THE PENSIONS (AMENDMENT) ACT, 1962

The Pensions (Amendment) Act, 1962 10

AN ACT to amend the Pensions Act, 1958.
Be it enacted by the Queen's Most Excellent
Majesty, by and with the advice and consent of the Senate
and the House of Representatives of The West Indies, and
by the authority of the same, as follows:-
1. This Act may be cited as the Pensions (Amend-short
mnent) Act, 1962, and shall be read as one with the Pensionscop. 512.
Act, 1958, hereinafter referred to as the principal Act.
2. Section 2 of the principal Act is hereby amended Amendment
by the deletion of subsection (2) thereof and the substitution of the
therefore of the following- principal
"(2) (a) Subject to paragraph (b) of this subsection,
for the purposes of determining whether an officer is
eligible by length of service for pension, gratuity or
other allowance and of computing the amount
thereof, a continuous period of service in any of the
organizations to which this subsection applies which is
immediately followed by service in a pensionable office
in the public service of the Federation, or which is

immediately followed by a continuous period of service
in another such organisation and thereafter, without
break of service, by service in a pensionable office in
the public service of the Federation, shall, if the
Governor-General so directs, be taken-into account as
if it were service in a pensionable office in the public
service of the Federation.
(b) There shall not be taken into account in
computing the pension, gratuity or other allowance
of any officer any service in respect of which such
officer has received, or is otherwise entitled to receive,
a pension, gratuity or other allowance.
(c) This subsection applies to the following
(i) The Pre-Federal Organisation set up to
establish the Federation;
(ii) The Regional Economic Committee;
(iii) The Development and Welfare Organisa-
(iv) The British Caribbean Air Transport
(v) The British Caribbean Welfare Service;
(vi) The British Caribbean Students Unit.
(d) The Governor-General may by Order add to
the foregoing list of organizations and any such Order
shall be laid before each chamber of the Federal
Legislature and published in the Gazette.
(e) For the purposes of this subsection any
pension, gratuity or other allowance to which para-
graph (b) of this subsection applies, which has been
refunded by the officer shall be deemed not to have
been received by him."
