COMMISSION OF ENQUIRY INTO THE KINGSTOWN' BOARD


* Under the Provisions of Section 2 of the Commissions of Enquiry Ordinance Cap 160
flis Excellency the Governor h-as appointed a Commission of Enquiry elmprising:
* EDWARD ALEXANDER CLAVIER HUGHES, ESQUIRE, O.B.E Chairman
IITU01I IIAYNES ILAMLETT, ESQUIRE, M.B.E. Member
COLONEL SYDNEY ALOYSIUS ANDERSON, ESQUIRE, O.B.E.,
M.V.O., C.P.M. Member
to enquire into the Management and Operations of the Kingstown Board between the 1st
March, 1973 and the 12th December, 1974.
The terms of reference of the Commission are:
(i) the appointment, dismissal, discipline and assignment of employees, whether
servants or agents of the. Board, or whether engaged full time, or on job work
or otherwise;
(ii) the use, deployment and disposal of funds, equipment and labour by the Board,
whether within or without the boundaries of the town of Kingstown as defined
in the Kingstown Board Ordinance, 1970, or on public or'private property;
(iii) the award of Contracts by the Board, including the contract to build a Town
Hall;
(iv) the expenditure of the funds of the Board.

2. Public organizations, groups, associations, other bodies and members of the public in
general, are invited to submit to 'the Commission memoranda or statements or any matter
considered relevant to 'the Commission's terms of reference..

3. All memoranda or statements should be submitted in quadruplicate and shall state
the mines and addresses of the persons who will be ready and willing to attend and'appear
before the Commission to support their memoranda or statements in the event, that the
Commission requires their attendance.

4. Every nmeimoranda or siatemenli must h1) signed by or on behalf of the organisation,
group, association, body or peIrson and addressed or sent to

WHEREAS by Section 2 of the Commissions ot Enquiry Ordinance, Cap. 160 of the Laws
of Saint Vincent Revised Edition 1926, it is provided, inter alia, that it shall be lawful for the
Governor whenever he shall deem it advisable to issue a Commission appointing one or more
commissioners to enquire into 'the conduct or management of any department of the public
service, or of any public or local institution or into any matter in which an enquiry would, in the
opinion of the Governor be for the public welfare:

AND WHEREAS I deem it advisable that an enquiry be held into whether, and if so in
what respects, there were any illegalities or irregularities surrounding tihe management and
operations of the Kingstown IBoard between the Isr. day of March, 1973, and the 12th day of
December, 1974, and in particular, but without restricting the generality of the foregoing, to
enquire into whether: and if so in what respects, there were any illegalities, irregularities or
improper motives surrounding the following-
1. the appointment, dismissal, discipline and assignment of employees, whether servants
or agents of the Board, or whether engaged full time, or on job work or otherwise;
2. the use, deployment and disposal (f funds, equipment and labour by the Board, whether
within or without the boundaries of the town of Kingstown as defined in the Kingstowa
Board. Ordinance, 1970, or on public or private property;
3. The award of Contracts by the Board, including the contract to build a Town Hall;
4. The expenditure of the funds of the Board:

NOW THEREFORE, I, RUPERT GODIFREY JOHN, Governor as aforesaid, do hereby
in pursuance of the powers vested in me in this behalf by the said Ordinance, issue this my"

behalf by the said Ordinance, issue this my commissionn appointing you, the said EDWAl
ALEXANDER CLAVIER HIUGHES, Esquire, O.B.E., IIvUn IAYTNES IAMLETT, Esquire, M.B.E. and
Colonel SYDNEY ALOYSIUS ANDERSON, Esquire, O.B.E., M.V.O., Q.P.31. to be Commissioners to
hold the enquiry aforesaid:

AND I direct that you the said EDWARD ALEXANDER CLAVIER Iluou1ts, Esquire, O.B.E. shall
be Chairman:

AND I further direct that you the said Coiinissioners forthwith proceed at such places
and times as may be convenient with due diligence and despatch to enquire into the matters
aforesaid and to report to me in writing with all despatch upon the said matters and to give
your opinion and recommendations and to furnish me separately with a full statement of the
proceedings of the Commission and the reasons leading to the conclusions at which you have
.arrived:

AND I further direct that, except to the extent to which you may find it desirable in the
public interest to hold a part of the enquiry in private, the enquiry shall be held in public:

WHEREAS section 7 of the Bank Holidays Ordinance (Cap. 161) it is
provided that the Governor may from time to time by proclamation in the Gazette,
appoint a special day to be observed as a Bank Holiday.
AND WHEREAS it is deemed expedient that the 22nd day of January,
1975, shall be observed as a Bank Holiday.
NOW, THEREFORE, I, RUPERT GODFREY JOHN, Governor of Saint
Vincent, pursuant to the authority vested in me by the said Ordinance, do hereby
proclaim and appoint the 22nd day of January, 1975, to be observed as a Bank
Holiday.

BEQUIA DISTRICT (DIVISION INTO WARDS) (REVIVAL)
ORDER.


(Gazetted 16th January, 1975).


1. Short title. This Order may be cited as the Bequia District (Division
into Wards) (Revival) Order, 1975.
2. Revocation. The Bequia District (Division into Wards) (Revocation
and Transitional Provisions) Order, 1974 is hereby revoked.
3. Revival. THe Bequia District (Division into Wards) Order, 1957
(No. 47 of. 1957) is hereby revived.


Made by the Governor under section 6(3) of the Local Government Ordi-
nance, 1951, this 16th day of January, 1975.

THE BEQUIA DISTRICT COUNCIL (ELECTION OF /S BERS),
(AMENDMENT) (REVOCATION) BY-LAW I


(Gazetted 16th January, 1975).


1. Short title. These By-Laws may be cited as the Bequia Distict council
(Election of Members) (Amendment) (Revocation) By-Laws, 1975, aiid-sfha
be read as one with the Bequia District Council (Election of Members) By-
Laws, 1957 (S.R. & 0. 1957 No. 48) (hereinafter referred tooas the principal
Ordinance) and all amendments thereto.
2. Revocation. The Bequia Distric-t Council (Election of Members.)
(Amendment) By-Laws, 1974, ar6 hereby revoked.
3. Revival. The' Bequia District Council (Election of Members) By-
Laws 1957 are hereby deemed to be the same as they were immediately before
the coming into operation of the Bequia District Council (Election of Members)
(Amendment) By-Laws, 1974.


Made by the Local Government Officer on behalf of the Bequia.District
under section 56(1) (a) of the Local Government Ordinance, 1951, this 16th
day of january, 197W.
