ASSESSED VALUATION PER PUPIL AND LOCAL MILLAGE


For more than a century, ad valorem taxation has been a major factor in

public school support in Florida. Cochran reports that on January 6, 1851:

. the counties were authorized, for the first time in the history
of Florida, to levy a tax on both real and personal property for the
support of the common schools; but the amount levied could not exceed
four dollars annually for each child of school age.1

The limitation of four dollars per child was evidently unnecessary for it

seems that only Franklin and Monroe counties ever levied taxes under the pro-

visions of this law. Two years later, in 1853, the county commissioners were

authorized to add any taxes they deemed proper to the above. Apparently, no

limitation was placed on the taxes the county commissioners could levy for this

purpose.

The Florida Constitution of 1868 provided for a special state tax on

taxable property of not less than one mill to be distributed to the counties on

the basis of the number of children of school age. To qualify for this state

tax distribution, each county was required to levy taxes equal to one-half of

the amount distributed by the state. Also, schools had to be in session at

least three months out of the year in order for the county to qualify for state

tax funds. Section 8 of the Constitution of 1868 provided:

Each county shall be required to raise annually by tax, for
the support of common schools therein, a sum not less than one-half
the amount apportioned to each county for that year from the income
of the common-school fund. Any school district neglecting to
establish and maintain for at least three months in each year such

school or schools as may be provided by law for such district shall
forfeit its portion of the common-school fund during such neglect.1

By the school year 1969-70 school taxes ranging from one to two and one-half

mills were being levied in all but four counties.

By 1874 five counties (Lafayette, Marion, Monroe, St. Johns, and Washington)

were levying a school tax of six mills or more. This same year the legislature

placed a ceiling of five mills for the county school tax. In 1879 the legis-

lature provided relief to the taxpayers by limiting the school millage to two

and one-half mills. Since most counties were levying from three to five mills

this action resulted in a decrease in school expenditures.,

Two years later, 1881, the legislature reversed its. action and made the two

and,one-half mills mandatory and raised the limit to four mills.

The Florida Constitution of 1885 provided for a state property tax of one

mill for schools and required counties to levy at least three mills but not

more than five mills.

Section 6. A special tax of one mill on the dollar of all taxable
property of the state, in addition to the other means provided, shall be
levied and apportioned annually for the support and maintenance of public
free schools.



Section 8. Each county shall be required to assess and collect
annually for the support of public free schools therein, a tax of not
less than three mills nor more than five mills on the dollar of all
taxable property in the same.2

A Constitutional Amendment was ratified in 1904 raising the maximum allow-

able county millage to seven. A later amendment, adopted in 1918, increased the

maximum county school millage to ten mills. Provision also was made in the

Constitution of 1885 for the division of a county into school districts with

three school trustees and provided authority to levy up to three mills of

district school tax for the schools within the district providing the taxpaying

qualified electors of the school district voted in favor of such levy.

Section 10. The legislature may provide for the division of any
county or counties into convenient school districts; and for the election
biennially of three school trustees, who shall hold their office for two
years, and who shall have the supervision of all the schools within the
district; and for the levying and collecting of a district school tax,
for the exclusive use of public free schools within the district, whenever
a majority of the qualified electors thereof that pay a tax on real or
personal property shall vote in favor of such levy; Provided, That any tax
authorized by this section, shall not exceed three mills on the dollar in
any one year on the taxable property of the district.1

This district limitation was raised an additional five mills in 1912 in school

districts where bonds had been voted, thus making it possible for a special tax

district to levy up to eight mills.

Another amendment, approved in 1922, raised the authorized district maxti-

mum levy to ten mills, and in 1924 the limit on the bonded indebtedness was

fixed at a sum not exceeding 20 percent of the assessed valuation of the

property of the district,2 Efforts in the mid-twenties to remove this ceiling

on the ten mill levy were not successful. However in 1924 the Constitution was

amended to provide that when a special tax school district voted to issue bonds,

a special tax could be levied to pay the principal and interest on such bonds

but only for this purpose,

Prior to 1947, Florida had "county unit" system insofar as school board

financial administration and supervision of instruction were concerned. However,

each county still had, as late as the 1946-47 school year, a number of school

districts totaling 650 for the state. Each of these districts could levy a

district school tax of up to ten mills for the exclusive use of the schools in

the district when approved by the freeholders of the district. Also each

district could bond itself for school construction.

In 1947 all districts within each of the 67 counties were simply abolished

and one district established, co-extensive with the boundaries of the county

itself., This district functioned as a county-wide district known as "Special

Tax School District #1." The constitutional district current tax up to 10

mills voted biennially by freeholders became, after 1947, a county-wide tax

.on non-exempt assessed valuations by the entire vote of allelectors in

Special Tax School District #1 instead of the aggregate produced by separate

district elections, At the same time the various boards of trustees (three (3)

members in each district) were eliminated and provision was made for the biennial

election of only one board of trustees, or three for the entire county. Not

more than one trustee could come from any one of the five residence districts

which correspond to the five county commissioner residence districts. The

three candidates receiving the highest number of votes made up the county-wide.

All obligations created for bonded indebtedness prior to reorganization

of the various districts remain as an obligation of the original district area

and millages sufficient for debt service are determined and levied by the

County Boards of Public Instruction. New bond issues, submitted to the vote

of freeholders of the county at large, became an obligation of the newly

created Special Tax School District #1.

Some confusion has existed since 1947 regarding the terms "County Current"

and !'District Current" taxes. Both of these taxes were paid by the same tax-

payers. The County tax however was levied by the County School Board while

-the.District taxes were those voted biennially by the people living in the

county.

A law was passed in the 1965 session of the legislature which required a

reduction in millage levies in proportion to the increase in the general level

of assessed valuation. Millage could be increased by ten percent by the County









School Board and by an additional five percent after public hearings and

approval of a special County Review Commission composed of three School Board

members and three county commissioners. This law was effective January 1, 1966,

which made it applicable to tax levies for the 1966-67 school year.

The State Legislature, in the special 1968 session, effectively placed a

ceiling or limitation on school taxes for operation of grades kindergarten

through twelve by providing in Section 236.251 that:

Effective July 1, 1968, each county board of public instruction
desiring to participate in the minimum foundation program for kinder-
gartens and grades one through twelve shall levy no more than ten mills
of tax on the non-exempt assessed valuation of the county, exclusive
of voted district building and bus, required debt service, and the
millage required for junior college minimum effort . ,

The Florida Constitution as amended in 1968 made each county a school

district and'provided for the consolidation of two or more adjoining counties

into a single school district. Taxes levied by a school district for school

purposes are limited to ten mills but additional taxes for periods of not more

than two years are permitted when authorized by a vote of the electors who are

the owners of freeholds not wholly exempt from taxes when authorized by law.

The constitution also provides that "By general law regulations shall be pre-

scribed which shall secure a just valuation of all property for ad valorem

taxation, "

The property tax, while it may not be as important as it once was in

school support, remains the primary source of local revenue. It provides the

source of local support over which the county exercises the most "control",

Table I gives the amount of local non-exempt (taxable) property supporting each

child in average daily attendance. This is the tax base on which levies can

be made. For the purpose of illustrating relative changes in this base, rank-

ings are shown for each county.










It must be emphasized that the basis for these computations is the local

assessment. No effort has been made to make adjustments on the basis of percent

of assessment. The assessments reported to the State Comptroller are used,along

with attendance figures taken from annual attendance figures reported to the

State Department of Education by county superintendents, Only the average daily

attendance of pupils in grades one through twelve'is used in order to provide ,

comparability since not all counties have kindergarten pupils.

Table 2 gives combined county and district tax levies from 1949-50 to

the present. Levies for Building and Bus leviesare included since these

come within the millage prescribed by law. Taxes for servicing local bonds

are not included nor are special levies on old school districts which existed

prior to 1947.
