appointed Major H. C. Biggs to the post of
Regional Marketing Organiser for a provisional
peroid of two years on the staff of the Development
ani Welfare Organisation at Barbados.
Major Biggs, who was a member of the Fact
Finding Mission which recently reported on the
citrus industry, was formerly Commissioner of
Commerce and Industry under the Government
of Palestine, and has considerable commercial
experience in the marketing of agricultural produce.

the Inspector of Motor Vehicles at the New Fire
Station, Car'nage, St. Geojge's, in advance with
a view to effecting any alterations that may be
necessary to comply with the provisions of the
Motor Vehicles and Road Traffic Ordinance, 1938,
and of the Regulations made thereunder.
Vehicles must be presented in a thoroughly clean
condition, and must have been recently overhauled.
The body and wings, axle, chassis, frame, steer-
ing arms, springs, trackrods, brake connections,
shackles, bolts, nuts, split pins, engine, engine
shield and case, clutch, gearbox, magneto or coil,,
air filter, carburettor and all working parts must
be cleaned in order to admit of proper examination.
Dust covers, if used, must be removed before
presentation in order to admit of an examination
being made in full. All split pins etc., must be
clearly exposed, also chassis and engine numbers.
Drivers' seats must be securely fastened so that
the driver can have proper control over the vehicle.
Spot lights, musical horns nnd whistles are strictly
prohibited. Each vehicle must have its tare and
maximum gross weight painted in white figures not
less than 'j inches in height upon a black ground
in a conspicuous place on the right or off side of
the vehicle.
The registered Identification marks on all
vehicles must conform to provirons of Regulations
7, 8 and 9 and the Second Schedule to the Regula-
tions No. 35 of 1938, and be in such a condition as
to render each letter or figure readily distinguish-
able. The attention of owners of Motor and
Goods Vehicles is specially directed to Regulations
23 (II) (a) regarding the position of front lamps.
Spotlights will not be allowed except with the
written approval of the Licensing Authority.
The attention of owners of Hiring Cars and
Motor Omnibuses is directed to the Motor Vehicles
and Road Traffic (Amendment) Regulations, No. 6
of 1944, as amended by the Motor Vehicles and
Road Traffic (Amendment) No. 2 Regulations No.
70 of 1946, which requires that printed copies cf
the Tariffs of Maximum Fares to be displayed in
such Vehicles. Those are now available and may
be purchased at the Treasury, St. George's, and
at any District Revenue Office, at 4 cents per'
copy.
Vehicles which have been found by the Inspector
to have defects must not be used on the roads
until they have been issued with a Certificate,
certifying that the Vehicles may be duly licensed.

ONEY Orders issued in the United States of
America and in Canada (including Newfound-
land) and payable in Grenada shall be converted
at the following rates: -
(a) the face value of the United States and
Canadian dollar shall be regarded as equal to 4/2d.
sterling.
ib) when United States or Canadian funds are
at a Discount in terms of sterling, the Cclonial
Treasurer shall establish and declare tne rate of
exchange which will be fixed at the nearest i%
below the local bank buying rate for United States
drafts as the case may be.
(c) when United States or Canadian funds are
at a premium in terms of sterling, the Coloni il
Treasurer shall establish and declare the rate of
premium to be paid based on the local banks buy-
ing rate for United States drafts or (anadian
drafts as the case may be in accordance with the

of origin, such equivalent in sterling shall be paid
as indicated on the face of the Order by the
Exchange Office of the administration of origin,
or according to such information as shall be fur-
nished by the administration of origin and in
Default thereof as the Governor in Council may
prescribe.
The Postmaster shall keep himself constantly
informed of the local bank ra-es for buying or sell-
ing bills of exchange expressed in dollars drawn by
or payable in Canada (including Newfcundland)
and the United States of .\meric:. respectively and
shiill apply the rates of conversion as indicated in
these Regulations or as :::,y bn prescribe i from
itme to time or according to such instructions as
he may otherwise receive.
The Postmaster shall issue the necessary instruc-
tions for the conversion of Money Orders drawn in
dollars to the Money Order Offices in the Colony
ci' Grenada.
A Notice shall be exhibited in every Money
Order Office stating for tl.e information of tihe
public, the rates of conversion in respect of Money
Orders drawn in dollars.

NOTICE TO THE PUBLIC.


Loans for Agricultural Rehabilitation.


1. Further to a previous notice published on
the subject of the Agricultural Loans Scheme for
rehabilitation, the following announcement is made
for the information of agriculturalists.
The scheme to be initiated immediately is the
commencing stage of a wider scheme. The sum
of 100,000 at present available is to be used to
meet the needs of cultivators for the next few
weeks only. Further loans may become available
at a later stage. The loans now authorised will
be used primarily to meet the labour requirements
of cultivators but it is hoped that permission will
be got to give assistance also toward the purchase
of tools and manures and to effect temporary
repairs required to immediately essential estate
,buildings.
2. Applications must relate to expenses of the
replanting of permanent crops damaged by the
hurricane such as cocoa, nutmegs, coconuts,
bananas, citrus. A damaged cultivation in one
crop can be replaced by a cultivation of another
permanent crop of the type mentioned above.


3. This Scheme of assistance does NOT embrace
garden and root crops such as yams, potatoes,
tannias, bluggoes, etc. except in so far as these
are planted as shade for cccoa. Garden cultivators
have for weeks past been receiving help for
rehabilitation in the way of free planting materials
and the needy cases have also been receiving free
Food Tickets fortnightly.
4. The loans will be available to owners and
occupiers of land cultivated before the hurricane
whose cultivations w ere destroyed.
5. If you are the owner of the damaged
cultivation and it has a mortgage on it, it will be
necessary for your application form to be signed
by the encumbrancer. Hi- signature must te
witnessed.
6. If you are not the owner, hut an occupier,
your application must be signed by the owner
also. (It would be helpful if the ownei, whether
or not he is the applicant, would give particulars
of his title to the property.)
7. You can obtain application forms from the
office of the Areo r. committee nearest to you, or at
Agricultural Stations.
8. Application forms should Ibe prepared IN
DUPLICATE.
9. A group of Referees is being appointed for
your district. Your application form nust be
certified by two of these lieferees and the office
of the Area Committee will be glad to suggest to
you the names of two to wLom you may go with
ycur form when you are ready for the property
to be inspected. Tie referees should be persons
residing reasonably near to you, as that will bb to
your convenience and theirs.
10. It would be helpful if you will get into touch
with the nearest officer of the Agricultural Dspart-
ment in order that he can.assist yo; in arriving at.
the amount of money needed for rehabilitation of
your holding for the next four weeks. He willalso.
advise you on crops which you should plant and, if
necessary, help you to fill in the forms.
11. You should get in touch quickly with the
two Referees. If they are satisfied with the
application they will sign and return it to you.
You should then sign the form in the presence of a
Justice of the Peace or Magistrato and hand it in.
to ycur Area Committee office.
12. Very soon afterwards you will receive a former
stating the sum approved as a loan and the
purposes for which the loan must be used.
13. On receipt of this notification,, you should
then make immediate arrangements for the labour
necessary to get the work started, and commence;
the work qn the ground,
14. The method of putting you in funds will
enable you to pay your first and subsequent wage
bills. Particulars of the system and how you will
proceed to obtain the money will be published
shortly. The first step is to get your application
forms in as quickly as possible.

VACANT POST OF FOREST RANGER

A PPLICATIONS are invited for tho vacant post

ing allowance of $444 per annum. The :ppointee
will be required to keep a motor :yeyd and
Government wil be prepared to grnntl a loan,
repy'able in (5) five years, for the purchase.
2. The appointee will be required to work under
the supervision of the Forest supervisor who will
define his duties from time to time. Suh duties
will involve the general supervision of silvicultural,
nursery and field work, the sale of forest products,
the keeping of records, the supervision of the
subordinate, forestry staff, and regular inspections
of all forest areas in the island.
3. Applicants should have a good knowledge of
local timber and their uses. They should be
physically fit, of strong character and personality
and be intelligent and willing to learn. They
should have reached at least School Certificate
standard, or be a holder of the Certificate of
Agricultural Apprenticeship.
4. The appointee will be required to reside at
the Grand i~tang in the house provided for that
purpose.
5. Applications should be addressed to the
Secretary of the Public Service Commission,
Government Office, St. George's, Grenada, and
should be in the handwriting of the candidate.


Applicants must state age, schools attended and
standard or certificate obtained, experience, present
and past employment, emoluments of post in which
you are at present or last employed.

Judgment.

THE Appellant who was liable Lo be assessed
for Income Tax in respect of the year of assess-
ment 1953, under the provisions of the Income
Tax Ordinance Cap. 103 submitted a return
showing income under Head 'A' comprising
income derived from the letting of houses lands
or other properties within the colony, and under
Head 'B' comprising profits or gains from the
working of states or the occupation and culti-
vat;on of lands of every description. Later by
virtue of the provisions of Section 40 of the
Ordinance, an additional assessment was made
on the appellant under Head 'D' in respect of
profits alleged to have been made by him from
sales of land in 1952, on the ground that he was a
dealer o: trader in real estate. He objected to
this additional assessment ; the Commissioners
of Income Tax disallowed the objection, and
found that the frequency and number and manner
of his transactions showed that he was dealing
or trading in real estate. Against this determi-
nation he appealed to the Chief Justice under
Section 44 (1) of the Ordinance.
At the hearing of that appeal as set out in the
judgment, it was agreed by counsel that the sole
question for decision was, "whether the appellant,
in the circumstances, was liable to be assessed
under Head "D" as a trader or dealer in real
estate ; if he was, then the details of the actual
assessment, such as amount of receipts from sales
of land in 1952, permissible deductions etc.,
would be further considered by the Commissioners
on the production of further evidence by the

appellant". The appellant gave evidence in the
course of which he admitted having over a period
of years bought and sold lands and borrowed
various sums of money from time to time in
connection with the transactions. The Acting
Chief Justice came to the conclusion from the
facts and circumstances disclosed at the hearing,
that the appellant had been engaged in the business
of a trader in real estate, and dismissed the appeal.
The appellant has appealed to this Court under
Section 44 (10) which is as follows :-
"Any party dissatisfied with the decision of the
Chief Justice in point of law may appeal
from the same to the Court of Appeal
established by the Imperial West Indian
Court of Appeal Act, 1919".
Appeals confined to questions of law have come
before the Courts from time to time. In Edwards
(Inspector of Taxes) vs. Bairstow (1955) 3 W.R.L.
410 the question is fully considered Lord
Radcliffe in his speech at page 422 referred with
approval to the statement of ihe law as enunciated
by Warrington L. J. in Cooper vs. Stubbs (1925)
2 K.B. at page 768, that "intervention was proper
only in a very clear case, where either the Com-
missioners have come to their conclusion without
evidence which should support it, that is to say,
have come to a conclusion which on the evidence
no reasonable person could arrive at, or have
misdirected themselves in point of law". And
further in referring to Lord Normand's judgment
in the First Division of the Court of Session in
Inland Revenue Commissioners vs. Fraser, 24 Tax
cases 498 at page 501, he observed that the learned
Judge had said almost everything that needs to
be said on this branch of the subject. "in cases,"
he says, "where it is competent for a tribunal to
make findings in fact which are excluded from
review, the Appeal Court has always jurisdiction to
intervene if it appears either that the tribunal has
misunderstood the statutory language-because
a proper construction of the statutory language is
a matter of law-or that the tribunal has made a
finding for which there is no evidence or which is
inconsistent with the evidence and contradictory
of it". Lord Simonds in the Bairstow case at
page 418 said ; "such cases as Cooper vs. Stubbs
(1925) 2 K.B. 753 Jones vs. Leeming (1930) A.C. 415
and Inland Revenue Commissioners vs. Lysaght
(1928) A.C. 234 (a case of residence) amongst
many others are decisive. Yet it must be clear
that to say that such an inference is one of fact
postulates that the character of that which is
inferred is a matter of fact. To say that a tians-
actior is or is not an adventure in the nature of
trade is to say that it has or has not the character-
ristics which distinguish such an adventure. But
it is a question of law not of fact, what are those
characteristics, or, in other words, what the
statutory language means. It follows that the
inference can only be regarded as an inference of
fact if it is assumed that the tribunal which makes
it is rightly directed in law what the characteristics
are and that, I think, is the assumption that is
made. It is a question of law what is murder :
a jury finding as a fact that murder has been
committed has been directed on the law and acts
under that direction. The Commissioners making
an inference of fact that a transaction is or is not
an adventure in the nature of trade are assumed to
be similarly directed, and their finding thus becomes
an inference of fact".

Having regard to the principles enunciated
above the question before us now is adapting the
words of Macnaghten J. in Reynolds Executors vs.
Bennett (H.M. Inspector of Taxes) 25 Tax Cases
401 at page 406 whether there be any evidence
on which the learned Judge could reasonably
come to the conclusion to which he came. An
examination of the judgment under appeal clearly
shows that the learned Judge gave the fullest
consideration to the facts and kept before him
the correct principles of law to be applied. He
said "it is not possible to lay down definite lines
to make out what is a business or trade or
adventure and to define the distinctive character-
ristics of each. The facts in each case establish
the nature of the enterprise embarked upon.
And the point at which sales or assets resulting
in a profit are of such a number and nature as
to constitute a trade or business is a question of
degree and of fact."
The facts here disclose inter alia the following
transactions by the appellant.
(a) In 1945 he bought the Concord Estate
comprising 533 acres for the sum of
9,000, 113 acres thereof were sold in
separate parcels for a total sum of 7,675,
some of these sales being effected either
on the day of or soon after the purchase.
(b) In 1947 he bought the Stanhope Estate
comprising 432 acres for 7,500; he
began selling portions of this estate within
seven days of the purchase and sold 412
ac:cs for an aggregate sum of 9,188.
(c) Again in 1947 he bought Mount Nelson and
Crosby Hill estates comprising 72 acres
for 8,250 and between 1950 and 1952 he
sold 34 acres thereof in small parcels for
a sum totalling 19,050.
(d) In 1950 he bought Industry Estate com-
prising 233 acres for 15,000 ; he sold
between 1950 and 1952 117 acres thereof
in small parcels for a total sum of 16,730.
In connection with the above purchases the
appellant borrowed-
(i) ;n 1945 the sum of 5,000 from the Grenada
Co-operative Bank,


(ii) in 1946 the sum of 4,500 from Barclays
Bank.
(iii) in 1947, 7,150 from Barclays Bank,
(iv) in 1950, 5,000 from Barclays Bank.
To quote his own words "when I borrowed
money from the Bank I was given note on demand
for a short term (six months, nine months, one
year-as long as interest paid".
Between 1945 and 1952 he effected the sale of
thirty-three (33) different parcels of land varying
in size from one rood, 2 perches to 300 acres at a
price averaging from 22 an acre to 98 an
acre-sums largely in excess of the purchase price.
It was urged. before us by Counsel for the
appellant that the profits made from the sales
were in the nature of capital accretion and there-
fore not eligible to tax. With this contention
we cannot agree. The whole course of the
appellant's transactions, his method, organisation,
system of borrowing, buying and selling indicate
clearly that he was engaged in an adventure in the
nature of trade.
We have listened to a close and critical analysis
of the evidence and to the relevant authorities.
We are satisfied that there was ample evidence on
which the learned Judge could come to the con-
clusion which he did and indeed we do not see how
he could have reached any othei. It is clear that
the appellant was engaged in a trade and is liable
to be assessed under Head "D" as a trader or
dealer in real estate. The appeal is therefore
dismissed with costs.
