UNDER SECTION 3 OF THE ORDINANCE

W ,'.ErEAS it is enacted by Section 3 of the Land Acquisition Ordina'ice (No. 22 of 194'-)
that if the Governor considers that any land should be acquired for a public purpose, he may
cause a de-'laration to that effect to be published in the Gazette.
ANYD WYiEaEAS the Govercnr considers that all of the land, by estimation' a half an acre
more or less in extent in Biahou in the larish of Charlotte, the property said to belong to
Mfr. Norton Bess of Biabou is required for a public puripos', to wit the laying out of a public
road.

OFFICER


A vacancy exists at the Caribbean Com-
munity Secretariat for a Senior Administrative
Officer.

2. Appointment may be on a permanent
basis or on secondment from the Public Service
of a Member State of the Caribbean Community
with salary in the scale G$1,424- X $68 --
$1,696 a month and house allowance at the rate
of $271.25 a month, both tax free.

Applications are invited from suitably quali-
fied persons for the post of Chief Engineer in
the Public Works Department of the Ministry
of Co'munieations, Works cnd Labour, St.
Vincent.

Duties:

The Chief Engineer will be required to ad-
mini:t r and control public works in the fields
of roads, buildings, hospitals, airfields and the
like. IHe will be reo;onsible for the ef-icient
functioning of Public Works Department and
for implementing an internal re-organisation of
the Department which is currently under study.
He will control the activities of civil engineers
with their associated design and supervisory
support, and will alIo be responsible for in-
seivice trnairing of staff and supervisory person-
nel of the Department in their various disci-
piin s. The Public Works Department full
str mgthl consists of some six professionals and
seventy non-professional staff, with a day labour
force of some three thousand.

construction of factory shells at Powells Hill.
The Project will include:

1. The erection of t ,, factory shells of ap-
proximately 6,000 sq. ft. and 20,000 sq. ft.

quired concrete footings, floors, wall,
roofs etc.

2. External paving and roads of approxi-

PUBLIC SERVICE COMMISSION (AMENDMENT) REGULATIONS


(Gazetted 16th March, 1976.)


Made by the Public Service commission under the provisions of Section
77(13) of the St. Vincent Constitution Order, 1969.
1. Short title. These Regulations may be cited as the Public Service
Commission (Amendment) Regulations, 1976.
2. Amendment to Public Service Commission Regulations, 1969. The
Public Service Commission Regulations, 1969 (No. 48 of 1969) are hereby
amended as follows:-

(a) In Regulhtion 9, by the deletion of the word "request" and the
substitution of the word "direction";
(b) In Regulation 10. by the deletion of the words "any member of
the staff of the Commission" and the substitution of the words
"nor any public officer';

(c) In Regulation 17, by the insertion, after the word "persons", of
the words "whether employed in the Public Service or not";

(d) In Regulation 20, by the addition, at the end of paragraph (1),
of the words "and from time to time shall provide the Commission
with copies of such lists";

(e) In Regulation 31, by the addition ,.frf;er4pav c-;-r (c), of the
following new paragraph- '..


(d) where the officer is unqualified.
(f) By the deletion of Regulation 36, and the ibstittt on of the

Retirement 36. (1) Where it is represented to the Commission, or
in the 'the Coftmission considers it desirable in the public interest,
public interest. that an officer ought to be retired in the public interest-
(a) if the officer has held such pensionable office for less
than ten years and his record of service over a period.
of five years indicates his inability to discharge his
duties efficiently;
(b) if the officer has held such pensionable office for ten
years and over and his retirement is contemplated
on the ground of his inability to discharge his duties
efficiently,
the officer shall be informed of the grounds on which his retire-
ment is contemplated and he shall be given an opportunity of
being lih-ard by the.Commission.
(1A) The Commnission shall, in respect of any officer to
whom sub-paragraph (b) of paragraph 1 of this regulation
applies, obtain a report on the work of the officer from his Head
of Department, and it may also obtain a report, from any other
Head ofDepartment under whom the officer has served during
the previous five years.
(2) If, after having regard to-
(a) the conditions of the Public Service;
(b) the usefulness of the officer in the Public Service; and
(e) all the circumstances of his case, the Commission; after
hearing the officer, is satisfied that it is desirable in the
public interest to do so, it shall require the officer to
retire.
(g) In Regulation 37, by the deletion of the figures "35", "36" and "37"
and the substitution of the figures "34", "35" and "36" respect-
ively.

(h) By the deletion of Regulation 38, and the substitution of the
following-
38. (1) Any allegation of indiscipline or misconduct on
the part of an officer shall be dealt with under this Part of these
Regulations.
(2) Any allegation of indiscipline or misconduct on
the part of an officer shall be dealt with as soon as possible after
it has been made.
(i) In Regulation 39, by the deletion of paragraphs
(1) and (2) and the substitution of the following-
(1) where a Permanent Secretary or Head of Department becomes
aware of any allegation of indiscipline or misconduct on the part
of an officer, the Permanent Secretary or Head of Department shall
forthwith make a report to the Commission.























(2) Subject to paragraph (3) of this regulation, where the Commission
receives a report containing or otherwise becomes aware of any
allegation of indiscipline or misconduct on the part of an officer,
and the Commission is of the opinion that disciplinary proceedings
should be instituted against the officer by reason thereof, the
Commission may itself institute disciplinary proceedings, or may
issue instructions to the appropriate Permanent Secretary or Head
of Department as to how the matter is to be.dealt with.

(j) In Regulation 44-
(i) by the deletion of paragraph (2) and the substitution of the
following-

(2) An officer, who has been interdicted as a consequence of a
dishonest act which involves the loss of Government property
or funds, shall not receive any emoluments after the date of
his interdiction;

(2A) An officer interdicted for misconduct, other than a dishonest
act which involves the loss of Government property or funds,
may receive such proportion of the salary of his office, not
being less than one half, as the Commission may deem
appropriate;

(ii) in paragraph (4), by the insertion after the word "duty'' of
the words "or against whom disciplinary charges have been
instituted''.

(k) In Regulation 53, by the deletion of paragraph (3) and the sub-
stitution of the following-

(3) (a) The procedure prescribed by paragraph (2) of this regulation shall
apply to an investigation with a view to the dismissal of an officer
who has served for ten years and over in a pensionable office and
whose basic annual salary is less than four thousand three hundred
and twenty dollars, except that the charges may, at the discretion
of the Commission, be investigated by a Permanent Secretary, Head
of Department or such other officer or officers as may be appointed
by the Commnifsion;

(b) the procedure prescribed by sub-paragraphs (a) to (c) of para-
graph (2) of this regulation shall apply to an investigation with
a view to the dismissal of an officer who has served for less than
ten years in a pensionable office and whose basic annual salary
is less than four thousand three hundred and twenty dollars;
























(c). upon receipt of. the document mentioned in sub-paragraph (c)
of paragraph (2), pf this regulation, and after giving the officer
an opportunity to.be heard, the Commission may consider and
decide his case.

(1) In the Second. Schedule-
(i) by the deletion of paragraph 6 and t1he substitution of the
following-
Termination 6. The appointment of an unestablished officer (that is,
of employ- an officer who holds a post for which separate provision has not
nmeit of
unestnalished been made in the current Estimates) may, without enquiry
officer, made, or reason given to him, be terminated by the appropriate
authorized officer at any time on one month's notice in writing
or the payment of one month's salary in lieu thereof;
(ii) in paragraph 8-
(a) by the deletion, from sub-paragraph (2), of the words "so inter-
'* dicted" and the substitution of the words "interdicted for mis-
conduct other than a dishonest act which involves the loss of
Government property or funds';
(b) by the insertion, after sub-paragraph (2), of the following new
sub-paragraph-
(2A) Where an officer has been interdicted as a consequence of a
dishonest act which involves the loss of Government property
or funds; such officer shall not receive any salary from the
date of his interdiction;
(iii) in paragraph 9, by the deletion of paragraph (e) from sub-
paragraph (1), and the substitution of the following new
paragraphs-
(e) severe reprimand;
(f) reprimand.
(iv) in Form I-
(a) by the deletion of paragraph 2 and the substitution of the
following-
2. The appointment is non-pensionable and will be terminable at
any time on one month's notice in writing on either side or
the payment of one month's salary to you in lieu of notice;
(b) by the deletion of paragraph 4 and the substitution of the
following-

4. You will receive salary at the rate of $.................................... per annum
in the scale $........................................... ..... and will be eligible for annual

increments subject to the satisfactory conduct and perform-
ance of your duties.
