An Ordinance to amend the Minerals (Vesting)
Ordinance, 1948.

BE IT ORDAINED by the Governor and
Legislative Council of Antigua as follows:-
1. This Ordinance may be eited as the Short title.
Minerals (Vesting) (Amendment) Ordinance,
1951, and shall be read as one with the Minerals 1/1949.
(Vesting) Ordinance, 1948, hereinafter called the
Principal Ordinance.
2. Section 2 of the Principal Ordinance is Amendment
to section 2 of
hereby amended the Principal
Ordinance.
(a) by the insertion of the following para-
graph lettered (c) after paragraph (,) (ii)-
(c) mineral oils, including bitumen,
asphalt and all other bituminous sub-
stances with the exception of coal."
.(b) by the relettering of paragraphs
(c) and (d) as paragraphs
(d) and (e) respectively.
3. Subsection (3) of section 6 of the Princi- Subsection (3)

Minerals (Vesting) (Amendment). No. of 1951.


"(3) No compensation shall be payable
to the owner of any land at any time after
either-
(i) the fiftieth anniversary of the com-
mencement of this Ordinance; or
(ii) the twenty-fifth anniversary of the
day upon which, after the com-
mencement of this Ordinance, such
minerals were first won in, on, or
under such land,
whichever first happens; Provided that where
mining operations are suspended on the area
of the mining lease, the period during which
such operations are so suspended shall not be -
taken into account in determining such
twenty-fifth anniversary."

OBJECTS AND REASONS.


The object of this Bill is to amend the Minerals
(Vesting) Ordinance, 1948, by including provision for vesting
mineral oils in the Crown, and to restate in clearer terms
section 6 (3) of the Ordinance.

An Ordinance to amend further the Register Act
of one thousand eight hundred and sixty
seven of births, deaths and marriages.
BE IT ORDAINED by the Governor and
Legislative Council of Montserrat as follows:--

1. This Ordinance may be cited as the Short title.
Registration of Births and Deaths (Amendment)
Ordinance, 1951, and shall be read as one with the J2/s167
Register Act of one thousand eight hundred and 5/19
sixty seven of births, deaths and marriages, as
from time to time amended, which Act as so
amended is hereinafter referred to as the Principal
Ordinance.


2. Section 3 of the Principal Ordinance is
hereby repealed and in place thereof the following
shall have effect-

3. Each District Registrar shall reside
within the district of which he is Registrar, and
shall cause his name and office, together with
the names of the places in the district for
which he is appointed, to be exhibited in a
conspicuous manner on the front part of his
dwelling honse or his usual place of business."

3. Section 5 of the Principal Ordinance is
hereby amended by-

(a) renumbering the section as section 5
(1); and
(b) the addition thereto of the following-
subsection to be numbered (2)--

(2) The power conferred by sub-
section (1) of this section on the Gover-
nor, or the Registrar with the approba-
tion of the Governor, to make regulations
shall include power to make regulations
prescribing the forms of certificates to be
issued under subsection (2) of section 29,
the particulars to be furnished by appli-
cants for certificates thereunder, the man-
ner in which those certificates are to be
compiled, and the particulars which are to
be contained therein, so however, that no
certificate issued under subsection (2) of
section 29 shall include any particulars
except the name, surname, sex and date
of birth and such other particulars, if any,
as may be prescribed, not being particulars
relating to parentage or adoption."

new section. the following new section numbered 9 shall be
inserted-

Act, 1949, shall have occurred, the possessor or
occupier of the house, or of the apartment, or
of the dwelling in which such death shall have
occurred, or the head of the family, or of the

household, or of the persons residing or being
in such house, or apartment, or dwelling, or the
nearest rural constable, or, in a town or village
in which there is a Police Station, the officer in
charge of the Police Station, shall obtain from
the medical attendant of the deceased person
or, if there has been no such medical attendant,
from the district medical officer, a certificate
signed by such medical attendant or district
medical officer setting forth the cause of death,
and shall forthwith give notice of such death
and produce such certificate to the District
Registrar of the district in which such death
shall have occurred or to the Registrar if such
District Registrar cannot be found."

7. After section 17A of the Principal Ordi- Insertion of

Form 6 hereto," and the substitution therefore of the

Schedule A to this Ordinance."

10. Section 19A of the Principal Ordinance
is hereby repealed and in place thereof the following
shall have effect-


"19A. Every District Registrar shall
inform himself as carefully as possible of every
death which shall happen within his district and
register particulars relating to such death and
the cause thereof in the register book of deaths
according to Form 2 of Schedule A to this Or-
dinance. "


11. Section 23 of the Principal Ordinance is
hereby repealed and in place thereof the following
shall have effect-


23. (1) No alteration in any register
book of births or deaths shall be made except
as authorised by this Ordinance.

"(2) Any clerical error in any register
may be corrected by the Registrar or any person
duly authorised in that behalf by the Registrar.

(3) An error of fact or substance in any
register may be corrected-

n (a) by entry in the margin without
any alteration of the original entry; or
(b) if the Registrar deems it neces-
sary, by the making of a further entry
with a reference therein to the original
entry by the Registrar or by a person duly
authorised in that behalf by the Registrar,
upon production to the Registrar or such duly
authorised person by the person requiring such
error to be corrected of an affidavit setting forth
the nature of the error and the true facts of the
case, and made by the person required to give
information concerning the birth or death with
reference to which the error has been made, or in
default of such person then by two credible persons
having knowledge of the truth of the case."

18. Section 24 and 25 of the Principal Ordi-
nance are hereby repealed,

18. The Principal Ordinance is hereby fur-
ther amended by--,-

(a) renumbering section 26 as section 24;

(b) the insertion of the following new
section to be numbered as section 25-



"25. The District Registrar of Dis-
trict B and the District Registrar of Dis-
trict C shall-

(i) from time to time deliver or
caused to be delivered to the
Registrar all register books in
their possession which shall have
been duly filled up or completed;
(ii) not later than the 15th day fol-
lowing the end of every quarter
send to the Registrar quarterly
returns of the births and deaths
registered in their respective
districts."
(c) renumbering sections 27 and 28 as
sections 26 and 27 respectively.

14. Sections 29 and 30 of the Principal
Ordinance are hereby repealed and in place thereof
the following shall have effect-

from the General Registry Office shall be
stamped or sealed with the seal of the General
Registry Office.

29. (1) Any person shall be entitled
on payment of the fee authorised by Schedule
B to this Ordinance to search any record or
register in the General Registry Office or in the
custody of any District Registrar between the
hours of 10 o'clock in the forenoon and
3 o'clock in the afternoon of every day, except
Sunday and holidays, and to have a certified
copy of any entry:

"Provided that on Saturdays the hours
when the records and registers may be searched
shall be between the hours of 10 o'clock in the
forenoon and 1 o'clock in the afternoon.

(2) Any person shall, on payment of a
fee of twelve cents and on furnishing the pre-
scribed particulars, be entitled to obtain from
the Registrar or a District Registrar a certifi-
cate in the prescribed form of the birth of any
person compiled from the records and registers
in the custody of the Registrar, or from the
register in the custody of that Distict Registrar,
as the case may be."


15. After section 29 of the Principal Ordi-
nance the following new section numbered 30 shall
be inserted-


30. All copies of entries which shall be
certified as true under the hand of the Regis-
trar and purporting to be sealed or stamped
with the seal of the General Registry Office
(which seal it shall not be necessary to prove)
shall be admissible in all civil and criminal cases
as evidence of the births and deaths to which
the same relate without any further or other
proof of such entries; and no certified copy
purporting to be issued from such General
Registry Office shall be of any force or effect
unless it is signed and sealed or stamped with
the seal of such 'office."


16. Section 32 of the Principal Ordinance is
hereby repealed and in place thereof the following
shall have effect-


"32. Any person who-

(i) wilfully makes any false answer
to any question put to him by
the Registrar or a District Reg-
istrar relating to the particulars
required to be registered con-
cerning any birth or death or
wilfully gives to the Registrar

(iii) wilfully makes any false state-
ment with intent to have the
same entered in any register of
births or deaths,

shall be liable on summary conviction
to a fine not exceeding one hundred dollars
or to imprisonment with or without -hard
labour for a term not exceeding six
months, and on conviction on indictment
to imprisonment with or without hard
labour for a term not exceeding five
years."

17. Section 39 of the Principal Ordinance is Amendment
hereby amended by the addition of the following of sectin9

The words general, search shall mean
a search during any number of successive
hours not exceeding six without stating the
object of search.
The words "particular search" shall
mean a search over any period not exceeding
five years for any given entry.

to time in pursuance of section 5 of this Ordi-

For the word regulation appearing in the marginal
note and the words District Registrar appearing in
the 6th line of the section there shall be substituted
respectively the words Regulations and District

OBJECTS AND REASONS.


One of the objects of this Bill is to amend the existing
law relating to the registration of births and deaths so as to
place the custody of the registers under the'control of the
Registrar, to facilitate the registration of causes of death and
to modernize in other respects the Act of 1867 which is archaic
and cumbersome.

2. Another object is to enable the Registrar and District
Registrars to'issue a birth certificate in shortened form and at a
reduced fee of 12c. In the many cases where a birth certificate
is.required merely as evidence of age the shortened form of
Certificate will prove a convenience to the public and save
from unnecessary hardship persons who were born out of
wedlock.

3. The Bill also enables alterations to be made in reg-
isters of births or deaths where any error appears therein, on
the prescribed affidavit being produced. This will relieve hard-
ship in the frequent cases where persons apply for passports or
visas under a name which is different from that which was given
to the Registrar when their birth was registered.

4. A section, has been added imposing penalties' on
persons who make false statements to the Registrar or to a
District Registrar in relation to the registration of a birth or
death.
