Due to several conflicting, confusing and false statements with respect
to the seawall erected to protect the land just north of Moorings Park, we
are issuing the following statement so the residents of this community will "
know the facts.

FIRST: The land back of this seawall had eroded back of its original boun-

dary line some 40 feet. This erosion was continuing to where the property

could not be used for any multiple dwelling construction.

'''f': '. .'-', ; SECOND: An owner of the land along the beach has the right to protect '
\ his land by erecting a seawall up to his property line, which is the "mean
high tide."

: V THIRD: While the tide itself fluctuates from hour to hour and day to day

due to the influence of the wind, the moon, and many other factors,

such as an eclipse (which occurred in the past week), the U.S. Coast and Geo-
detic Survey has charted and established a "mean high tide" for the entire

coast line of the United States which, of course, includes Naples. "Mean

high ,tide" as is established by the U.S. Coast and Geodetic Survey is a verti;;

cal I ;elevation_ and at Naples is set at 2.1, feet. .

ineering' firm was employed' to, plat the "mean high tide" line for this pro V ..

\ ; perty. The City, through its engineering department, on two separate occasions r 1
carefully; surveyed this area and the particular location, and found

t that this seawall was within the boundary of the "mean high tide". line._
FIFTH: The City, through its regular departments, approved and issued a
permit for the construction of this seawall in this particular location.

SIXTH: Right now at low tide there is some 40 to 60 feet of sand in front

of the seawall, and except at high tide there is no trouble in walking along

;.; SEVENTH: Groins are being erected and jut out from each side and we

sideraby farther out in a relatively short space of time, similar to the Beach ,I
Club, Bahama Club, and other places having such groins. ....

In conclusion, we regret any temporary inconvenience this may cause any
of our residents who desire to walk along our beaches. Our purpose is to
protect this property and erect thereon a multiple dwelling unit which will
be a real credit to this community. At the same time, we will increase and ,
beautify this beach rather than to have it continue its erosion, resulting ina

beach covered wih stumps, weeds, and refuse.
If this seawall or the groins continue to cause inconvenience for a considerable ",-

r period, we will erect steps over such groins and/or seawall at our
ex pent for the use of those persons desiring to walk along the beautiful
beach of Naples.
