The Customs Department Act (Chapter 27) is published for gen-
eral information.

ORDER IN COUNCIL
Made Under Section 9 of
THE CUSTOMS DEPARTMENT ACT
(Ch. 27)
In exercise of the powers conferred upon the Governor in
Council by section 9 of the Customs Department Act, the follow-
ing Order is hereby made:










1. This Order may be cited as the Customs Officers (Over-
time Remuneration) Order, 1960.
2. The rates at which officers of the Customs Department
whose services may be required beyond the hours of general at-
tendance shall be remunerated by the party requiring those ser-
vices and shall be those set out in the Schedule hereto.
3. The fees payable under this Order may be claimed by
the officer who performs the duty and by no one else.
4. The Customs Officers (Overtime Remuneration) Order
1948 as amended from time to time is hereby revoked.

SCHEDULE
PART I
BOARDING, ENTERING AND CLEARING SHIPS
OTHER THAN AIRCRAFT
1. To the Deputy Comptroller, Assistant Comptroller or any
other officers delegated by the Comptroller:
For entering and clearing a ship (or for either service if per-
formed singly the other not being required 1. 10. 0: provided
that should the service exceed one hour, an additional 12/- might
be charged for every hour or part of an hour in excess of the
first hour so occupied and provided also that when more than one
ship.belonging to the same owner is entered or cleared within
the same hour one fee only shall be payable without regard to
the number of ships of that owner so entered or cleared (i.e.
1. 10. 0. for the first hour and 12/- for every additional hour
or part thereof if the service should extend beyond one hour).
Sunday and Public Holidays,
(Except Christmas Day, Good Friday and Easter Day)
2. To the Deputy Comptroller, Assistant Comptroller or any
other officer delegated by the Comptroller:

vided that should the service exceed one hour an additional 6/-
might be charged for every hour or part of an hour in excess
of the first hour so occupied and provided also that when more
than one aircraft belonging to the same owner or owners is en-
tered or cleared within the same hour one fee only shall be pay-
able without regard to the number of aircraft of that owner so
entered or cleared i.e. 1. 0. 0. for the first hour and 6/- per
hour for every subsequent hour of service or part thereof up to
midnight. After midnight 1. 0. 0. may be charged for the first
hour of service or part thereof and thereafter 6/- per hour or
part thereof for planes of the same owner entered or cleared.

6. The fees payable for overtime on Christmas Day, Good
Friday and Easter Day shall be double the appropriate fee pay-
able on ordinary weekdays in connection with any service pro-
vided for in Party I, II and III of this Schedule.

Maximum Fees
7. The fees payable during any one calender month to any
officer in respect of any service provided for in the Schedule are
subject to a maximum calculated on the average rate of 60/- per
day on ordinary weekdays and 80/- per day on Sundays and pub-
lic holidays, except on Christmas Day, Good Friday and Easter
Day.

Calculation of Fees in Cases of Delay
8. In cases where officers have been required to do over-
time work and are in attendance at the required place and it has
not been found necessary to start the work at the time started
they shall be entitled to receive fees at the rate applicable to
the time during which they are actually in attendance.

Duplication of Duties
9. A Customs Officer performing the duties of an Immigra-
tion Officer in addition to those of his substantive appointment
shall not be entitled to claim in respect of such additional duties
any additional overtime pay under this Order.

Made Under
THE TRADE MARKS ACT
(Ch. 130)
In exercise of the powers conferred upon the Governor in
Council by section 53 of The Trade Marks Act the following
Rules are hereby made.
PRELIMINARY
1. These Rules may be cited as The Trade Marks Amend-
ment Rules 1960 and shall be read as one with The Trade Marks
Rules 1947 as amended from time to time (hereinafter referred
to as the principal Rules).
2. The principal Rules are hereby amended by:
(a) renumbering Rule 116 as Rule 131; and
(b) adding after Rule 115 the following Rules:
DEFENSIVE TRADE MARKS (Section 34A)
116. An application for the registration of a defensive trade Application

panied by a statement of case setting forth full particulars of
the facts on which the applicant relies in support of his applica-
tion, verified by a statutory declaration made by the applicant or
some other person approved for the purpose by the Registrar.
The applicant may send with this declaration, or subsequently,
such other evidence as he may desire to furnish, whether after
request made by the Registrar or otherwise, and the Registrar
shall consider the whole of the evidence before deciding on the
application. In all other respects, and where they are appropriate
and it is not otherwise stated, these Rules shall apply to such
applications as they apply to application for the registration of
ordinary trade marks.
APPLICATIONS TO THE REGISTRAR
FOR RECTIFICATION (Section 34A)
117. An application to the Registrar under section 34A for Application

be accompanied by an unstamped copy of the application and
a copy of the statement, and these copies will be transmitted
forthwith by the Registrar to the registered proprietor.

118. Upon such application being made, and copy thereof Further

Notification 125. The Registrar shall notify in writing applications un-

to intervene in the proceedings shall within one month of the
receipt of such notification give notice to the Registrar on Form
No. 45 to that effect and shall send therewith a statement of- the
grounds of his intervention. The Registrar shall thereupon send
copies of such notice and statement to the other parties, so that
the intervention may be known to the applicant, the registered
proprietor, the registered user whose registration is in suit, and
any other registered user who intervenes. Any such party may,
within such time or times as the Registrar may appoint, leave
evidence in support of his case, and the Registrar after giving
the parties an opportunity of being heard may accept or refuse
the application or accept it subject to any conditions, amend-
ments, modifications or limitations he may think right to impose.
Cancella- 126. In the case of the registration of a registered user for

the case of any of the goods in respect of which
the trade mark is registered, to certify those

(b) that the proprietor has failed to observe a pro-
vision of the deposited regulations to be ob-
served on his part;
(c) that it is no longer to the public advantage that
the trade mark should be registered; or
(d) that it is requisite for the public advantage
that, if the trade mark remains registered, the
regulations should be varied.
(3) An application under this Rule shall be made on
Form No. 48.
(4) The Registrar may as he sees fit on such an applica-
tion make an Order rectifying the register or the deposited regu-
lations, or both, as the case may be.
(5) These Rules shall apply to such applications as they
apply to applications under subsection (1) of section 10 of the said
Act."

Made Under
THE ROAD TRAFFIC ACT 1958

In exercise of the powers conferred upon them by the Road
Traffic Act 1958 the Road Traffic Authority with the approval of
the Governor in Council hereby make the following Regulations:

1. These Regulations may be cited as the Road Traffic
Amendment (No. 4) Regulations, 1960 and shall be read as one O.G. 1959
with the Road Traffic Regulations 1959 (hereinafter referred to as Page 587
the principal Regulations).

2. Sub-paragraph (ii) of paragraph (b) of sub-regulation (4)
of regulation 8 of the principal Regulations is hereby deleted
and the following substituted therefore:

"(ii) On East Street west side from outside the Tele-
