en-USJudge rules in Ponce's en-US favor in Pacetta lawsuiten-USPonce Inlet officials are now breathing a sigh of en-US relief, if only temporarily, over the dismissal of a en-US legal matter which could still pose a serious finanen-US-en-US cial threat to the towns future.en-US Florida Seventh Circuit Judge Christopher France en-US ruled April 11 in favor of the town in its latest court en-US hearing against Pacetta LLC, a company that was en-US looking to develop 16 acres of land along the Halifax en-US River for various residential, commercial and retail en-US projects, including an expanded marina with addien-US-en-US tional boat slips and a 50,000-square-foot dry stack en-US facility for storing boats.en-US Pacettas principal owners, Lyder & Simone Johnen-US-en-US son, initially went to court in 2010, claiming town en-US officials encouraged them to invest millions en-US of dollars before blocking their plans due to en-US public outcry from many residents who were en-US against it.en-US The case went in front of Judge France last en-US month for a four-day partial retrial, one which en-US was ordered after the town successfully challenged en-US Pacettas $30.7 million judgment victory in Novemen-US -en-US ber 2014, over five times the towns latest annual en-US budget.en-US In his 12-page final judgment, which was released en-US more than two weeks after the partial retrial ended, en-US Judge France found the Johnsons never formally en-US applied for development of the 16 acres they own, en-US thus not giving town officials the chance to approve en-US or deny their plans.en-US He also found the Johnsons were fully aware of en-US existen-US -en-US ing town reguen-US-en-US laen-US -en-US tions, which prohibited those plans, before en-US they en-US started buying the first of 10 parcels they would en-US eventually purchase in June 2004.en-US Pacettas legal team argued a formal application en-US wasnt necessary in this case because it would have en-US been futile to do so for a variety of reasons, includen-US -en-US ing hostility from the Ponce Inlet Town Council, en-US especially after three new members were elected in en-US November 2008. en-USThe South Daytona Police en-US Department has a new man en-US in charge weeks after its foren-US -en-US mer top cop suddenly retired en-US while under criminal investien-US-en-US gation by the state.en-US Gerald Monahan Jr., who en-US ran the Port Orange Police en-US Department for more than a en-US decade, was named as Chief en-US Ronald Wrights temporary en-US replacement during the en-US South Daytona City Council en-US meeting April 10.en-US SDPD Lt. I conen-US -en-US gratulate our town attorneys, en-US especially Cliff Shepard, on en-US disproving all of the falseen-US -en-US hoods and reproving all of the en-US facts in this case.en-US Its not clear at this point if en-US Pacetta or the other compaen-US -en-US nies named in the lawsuit en-US Down The Hatch Inc. or Mar-en-US Tim Inc. plan to appeal. en-US Peter Heebner, the attorney en-US representing all three plainen-US -en-US tiffs, did answer a request for en-US comment.en-US But Ms. Witt said the town en-US is planning as if there will be en-US another appeal to the Fifth en-US District Court Of Appeals, the en-US same court that kicked the en-US case back to Floridas Seventh en-US District, and she expects any en-US such appeal to eventually end en-US in the towns favor.en-US Two separate panels of en-US these competent judges have en-US well understood the laws of en-US land use and found in favor of en-US the town on both the Bert J. en-US Harris inordinate burden en-US claim and the full takings en-US claim, Ms. Witt noted. en-US Therefore, we expect the en-US same, given the same facts en-US remain, for this partial taking en-US matter.en-US She also said the pending en-US federal court case involving en-US Pacetta will go the towns way en-US based in part on the latest rulen-US-en-US ing from Judge France.en-US We will budget accordingly en-US for both of these potential sceen-US-en-US narios as we pursue reimen-US-en-US bursement of those legal fees en-US and other court costs for en-US which we are now entitled, en-US Ms. Witt stated.en-US What the exact fees and en-US costs are isnt clear at this en-US point, she said, but the latest en-US estimate from the town has the en-US total at more than $5 million en-US and counting since legal proen-US-en-US ceedings began in 2008.en-US month.en-US FDLE hasnt released any en-US other details about the invesen-US -en-US tigation, nor has the office of en-US 7th Circuit State Attorney R.J. en-US Larizza.en-US Chief Monahan, also a en-US South Daytona resident, will en-US run SDPD until the city en-US wraps up its search for Chief en-US Wrights permanent replaceen-US-en-US ment, according to Mr. Yaren-US -en-US brough during the city counen-US -en-US cil meeting.en-US Were going to get through en-US this hurdle, he added. A en-USs the persistent march en-US to turn our beach into en-US a private one continues, en-US I am prompted to think back en-US to how all of this began. en-US By the mid-1980s there had en-US been several attempts to close en-US portions of the beach by those en-US who had bought the dunes, en-US but without much success. It en-US wasnt until the issue of turtle en-US safety came to the forefront en-US that the anti-beach driving en-US crowd could get any support.en-US At that time, our entire en-US country was making a en-US concerted effort to save en-US animals from extinction. It en-US was as though the population en-US was just discovering nature, en-US and, as Americans will do, en-US they rushed into it headlong.en-US Locally, the new environen-US -en-US mentalists nearly fainted when en-US they found out our beloved en-US manatees had fallen in en-US numbers to the point of being en-US put on the endangered species en-US list. Of course, that turned out en-US to be the result of poor en-US methods of counting the sea en-US cows, and once that had been en-US improved, the numbers of en-US Florida manatees shot up. en-US The people who wanted to en-US close down our beach to en-US driving and other peoen-US -en-US ple-friendly things like en-US nighttime access also jumped en-US on the environmental banden-US -en-US wagon. Now they had the en-US turtles to head up their cause. en-US After all, who could argue en-US with trying to protect those en-US cute little baby turtles. Now en-US they could successfully en-US petition the state to begin en-US keeping people and cars off en-US the beach. en-US The problem with that is the en-US turtle hatchlings were, at that en-US time just as now, more en-US protected than at any other en-US time in history. Aside from en-US rare instances of a turtle being en-US killed by a car, it was the en-US influx of population in east en-US Volusia County that saved en-US them by the thousands. en-US Each year in late spring, big en-US sea turtles come ashore, dig a en-US hole and lay their eggs. Not en-US being the best of parents, the en-US mother turtles would leave as en-US soon as the eggs were en-US dropped. Throughout history, en-US the turtle nesting season was en-US looked upon as a chance for a en-US good meal by many wild en-US animals and a lot of people. en-US Our earliest residents, the en-US Native Americans of the en-US Timucuan tribe, would en-US conduct a celebration to mark en-US the occasion of the gathering en-US of the eggs. en-US Bears, raccoons, foxes and en-US other animals would head to en-US the beach to dig turtle eggs. en-US According to the great 1987 en-US book, Tales Of Old Florida, en-US early European settlers who en-US lived a bit inland would come en-US to the beach to set up camps en-US to stay for weeks and harvest en-US the turtle eggs. Indeed, the en-US turtle nesting season was seen en-US as a bonanza of protein for en-US animals and humans alike.en-US When I first came to live en-US here in the late s, there were en-US signs posted on the more en-US desolate sections of our beach en-US warning us to be on the en-US lookout for egg-hunting bears. en-US The black bears were great egg en-US hunters and did not take en-US kindly to being interrupted. en-US Residents who lived near the en-US beach would walk along with en-US a long stick to jab into the en-US sand hoping to find a turtle en-US nest, but the bears could sniff en-US them out with ease. en-US That caused many settlers to en-US follow them and try to chase en-US them away from their find. en-US Turtle eggs were a big part of en-US the diet for all. Once the eggs en-US hatched, scores of predatory en-US birds (and people) would en-US descend on the beach to eat en-US the baby turtles. That is the curse en-US for a chef a great meal gone en-US bad. en-US My wife came from a large en-US family and hot food probably en-US wasnt high on the list at dinner, en-US because just trying to get en-US everyone fed was the goal. en-US Serving food at the proper en-US temperature for a chef is a rule en-US that cannot be broken. It goes en-US against all of my training and en-US drives me totally bonkers. en-US Let me give you a few en-US examples. Its time to eat and I en-US announce dinner is ready, then en-US everyone disappears. People en-US are going to the bathroom, en-US going out to get the mail, en-US answering the phone. ITS en-US DINNER TIME!en-US So now I announce dinner 5 en-US minutes early to give everyone en-US a chance to prepare to eat. en-US When I make salad, which is en-US usually every day, I keep it in en-US the refrigerator just prior to en-US eating and not letting it sit on en-US the table for 10 minutes. I also en-US keep the salad dressing en-US refrigerated as well. I have the en-US oven on low to keep food en-US warm, and I place the serving en-US plate in the oven also on very en-US low just prior to eating. Hot en-US food hot plate, its not that en-US hard. en-US Here are a few tips when en-US serving pancakes or French en-US toast. Heat the syrup or honey en-US in the microwave for a few en-US seconds. Next time you make en-US steak or chops and want steak en-US sauce, heat it up in the en-US microwave for a few seconds. If en-US you have a ceiling fan in the en-US dining area, turn it off. It will en-US cool off food quicker. I en-UShad scored a big zero in my en-US last spotted sea trout en-US expedition near High en-US Bridge, so this time I took The en-US Green Peanut a little farther en-US north.en-USI live pretty close to the en-US Flagler County line, so it is en-US not much of a stretch. Aside en-US from being territory I dont en-US often fish, the fact an angler en-US may keep five trout instead of en-US the four we are allowed in en-US Volusia County is an added en-US draw. en-US If you are fishing the en-US northern Halifax, you will en-US know you are in Flagler en-US County when you pass the en-US first condos to the east. From en-US there, you will want to head en-US west into the tangle of creeks en-US and mangroves that are part en-US of a large swamp. en-US As soon as I cleared the en-US river, I began to cast my jig en-US about, but for the first 45 en-US minutes I had nary a hit. Just en-US about the time I began en-US thinking of the fishermans en-US favorite excuse line (just en-US happy to be on the water), a en-US stout fish took the jig. At the en-US net I could see it was a beauty en-US of a four-pound sea trout. en-US Before I could congratulate en-US myself too much, it ejected en-US the hook with one last tail en-US flip. Oh well, at least it was en-US promising. en-US I paddled further west with en-US the intention of riding the en-US outgoing tide back to the en-US Halifax. I was in a narrow en-US stream of say 60 feet in width en-US and I soon found out there en-US was a deeper channel along en-US the south side of that creek. I en-US found out because thats en-US where the fish were. Sitting en-US in the deeper water, waiting en-US to ambush anything that was en-US being swept out by the en-US current. en-US My action picked up as I en-US drifted along. The trout were en-US not holding in a tight school en-US as they normally might, but en-US were scattered all along the en-US stream. Nice, fat fish of two en-US to three pounds began to en-US come in. Well some of them en-US came in. I missed as many as en-US I caught. The action was so en-US steady that before long I en-US could see getting my five-fish en-US limit was not going to be en-US difficult. With that in mind, I en-US began to release fish I would en-US love to keep on another, less en-US productive day. en-US I hate to preach, but if you en-US have attended any of my en-US talks and seminars, you en-US know I believe you catch en-US more fish by casting into the en-US current and allowing the bait en-US to wash back toward you. All en-US feeding fish sit looking into en-US the current for a meal. Sure en-US you can catch fish casting en-US against the current, but you en-US must know your bait is en-US mostly coming up behind en-US the fish. en-US On this day I was letting en-US my kayak drift backwards en-US downstream so I could cast en-US into the current. Once The en-US Peanut reached the river, I en-US turned to paddle hard back en-US into the swamp to take that en-US drift ride once more. en-US On the second drift, I was en-US about halfway through when en-US I had a hard hit. As I said, the en-US creek had a deeper channel en-US near the shore and I was en-US letting the chartreuse jig drift en-US with the current when it en-US came too close to a downed en-US tree. Out from under that en-US tree a big snook took it and en-US streaked off on a long run en-US that made my little #25 reel en-US sing. en-US The fish headed across the en-US stream and when I pulled en-US back hard to stop it, the en-US snook tried to jump. I say en-US tried because it was too fat to en-US clear the water. The fish was en-US at least 36 inches long and en-US weighed probably 12 to 15 en-US pounds and I knew I was in en-US trouble. A kayak in swift en-US water is no place to play a en-US fish like that.en-US After a bit, the snook en-US headed up stream and I was en-US getting a ride. The kayak was en-US being pulled against the en-US current by that strong critter. en-US I could only sit there and en-US regain line when possible en-US until the inevitable. The line en-US popped. en-US I had to smile. What a en-US battle. Actually, what a trip. I en-US landed 12 nice sea trout and en-US had played a horse of a en-US snook.
