THE TRADING WITH THE ENEMY (AUTHORIZATION) JAPANN) ORDER
1950 MADE BY THE GOVERNOR UNDER SECTION 6 OF THE
TRADING WITH THE ENEMY ORDINANCE, 1940 (ORD. NO. 16
OF 1940) AS AMENDED.

1. Short Title. This Order may be cited as the Trading
with the Enemy (Authorization) (Japan) Order, 1950.
The Trading with the Enemy Ordinance, 1910 (Ord. No.
16 of 1940) as amended, is hereinafter referred to as "the Ordin-
ance."
2. (1) Interpretation. The Interpretation Ordinance,
1940 (Ord. No. 15 of 1940) shall apply to the interpretation of this
Order as it applies to the interpretation of an Ordinance.
(2) For the purposes of this Order-
(i) "property" means real or personal property, and in-
cludes any estate or interest in real or personal pro-
perty, any negotiable instrument, debt or other chose
in action, and any other right or interest whether in
possession or not, and
(ii) "Japan" means all territory which was under Ja-
panese sovereignty on the 7th December, 1941.
3. Authorization. Notwithstanding anything contained
in section 3 of the Ordinance, any person, unless the Governor
otherwise directs, may trade except as provided in Article 6 here-
of with any person to whom this Order applies.
4. (1) Transfer of Annuities. The transfer by or on be-
half of any person within the description contained in Article 5 of
this Order of any annuities, stocks, shares, bonds, debentures or
debenture stock registered or inscribed in any register, branch
register or other book kept in the Colony of Dominica which, on
or after the 6th day of January, 1950, comes into the ownership
of any such person as aforesaid, is hereby sanctioned.
(2) The Governor hereby consents to the allotment or
transfer of any securities as defined in paragraph (1) of this Arti-
cle to or for the benefit of any individual who is an enemy subject
resident in Japan or any body of persons constituted or incorporat-
ed in, or under the laws of Japan.









5. Application. This order shall apply
(a) to any Government, public or other authority in Japan.
(b) to any individual resident in Japan,
(c) as respects any business carried on in Japan, to any
individual or body of persons (whether corporate or
unincorporated) carrying on that business.
6. (1) Limitation. This Licence shall not, except in the
case of anything done under an authority,, given generally or
specially by, or by any person authorised in that behalf by the
Governor extend to or authorise any trade in respect of any con-
tract entered into before the 6th day of January, 1950.
(2) As regards any property situate in the Colony of
Dominica belonging to or held or managed at that date on behalf
of any person to whom this Order applies and as regards any pro-
perty arising presently or at any future time out of such property
this Licence shall not, except in the case of anything done under
an authority, given generally or specially by, or by any person au-
thorised in that behalf by the Governor extend to or authorise any
trade in respect thereof.
7. Revocation. The Orders specified in the Schedule
hereto are hereby revoked.

JAPANN) ORDER 1950, MADE BY THE GOVERNOR UNDER SEC-
TION 9 OF THE TRADING WITH THE ENEMY ORDINANCE, 1940
(ORD. NO. 16 OF 1940) AS AMENDED

1. Short Title. This Order may be cited as the Trading
with the Enemy (Custodian) (Amendment) (Japan) Order, 1950.
The Trading with the Enemy Ordinance, 1940 (Ord. No.
16 of 1940) as amended, is hereinafter referred to as "the Ordn.-
ance."
2. (1) Interpretation. The Interpretation Ordinance,
1940 (Ord. No. 15 of 1940) shall apply to the interpretation of this
S Order as it applies to the interpretation of an Ordinance.
(2) For the purposes of this Order "Japan" means a'l
territory which was under Japanese sovereignty on the 7th De-
cember, 1941.
3. Payments to Custodian. Sections 2, 5 and 6 of the
Trading with the Enemy (Custodian) Order, 1940 (S.R. & O. 1940,
No. 14) as amended, (requiring payment of certain moneys to the
Custodian and imposing restrictions and requirements in regard
to certain property in the Colony of Dominica shall not apply to
(a) any money which would but for the operation of Se -
tion 9 of the Trading with the Enemy Ordinance,
1940 and of Article 1 of the Trading with the Enerr y
(Custodian) Order, 1939, become payable to or ftr
the benefit of any person within the description coi -
tained in Article 4 of this Order by reason of any
trade authorised by Article 3 of the Trading with ihe
Enemy (Authorisation) (Japan) Order, 1950;
(b) any property which on or after the 6th day of Jan--
ary, 1950, comes itto the ownership of any person
within the description contained in Article 4 of i is
Order by reason of any such trade as aforesaid includ-
ing any money derived therefrom;
(c) any money or property to which the abave mentioned
Articles would apply only because any such person as
aforesaid became resident or commenced or rtcom-










menced to carry on business in Japan on or after the
15th day of August, 1947.
4. Application. This Order shall apply,
(a) to any Government, public or other authority in
Japan,
(b) to any individual resident in Japan,
(c) as respects any business carried on in Japan, to any
individual or body of persons (whether corporate or
unincorporated) carrying on that business.
(d) as respects any business carried on in any territory
which is not an area which for the time being is to be
treated as enemy territory for the purposes of Section
2 or of Section 4 of the Ordinance, to any body of
persons (whether corporate or unincorporated) carry-
ing on that business if and so long as the body is con-
trolled by any individual resident in or body of per-
sons carrying on business in Japan.
5. Revocation. The Orders specified in the Schedule here-
to are hereby revoked.
