By virtue of the powers vested in
me by section 28 ow the Defence
Force Ordinance, 1912 (Montserrat
No. 5 of 1912) and section 18 (6) of
the Interpretation of Laws Ordinance,
1898 (Montserrat No. 6 of 1898),
I, CHARLESWOR.TH ROSS, Commis-
sioner of the Presidency of Montser-
rat, ;s it appears to me advisable to
do by reason of an internal emer-
gency threateniini the security of life
and property of the inhabitants of
this Presidency, do hereby call out
the Montserrat Defence Force for
actual service until further notice;
and I do hereby appoint you, WALTER
STANLEY SOUTHWELL, Assistant
Superintendent of Police, to be the
officer in command of the said
Defence Force.
2. And all members of the said
Montserrat Defence Force and all
His Majesty's loyal subjects in the
Presidency of Montserrat are hereby
required and enjoined to take notice
of this Proclamation and to govern
themselves accordingly.
GIVEN at the Government House,
Montserrat, this 9th day of
August, 1951, in the fifteenth
year of His Majesty's reign.

ORDER OF .COPETENT AUTHORITY.


Order made by the Competent Authority for the Presidency of Antigua under Regulation 50
of the Defence Regulations, 1939. as having effect by virtue of the Supplies and Services
(Transitional Powers) Act, l P45, the Supplies and Servioes (Transitional Powers) (Colonies
etc.) Order in Council, 194 (lap.) the Supplies and Services (Transitional Powers)
Order, 1946, and the Supplies and Services Continuance Order, 1950 (Imp.).


No. 20 of 1951.
DEFENCE REGULATIONS, 1939.


1. Short Title. This Order may be cited as the Milk Production (Amendment) Order,
1951, and shall be read and construed as one with the Milk Production Order, 1950, (No. 40 of 1950)
hereinafter referred to as the Principal Order.
2. Amendment of Paragraph 8 of the Principal Order. Pa:rgraph 8 of
the Principal Order is hereby amended as Follows:-

(a) by the substitution for the words the dairy herd in sub-paragraph (1)]of
the following:-

All cows in milk, dry cows, dairy bulls and such other cattle forming
part of the dairy herd as the Inspector may determine."

(b) by the insertion after sub-paragraph (3) of the following sub-paragraphs:-

(4) No additions other than births to cows forming part of the dairy
herd shall be made to the dairy herd without the prior consent in writing of the
Inspector.
(5) All births, deaths and additions to the dairy herd shall be reported in
writing by the milk producer or his agent to the Inspector within seven days
after their occurrence.
(6) No cattle belonging to any person other than the milk producer shall
form part of the dairy herd except with the prior consent in writing of the
Inspector.
(7) Any cattle found in a licensed dairy or on the farm attached thereto
in contravention of sub-paragraphs (4) or (6) of this Order shall be liable to
forfeiture and shall be dealt with or may be disposed of in accordance with the
instructions of the Inspector, and the Milk producer, his agents and employees
shall comply with any such instructions as may be given by the Inspector:
Provided that any such forfeiture may be remitted, in whole or in part,
in his discretion, by the Competent Authority.'"
3. Amendment of Paragraph 9 of the Principal Order-. Paragraph 9 of the
Principal Order is hereby amended by the insertion after subparagraph (2) of the following sub-
paragraph:-
(3) Any removal slaughtering or treatment prescribed under sub-paragraphs (1) or
(2) of this paragraph shall be effected by the milk producer or his agents at his expense
and subject to any directions as may be stipulated by the Inspector."

An Ordinance to provide for the registration of
persons entitled to vote at the elections of
members of the Legislative Council of the
Presidency and for other purposes in connec-
tion therewith.
WHEREAS provision is made by the Antigua Preamble
Constitution Ordinance, 1936, as amended, o0/1936.
for the constitution of a Legislative Council for
the Presidency, the qualification and election of
certain members of such Council and the registra-
tion of voters:
AND WHEREAS it is proposed to make
other provision for the constitution of a Legislative
Council for the Presidency and for the election of
members of such Council:
AND WHEREAS it is expedient for the
avoidance of delay that the Legislature of the
Presidency should make provision for the registra-
tion of persons entitled to vote at the election of
members of the Legislative Council in manner
hereinafter appearing:
BE IT THEREFORE ORDAINED by the
Governor and Legislative Council of Aritigua as
Sfollows:-
1. This Ordinance may be cited as the Short title.

Interpreta- 2. (1) In this Ordinance, unless the context
tion. otherwise requires-

Administrator" means the person for the
time being holding the office of Adminis-
trator of the Presidency and includes
t every person for the time being acting as
such in his stead;
"Council means the Legislative Council of
the Presidency;
election means an election of members to
the Council;
"Governor" means the Governor and Com-
mander-in-Chief for the time being of the
Leeward Islands and includes every
person for the time being administering
the Government of the Leeward Islands
and, to the extent to which a Deputy for
the Governor is authorised to act, that
Deputy;
proclamation means a written or printed
notice under the hand of the Governor or
the Administrator, as the case may be,
published by his order in the Presidency;
"Revising Officer" means the person appointed
by the Administrator for the purpose of
revising and settling the list of voters for
one or more registration units under this
Ordinance;
"voter" means any person who votes or is
entitled to vote at an election.

(2) References in this Ordinance to His
Majesty's dominions shall have effect as if they
included references to all British protectorates and
British protected states and to all territories admin-
istered by the Government of any part of His
Majesty's dominions under the trusteeship system
of the United Nations.

(3) This Ordinance shall be construed-
(a) as if subsection (1) of section 1 of
12,13 & i the India (Consequential Provision) Act,

subsection applies to laws in force on the date
mentioned in that subsection; and
(b) as if subsection (2) of section 3 of
the British Nationality Act, 1948 (as inter- 11 & 12 Geo. 6
preted by subsection (1) of section 3 of the c. 56.
Ireland Act, 1949) and subsection (2) of sec- 12 & 13,Geo. 6
tion 3 of the Ireland Act, 1949, applied to it c. 41.
as those subsections apply to laws in force at
the dates of the commencement of those Acts
respectively.

3. (1) Every person who- Qualification
of voters.
(a) has attained the age of twenty-one
years; and
(b) is not a lunatic so found under any
law in force in the Presidency; and
(c) is a British subject; and
(d) has resided in the Presidency for
twelve months immediately preceding the date
of registration or is domiciled in the Presi-
dency and is resident therein at the date of
such registration; and
(e) is not disqualified from being regis-
tered as a voter by any law in force in the
Presidency relating to offences connected with
elections,
shall be entitled to be registered as a voter and
when registered, to vote at an election:
Provided that no person shall register in
more than one registration unit.
(2) No person shall be registered as a voter
or be entitled to vote atoan election who has been
sentenced by any court in His Majesty's dominions
or in any territory under His Majesty's protection
to death, or penal servitude, or imprisonment for
a term exceeding twelve months, and has not
either suffered the punishment to which he was
sentenced or such other punishment as by com-
petent authority may have been substituted for the
same or received a free pardon from His Majesty.

Registration 4. (1) For the purpose of the registration
units. of persons entitled to be registered as voters under
this Ordinance, the electoral district of the Presi-
dency shall be divided into the registration units as
defined in the First Schedule to this Ordinance.
(2) The Register of Voters shall be framed
in separate parts for each registration unit.
Appointment 5. (1) The Administrator shall appoint
ofReistering a fit and proper person to be the Registering Officer
for each registration unit.

(2) The Administrator may appoint an assist-
ant or assistants to each such Registering Officer in
the performance of his duties under this Ordinance.
(3) Subject to the authority, directions and
control of the Registering Officer, an assistant shall
have all the powers and may perform any of the
duties of the registering officer under this Ordi-
nance except the examination of claims.
(4) There shall be paid to eac'i Registering
Officer and Revising Officer and the other officers
and persons to be appointed under this Ordinance
such remuneration for their services as the Govern-
or in Council may direct.
Notice to per- 6. Subject as hereinafter provided, the

before the first day of July triennially thereafter,

who may be entitled to vote at the election of a
member of the Council todeliver to the Registering
Officer of the registration unit in which such person
resides, notice of his claim to be registered as a
voter.
Notice of 7. (1) Within the time prescribed in section

set out as Form No. 2 in the Second Schedule to Form No. 2.
this Ordinance, and shall produce such evidence
as may be necessary to establish his claim to be so
registered:

Provided that no person whose name is upon
the Register of Voters shall be required thereafter
to make any such claim as aforesaid so long as he
is entitled to be registered as a voter.

(2) Every claimant to be registered as a
voter shall, if he is able so to do, with his own
hand subscribe his name and the date of such sub-
scription to the notice of his claim to be registered
as a voter.
(3) If any such claimant is unable by reason
of illiteracy, blindness or any other physical cause
to perform the subscription mentioned in subsection
(2) of this section, such subscription shall be per-
formed on his behalf by the Registering Officer,
who shall witness the same by subscribing his own
signature to the notice of claim of such claimant.

8. Every Registering Officer shall examine Examination
the qualifications in respect of which a claim to be of claims by
registered as a voter is made and shall receive such gosering
evidence as may be necessary to prove to his satis-
faction that the claimant possesses the qualifications
in respect of which he claims to be registered as a
voter.

9. In all cases where the Registering Officer Registration
is satisfied that the claimant possesses the necessary of claimant.

manner hereinafter provided, otherwise he shall
disallow such claim.
10. The Registering Officer, in the month of Examination

voter, and shall write the word Dead" against
the name of every person who he has cause to
believe is dead.
List of voters. 11. The Registering Officer shall-
(a) for the purpose of the general election
to be held in the year 1951, within the space
of twenty-one days from the last day upon
which any notice of claim as provided in
section 7 of this Ordinance is allowed to be
made, and
(b) in the month of August triennially
thereafter,
make out an alphabetical list in the form set out as
Form No. 3. Form No. 3 in the Second Schedule to this Ordi-
nance, of all persons residing in the registration unit
for which he is appointed who by virtue of section 7
of this Ordinance, or who in his opinion, are entitled
to be registered as voters, and shall cause a copy of
such list dated and signed by him (hereinafter
referred to as the first list of voters) to be published
in the Gazette and to le posted on the outer doors
of any Court House, Church, Chapel, school-house
or other building in such registration unit which in
his opinion will give publicity to such list.
Procedure as 12. (1) Every person whose iiame has been

voters and who claims to have his name inserted
therein, shall within ten days after the first publica-
tion of such list, give notice in writing to the
Registering Officer of the registration unit in which
Form No. 4. he resides in the form set out as Form No. 4 in the
Second Schedule to this Ordinance.

(2) Every person whose name appears in such
list may object to any other person whose name also
appears therein as not being entitled to have his
name therein and shall within ten days after such
publication give notice in the form set out as Form

and to the person objected to by delivering the
same to him personally or by leaving the same at
his usual place of abode.
(3) Immediately on the expiration of the said
ten days the Registering Officer shall prepare a list
of all such claims and objections and the names of
the persons who have made the same, and such list
shall be open to inspection of the public free of
charge during the hours of business in each day
for a period of ten days after the preparation of
such list, at the Magistrate's Courts and Police
Stations, if any, in the registration unit to which
such list applies and at the Court House in the
City of Saint John.
13. (1) An open Court shall be held in one Court to revise
or more places as may be designated by the Ad- list of voters.
ministrator for the purpose of revising the first list of
voters by and before a Revising Officer.
(2) The said Court shall be held on such day
as may be fixed by the Revising Officer, being
withinn four weeks after the publication of the list
prepared under sub-section (3) of section 12, of
persons claiming to be entitled to be registered as
voters or objected to as such, and six days notice in
the form set out as Form No. 6 in the Second Form No. 6.
Schedule to this Ordinance of the holding of such
Court and of the place at which the same is to be
held shall be given in the Gazette, in one or more
of the newspapers published in the Presidency and
by posting such notices on the outer doors of the
Court House, Treasury, Magistrate's Courts and
Police Stations in the Presidency.
14. (1) Upon the production in Court by Procedure of
the Registering Officer of the list of persons in his rutrevisidn
registration unit claiming to be entitled to be regis-
tered as voters, or objected to as such, the Revising
Officer shall go through the same and shall insert in
the first list of voters the name of every person
who is proved to his satisfaction to be entitled to
have his name inserted therein, and shall strike out
of such list the name of every person who, upon the
application of the objector, is proved to the satisfac-
tion of the Revising Officer to be disentitled to have
his name retained in such list.

(2) If the objector appears neither in person,
nor by counsel, nor by some voter duly authorised
by him in that behalf, the objection shall be over-
ruled, and the name of the person objected to shall
be retained in the list of voters.


(3) The Revising Officer shall have power to
adjourn the Court to such time and as often as may
be necessary and shall have the same powers for
the keeping of order in his Court, as are given to
a Magistrate under the Magistrate's Code of Proce-
dure Act.
(4) The Revising Officer shall in open Court
determine all claims or objections, and shall write
his initials against any name struck out of the list
of voters or inserted therein, and against any
mistake or omission corrected, and shall sign his
name to every page of the list, when the same is
finally settled.
(5) If the Revising Officer is of the opinion
that the claim or objection of any person is without.
foundation or is frivolous, he may order such
person to pay the actual costs of the inquiry inclu-
ding the costs of witnesses, and such costs shall be
recoverable by an action before any Court of com-
petent jurisdiction.
(6) Any person aggrieved by a decision of the
Revising Officer may appeal to a Judge in accord-
ance with the provisions of the Magistrate's Code
of Procedure Act.
15. (1) The Revising Officer when he shall
have completed the revision of the list of voters
shall cause two copies of such list dated and signed
by him to be printed and separately bound and
shall certify such printed lists and forthwith trans-
mit to the Administrator such certified lists one of
which shall be designated by the Administrator as
the Register of Voters and shall remain in force until
the next list of voters has been revised and certified
in accordance with the provisions of this Ordinance.
(2) If as the result of an appeal from a deci-
sion of the Revising Officer, the insertion of any
name in the Register of Voters or the deletion of

any name therefrom shall be necessary, such in-
sertion or deletion shall be made by the Registering
Officer who shall number any name inserted with
the same number as the preceding name followed
by a letter or letters.

RESOLUTION OF THE LEGISLATIVE COUNCIL OF ANTIGUA
DATED AUGUST 16, 1951.

BE IT RESOLVED that the sum of $25.62 (twenty-
five dollars and sixty-two cents) being moneys paid into
the Treasury of the Presidency as import duty on articles
purchased by a detachment of the 1st Battalion Royal
Welch Fusiliers be refunded by the Treasurer to the Officer
Commanding the said detachment.
