IN THE SUPREME COURT OF THE
WINDWARD ISLANDS AND
LEEWARD ISLANDS.

ST. VINC'NT CIRCUIT.

(Appellate Jurisdiction.)

Suit No. 6/1958.

STANLEY GUMBS
Appellant

vs.

RELEASE JACOBS
Respondent

Before TAYLOR, J.

JUDGMENT.

The appellant in this case rents a
portion of a house he owns at Campden
Park to the respondent for $1.68 per
month. On the 21st February, 1958, his
application to eject the respondent, was
heard by the learned Police Magistrate.
The learned Magistrate allowed the re-
spondent six months to give up posses-
sion, granting her liberty to apply for
a further extension of time. Against
this decision the appellant has appealed.
Had I heard the case originally, I
would not have allowed the respondent
more than two months in which to leave,
or possibly three months. I consider
that six months was being over generous.
While it is true that she has six chil-
dren there is no evidence as to their
ages, and she is at the moment living
with a man for whom she has a child.
This appeal came on for hearing be-
fore me on the 5th May, 1958. When
I then adjourned it, I did not anticipate
that so long a time would have elapsed
before the case came up again. This
has been due to my visits to other Cir-
cuits and the pressure of work since my
return. It is now six months since the
learned Police Magistrate gave his de-
cision and the respondent is still in the
house and has paid no further rent. She
was owing three months rent when the
case was heard in February. She has
not appeared today and the message
which I have received unaccompanied
by a doctor's certificate that she is ill
carries no conviction with me.
This appeal is allowed and I order
the respondent to quit and deliver pos-
session in six weeks or be ejected.
G. L. TAYLOR,
Puisne Judge.
22nd August, 1958.
