BANANA GROWERS ASSOCIATION (AMENDMENT)
REGULATIONS.


(Gazetted 5th March, 1959).


1. Short title. These Regulations may be cited as the Banana Grow-
ers Association (Amendment) Regulations, 1959, and shall be read as one with
the Banana Growers Association Regulations, 1958 (S.R. & 0. 1958, No. 38) (herein-
after referred to as the principal Regulations) and all amendments thereto.

2. Regulation 8 of principal Regulations revoked and re-
placed. Regulation 8 of the principal Regulations is hereby revoked and re-
placed with the following:-
"8. Exporting of bananas and banana plants. (1) All bananas or
banana plants grown in the Colony and intended to be exported therefrom
shall be delivered to the Association at such places in the Colony as shall
from time to time be determined by the Board and no bananas or banana
plants shall be exported from the Colony except by the Board on behalf of
the Association: Provided that nothing in this regulation shall prevent the
export by persons or bodies other than the Association of bananas which have
been rejected by or-on behalf of the Association, or in respect of which a
licence has been granted by the Board.
(2) No person shall sell or offer for sale for export by the Board or by the
Exporting Company any bananas which have been previously condemned for
export, nor shall any person purchase such bananas for such export except
by leave of the Doard. In this connection it shall be lawful for all selectors
of bananas working directly with the Association or with the Exporting
Company to mark rejected fruit by removing a thin sliver from the thick
end of the stem.
(3) The Exporting Company may accept any stem from which a sliver
has been so removed if a Board of Arbitration appointed under the terms of
the existing Agreement between the Association and the Exporting Company
finds that such stem is fit for export by the Exporting Company.
(4) Any person who contravenes or fails to comply with any of the
provisions of this regulation shall be guilty of an offence and shall be liable
on summary conviction to a fine not exceeding one hundred dollars and on a
second or subsequent conviction to a fine not exceeding two hundred and
fifty dollars."















3. New regulation added to principal Regulations. After
regulation 9 of the principal Regulations the following new regulation shall be
added:-
"9A. Registration of Growers. (1) The Board shall keep or cause to
be kept a register of growers and shall issue to each grower a numbered regis-
tration card or badge to be produced by the grower when called upon so to
do by any officer of the Association, and every grower shall be entitled to be so
registered without the payment of any fee therefore.
(2) No infant shall be entitled to be registered or shall cause himself
to be registered as a grower.
(3) Not more than one grower shall be registered in respect of the same
lot, piece or parcel of land.
(4) The Board shall, through its officers, refuse to accept any bananas
from a non-registered grower.
(5) No person other than the registered grower or his agent shall sell
or offer for sale any bananas to the Association, and all such bananas shall
be sold in the name of the registered grower.
(6) Any person who by himself or by his agent sells or offers for sale
to the Association any bananas not grown by such person, and any person
who permits any bananas not grown by him to be sold or offered for sale in
his name, shall be guilty of an .offence and shall be liable on summary convic-
tion to a fine not exceeding one hundred dollars."

Made by the Governor in Council under section 8 of the Banana Growers
Association Ordinances 1954-1958 (Suspension of Operation) Ordinance, 1958
(No. 13 of 1958) this 3rd day of March, 1959.

2. Commencement of Order. The Official Designations Order, 1954
(S.R. & O. 1954, No. 74) shall be deemed to have come into force and taken effect
on the 28th day of December, 1954.

Ordinance, 1940 (No. 4 of 1940) this 3rd day of March, 1959.
