TIE LIQUOR LICENCE
ORDINANCE
No. 11 OF 1948

Persons intending to apply for Certi-
cates of Fit::;.; to sell intoxicating
Liquor in respect of the year 1969 un-
der the above named Ordinance are
hereby reminded that:-
1. There will be the Annual Licens-
ing Sessions for the Parishes of
Saints Andrew & George, Char-
lotte, Saint David, Saint Patrick
and the Grenadines in the month
of December, 1968, for the pur-
pose of considering the grant of
new certificates and renewals in
respect of the year 1969.
2. Application forms are available at
the Magistrates' Office, Kingstown
and at the various Police Stations.
3. Applications for new Certificates
should reach the Magistrates'
Office, Kingstown, not later than
the 31st day of October, 1968.


4. Applications for renewals should
reach the Magistrates' Office in
time for consideration by the
Licensing Boards at the Annual
Licensing Sessions in December,
1968; Applications for renewals
are subject to a late fee if they are
not received in time.
5. The time ;.nd date and place of
the several Sessions will be pub-
lished in a subsequent notice in
the Government Gazette.
6. Notice of intention to oppose
grant of certificate must be served
upon the Magistrate and upon the
licensed dealer not less than seven
days before the (lay fixed for the
holding of the Licensing Session
or hearing of the application.
7. Applicants are reminded that
there are nine classes of liquor
licences isuned under the Ordin-
ance i.e.-
Class 1-Wholesale Licence
Class 2-Retail Town Licence
for Kingstown, Georgetown,
Chateaubelair, Calliaqua, Bar-
rouallie, Layou.
Class 3-Retail Country Li-
cence
Class 4-Retail Grenadines Li-
cence
Class 5-Hotel Licence
Class 6-Refreshment House Li-
cence
Class 7-Occasional Licence
Class S-Bottle Licence
Class 9-Proprietary Club Li-
cence
8. Applicants are reminded that a
Class 6 Licence i.e. a Refreshment
House Licence shall not be granted
to any person wvio is not tile hold-
er of a Bottle Licence under
Class 8.

INCOME TAX (DOUBLE TAXATION RELIEF) (UNITED KINGDOM)
AMENDMENTN) ORDER, 1968.


(Gazetted 1st October, 1968).


1. Short Title. This Order may be cited as the Income Tax (Double
Taxation Relief) (United Kingdom) (Amendment) Order, 1968, and shall be
read as one with the Income Tax (Double Taxation Relief) (United Kingdom)
Order, 1948 (S.R. & O. 1948, No. 103) (hereinafter referred to as the principal
Order) and all amendments thereto.

2. Declaration. It is hereby declared-
(a) that the arrangements specified in the Agreement set out in the
Schedule to this Order have been made with the Government of the
United Kingdom with a view of affording relief from double tax-
ation in relation to income tax or corporation tax and taxes of a
similar character imposed by the laws of the United Kingdom
varying the arrangements set out in the Schedule to the principal
Order; and
(b) that it is expedient that those arrangements should have effect.

SCHEDULE

AGREEMENT AMENDING THE ARRANGEMENT IS BETWEEN THE
GOVERNMENT OF THE UNITED KINGDOM OF G AT BRITAIN

VINCENT FOR THE AVOIDANCE OF DOLE T X TION AND

TO TAXES ON INCOME /

Desiring to amend the Arrangement for the avoidance of double taxation
and the prevention of fiscal evasion with respect to taxes on income made in
1949 between His Majesty's Government and the Government of Saint Vincent
(hereinafter referred to as "the Arrangement"),

Have agreed as follows:

ARTICLE 1

The Arrangement shall be amended-
(a) by the deletion of paragraph 2 (1) (b);
(b) by the substitution for the references therein to "the Colony", "Col-
onial enterprise" and "Colonial tax" of references to "Saint Vincent",
''Saint Vincent enterprise and Saint Vincent tax'' respectively;
(c) by the addition at the end of paragraph 6 of the following new sub-
paragraph-
"(3) If the recipient of a dividend is a company which owns 10 per
cent or more of the class of shares in respect of which the
dividend is paid then sub-paragraph (1) shall not apply to the
dividend to the extent that it can have been paid only out of
profits which the company paying the dividend earned or other
income which it received in a period ending twelve months or
more before the relevanl date. For the purposes of this sub-
paragraph the term "relevant date" means the date on which
the beneficial owner of the dividend became the owner of 10
per cent. or more of the class of shares in question. Provided
that this sub-paragraph shall not apply if the beneficial owner
of the dividend shows that the shares were acquired for bona
fide commercial reasons and not primarily for the purpose of
securing the benefit of this paragraph.";
(d) by the substitution for sub-paragraphs (1) and (2) of paragraph 13
of the following two new sub-paragraphs-
"(1) Subject to 1he provisions of the law of the United Kingdom
regarding the allowance as a credit against United Kingdom
tax of tax payable in a territory outside the United Kingdom
(which shall not affect the general principle hereof)-
(a) Saint Vincent tax payable under the laws of Saint Vincent
and in accordance with this Arrangement, whether directly
or by deduction, on profits or income from sources within
Saint Vincent shall be allowed as a credit against any
United Kingdom tax computed by reference to the same
profits or income by reference to which Saint Vincent tax
is computed. Provided that in the case of a dividend the
credit shall only take into account such tax in respect

thereof as is additional to any tax payable by the com-
pany on the profits out of which the dividend is paid and
is ultimately borne by the recipient without reference to
any tax so payable.
(b) Where a company which is a resident of Saint Vincent
pays a dividend to a company resident in the United
Kingdom which controls directly or indirectly at least 10
per cent. of the voting power in the first-mentioned com-
pany, the credit shall take into account (in addition to
any Saint Vincent tax for which credit may be allowed
under (a) of this sub-paragraph) the Saint Vincent tax
payable by that first-mentioned company in respect of the
profits out of which such dividend is paid.";
(2) Subject to the provisions of the law of Saint Vincent regarding
the allowance as a credit against Saint Vincent tax of tax
payable in a territory outside Saint Vincent (which shall not
affect the general principle hereof)-
(a) United Kingdom tax payable under the laws of the United
Kingdom and in accordance with this Arrangement,
whether directly or by deduction, on profits or income
from sources within the United Kingdom shall be allowed
as a credit against any Saint Vincent tax computed by
reference to the same profits or income by reference to
which the United Kingdom tax is computed. Provided
that in the ease of a dividend the credit shall only take
into account such tax in respect thereof as is additional
to any tax payable by the company on the profits out of
which the dividend is paid and is ultimately borne by the
recipient without reference to any tax so payable.
(b) Where a company which is a resident of the United King-
dom pays a dividend to a company resident in Saint Vin-
cent which controls directly or indirectly at least 10 per
cent. of the voting power in the first-mentioned company,
the credit shall take into account (in addition to any
United Kingdom tax for which credit may be allowed
under (a) of this sub-paragraph) the United Kingdom tax
payable by that first-mentioned company in respect of the
profits out of which such dividend is paid."; and
(e) by the addition after paragraph 13 of the following new paragraph-
"13A. This Arrangement shall not apply to companies entitled to any
special tax benefit under the Saint Vincent International Busi-
ness Companies (Exemption from Income Tax) Ordinance, 1966,
as in effect on 9 February, 1967, or any substantially similar
law enacted by Saint Vincent after that date."

ARTICLE 2

(1) This Agreement shall enter into force when the last of all such
things shall have been done in the United Kingdom and Saint Vincent as are
necessary to give the Agreement the force of law in the United Kingdom
and Saint Vincent respectively.
(2) Upon the entry into force of this Agreement in accordance with
paragraph (1) the new sub-paragraph (3) of paragraph 6 and the new para-
graph 13A of the Arrangement shall both have effect immediately and the
new sub-paragaphs (1) and (2) of paragraph 13 thereof shall have effect-
(a) in the United Kingdom.
(i) as respects income tax including surtax, for any year of assess-
ment beginning on or after 6 April, 1!)68; and
(ii) as respects corporation tax, for any financial year beginning on
or after 1 April, 1968;
(b) in Saint Vincent:
as respects income tax, for any year of assessment beginning on or
after 1 January, 1968.

IN WITNESS WHEREOF the undersigned, duly authorised thereto,
have signed this Agreement.
