connected with the educational interests of the
State, must be entirely and forever divorced from party politics. Too
frequently has the county superintendency fallen into the hands of men
who have prostituted it to their political advancement,1or made use of it
for the pecuniary gain it brought. This should not be.


Additional insight into the situation that existed during this period is

provided by Dr. Thomas E. Cochran, who wrote:

The state and county superintendents of schools were appointed by
the executive head of the state. Consequently, there was a temptation to
play politics at the expense of the schools, and too often this temptation
proved irresistable. Men were chosen, not on the basis of fitness for

service, but with relation to party affiliation, thereby working
disastrous results in respect to the educational welfare of the
youth of the State. This was especially true from June 8, 1868,
until January 1, 1877, during which time the government of the
State was in the hands of a political party that was neither elected
by, nor in favor with, the majority of the intelligent voters and
property-owning people of the State. Hence, there were a great many who
did not cooperate in the educational movements as they would have
done had they been in sympathy with the party in power. But with
the beginning of the administration of Governor George F. Drew,
a "conservative," as a member of the opposing party was then called,
there was an increased interest, and, therefore, increased progress
in the public school system.2


George F. Drew, the first "conservative" Governor after the War Between

the States, removed or accepted the resignations of well over half of the

county superintendents who were serving when he became Governor in 1877.


This analysis of the quality of county superintendents in general by

Mr. McLin gains weight when considered in the light of conditions existing

at the time it was written. He was one of the "hateful imports" then in

control of State government and was referring to appointees of his own party.

He succeeded Jonathan C. Gibbs, Florida's only Negro State Superintendent.

Superintendent Gibbs, from Pennsylvania, was a former Secretary of State in

the same administration and may be presumed to have had considerable

influence in the appointment of county superintendents -- at least a number

of "conservatives" (Democrats) were removed when he was appointed State

Superintendent.


There was little continuity in office either at the State or county level.

During the six-year period, 1870 to 1876, there were five State Superintendents

of Public Instruction. During 1871 to 1874, only five counties did not have a

turnover in the office of county superintendent.

On the following pages the name of each district superintendent is given

with the date of his commission. Remarks contained in the Commission Book are

reproduced. Where the word "deceased" appears in the remarks section, it

indicates that the superintendent died before the end of his term of office.

Records for the very earliest superintendents are incomplete as to date of com-

mission. Only the date of first appointment is indicated.

There were no county superintendents as such between 1845 when Florida

became a state and 1869 when the State school system was established. During

this period the County Judge of Probate served some of the same functions as the

county superintendent later assumed. The efforts of these ex-officio superin-

tendents in the field of education varied widely. Their turnover was frequent in

many counties, which may explain some of the lack of progress. The names of

Judges of Probate are given when available.

Below is given a list of State Superintendents of Public Instruction, with

the date of their first commission. Prior to 1868 there was no state official

with primary responsibility for public schools. In the 1968 Florida Constitution,

the title of State Superintendent of Public Instruction was changed to "Commissioner

of Education."
