THE ACQUISITION OF LAND ACT (Chapter 254)

THE ACQUISITION OF LAND (SPECIAL APPLICATION)
ACT 1957
(No. 21 of 1957)
WHEREAS it appears to His Excellency the Governor in
Council that the land described in the Schedule hereto is required
for a public purpose
NOW THEREFORE it is hereby notified that it is the inten-
tion of His Excellency the Governor in Council to acquire the
said land for a public purpose to wit: for the purpose of imple-
menting the Agreement made with the concurrence of the Gov-
ernment of the Bahama Islands between the Government of the
United Kingdom of Great Britain and Northern Ireland and the
Government of the United States of America concerning a Long
Range Proving Ground for Guided Missiles to be known as "The
Bahamas Long Range Proving Ground"
All persons interested in the said land shall within 30 days of
the publication of this notice state in writing to the Colonial
Secretary of the Colony the nature of their respective interests in
the said land and the amount and particulars of their claim to
compensation for such interests.

SCHEDULE
All that certain tract or parcel of land situated in the area
between Barkers Point and Grahams Harbour, on the northern
coast of the Island of San Salvador, Colony of the Bahamas, as
outlined on Corps of Engineers, U.S. Army may designated Draw-
ing No. RE-2880 and on file at the Corps of Engineers District
Office, Jacksonville, Florida, U.S.A., which said map by this
reference is made a part hereof, and more particularly described
as follows:
From U. S. Coast and Geodetic Survey Station "WEEL"
situated on northern coast of Island of San Salvador at Latitude
24 degrees 06 minutes 56.6483 seconds North, Longitude 74 de-
grees 29 minutes 22.2075 seconds West, go thence South 44 de-
grees 05 minutes 13 seconds East, 183.41 feet to a brass disc set
in concrete on the northern boundary of the Main Public Road
which is the point of beginning of Tract No. SS-524 being describ-
ed herein;

From this point of beginning the boundaries of said Tract
No. SS-524 extend thence through land said to be in possession
of Frederick Zissu on the following three (3) courses:
North 3 degrees 07 minutes 21 seconds West, 250.00 feet to a
brass disc set in concrete;
Thence South 80 degrees 09 minutes 03 seconds East, 205.23
feet to a brass disc set in concrete;
Thence South 3 degrees 07 minutes 52 seconds East, 204.00
feet to a brass disc set in concrete on the northern boundary of
the said Main Public Road;
Thence along a portion of the northern boundary of the said
Main Public Road South 86 degrees 52 minutes 32 seconds West,
200.00 feet back to the point of beginning; which said tract or
parcel of land herein described and known as Tract No. SS-524
contains 1.04 acres, more or less.

Health Act


Made Under
THE PUBLIC HEALTH ACT
(Chapter 35)
In exercise of the powers conferred upon them by section 37
of the Public Health Act the Health Board with the approval of
and confirmation by the Governor in Council hereby make the
following Rules:

1. These Rules may be cited as the Health Amendment
Rules 1963.

2. Rule 10 of the Health Rules 1934 is hereby revoked and
the following substituted therefore:
"Premises on which animals etc.,
kept to be clean and sanitary.
"10.(1) Every person who keeps or causes to be kept any
pig, goat, sheep, cow or horse, or any poultry, pigeons or other
birds shall ensure that the premises on which such animals or birds
are kept are maintained in a clean, wholesome and sanitary con-
dition and that no pollution of any water supply is likely to result
and that no nuisance is likely to arise.
Certain Area within which certain
animals may not be kept.
(2) No person shall keep, goats, pigs, horses or cattle within
that area delineated as follows:-
All that part of New Providence bounded on the North by
the Harbour of Nassau, on the East by Mackey Street, on the
South by an imaginary line starting at a point approximately three
hundred and eihty yards to the south of the junction of Mackey
Street and Shirley Street and continuing in a straight line to the
southeast corner of the grounds of the Princess Margaret Hospital,
thence southwardly to Prison Lane, thence to the southern boun-
dary line of the Police Barracks, thence in a straight line west-
wardly to the junction of Dillet Street and Blue Hill Road and
following the centre of Dillet Street and Meeting Street to Nassau
Street, and on the West by Nassau Street and also the whole of
Hog Island and also Potters Cay and all other islets and cays
id the Harbour of Nassau:
Provided, however, that if the permission in writing of the
Board of Health is obtained it shall be lawful, where such exists at
the coming into operation of these Rules, to keep in the area
defined in this paragraph pigstyes, cowsheds, pens, and sheep,
goats, pigs, cattle and horses not less than fifty feet away from
the nearest boundary line of the premises.
(3) Notwithstanding the provisions of paragraph (2) of this
rule it shall be lawful for the Health Board to grant permission
in writing to the owners for the time being of that area of Hog
Island comprising the tract of land known as Saratogo and a
portion of the tract of land known as Howelton or The Nassau
Dry Dock and delineated on the diagram annexed to an Inden-
ture of Conveyance dated the Sixth day of March, 1953, and
recorded in Registry of Records in Book K.20 at pages 44 to 46
and thereon Coloured PINK AND ALSO the lots numbered 1, 2,
3, 4, 5, 6, 7, 9, 10 and 11 of a Plan of Eleven lots of Hog Island
laid out by the Surveyor General of the Colony and filed In the
Crown Lands Office of the Colony as No. 73 AND ALSO a tract
of land comprising 5 acres being a portion of Lot No. 8 of the
said Plan No. 73 the said tract being delineated on the diagram
annexed to an Indenture of Conveyance dated the Twenty-third
day of December, 1941, and recorded in the Registry of Records
in Book G. 13 at pages 440 to 443 and thereon coloured PINK AND








ALSO another tract of land comprising 5 acres being a portion,
of the said Lot No. 8 of the said Plan No. 73 the said tract being
delineated on the diagram annexed to an Indenture of Convey-
ance dated 'the Fourth day of April, 1941, and recorded in the
Registry of Records in Book A.15 at pages 189 to 191 and thereon
coloured Pink to keep horses thereon subject to the following
conditions:
(a) All stables shall be situated at least 200 feet from any
other building whether occupied or not;
(b) The site and construction of the stables shall be subject
to the approval of the Health Board;
(c) Any permission granted by the Health Board under this
paragraph may be revoked if the stables are found to
cause a nuisance;
(d) Permission to keep horses under this paragraph shall
only be granted for one year at a time.
In certain Area keeping of certain animals not
permitted within 100 feet of dwelling.
(4) It shall be unlawful to keep sheep, goats, pigs, cattle
and horses or pigstyes, cowsheds, pens or stables within 100 feet
of any occupied building in all that part of New Providence
outside the areas as laid down in paragraph 2 of this rule:
Provided, however, that if the permission in writing of the
Board of Health is obtained it shall be lawful where such exists
at the coming into operation of these Rules, to keep in the area
defined in this paragraph pigstyes, cowsheds, pens and sheep,
goats, pigs, cattle and horses not less than fifty feet away from
the nearest boundary line of the premises.
(5) Notice in writing shall be given by the Sanitary Inspec-
tor on behalf of the Board of Health to any person guilty of
breach of this rule and any such person shall be deemed to com-
mit a separate offence for every day during which any such
contravention continues after service of notice upon such person."
3. The short title of the Health Amendment Rules 1962 dated
the 4th day of August, 1962, is hereby amended by inserting the
symbols, word and figure "(No.2)" between the words "Amend-
ment" and "Rules" appearing therein.

(Chapter 66)
In exercise of the powers conferred upon the Governor in
Council by Section 3 of The Children and Young Persons Act,
Chapter 66, the following Order is hereby made:
1. This Order may be cited as The Children and Young
Persons (Juvenile Courts .Panel)(Amendment) Order 1963.
2. The Children and Young Persons (Juvenile Courts Panel)
Order 1963 is hereby amended by deleting from the Schedule
Mrs. Basil Burnside and substituting therefore Mrs. Cynthia L.
Bosfield.

Act (Chapter 10) are published for general information.

THE WATER AND SEWERAGE ACT
(Chapter 10)
In exercise of the powers conferred upon it by section 35 of
the Water and Sewerage Act (Chapter 10) the Public Board of
Works for New Providence with the approval of the Governor in
Council hereby makes the following Rules:
O.G. 1953 page 184B
1. These Rules may be cited as the Water Supply Amend-
ment Rules 1963 and shall be read as one with the Water Supply
Rules 1953 (hereinafter referred to as the principal Rules).
2. Paragraph (b) of rule 22 of the principal Rules is hereby
deleted and the following substituted therefore:
"(b) General Rates









For every 1,000 gallons of the first 13,000 gallons
per meter per quarter ...................... 8/-
For every 1,000 gallons or part thereof in excess
of 13,000 but not exceeding 26,000 per meter per
quarter ............................... 10/-
For every 1,000 gallons or part thereof in excess of
26,000 per meter per quarter .................. 14/-
And, in each case, a proportionate sum for
periods less than a quarter."
