Present,

THE QUEEN'S MOST EXCELLENT MAJESTY
IN COUNCIL

Her Majesty, by virtue of the powers conferred upon Her by article 117
of the Constitution of the West Indies annexed to the West Indies
(Federation) Order in Council, 1957(a), and of all other powers
enabling Her in that behalf, is pleased, by and with the advide of
Her Privy Council, to order, and it is hereby ordered, as fbllows:-
1.-(1) This Order may be cited as the Constitutioi of the Wtlt Citation,
Indies (Amendment) Order in Council, 1962, and shall be cosfifm ied construction
as one with the Constitution of the West Indies, as amended by the and
Constitution of the West Indies (Amendment) Order in Council, 1959,publication.
the Constitution of the West Indies (Amendment) Order in Council,
1960 and the Constitution of the West Indies (Amendment No. 2)
Order in Council, 1960; and the Constitutilio of the West Indies,
as so amended, is hereinafter referred to as "the Constitution ".
(2) This Order shall be published in the Gazette.

2. Paragraph (1) of article 59 of the Constitution is aftenided by Amendment

3.-(1) The following paragraphs are substituted for paragraphs (1), Amendment
(2) and (3) of article 60 of the Constitution:- of article 60

"(1) In the exercise of his functions the Governor-General shall, Constitution.

with the advice of the Cabinet (or a Minister acting under the
general authority of the Cabinet).
(2) The Governor-General shall not be required to obtain the
advice of the Cabinet (or of the said Minister) in any case in
which, in his individual judgment, he considers it necessary or
expedient in the public interest that he should act before that
advice can be obtained; but in any such case he shall, as soon as
practicable, communicate to the Cabinet the measures that he has
adopted and the reasons therefore.
(3) When the Governor-General has, in pursuance of this article,
obtained the advice of the Cabinet (or of the said Minister) in
relation to any matter he may act otherwise than in accordance
with that advice if, in his individual judgment, he considers it
necessary or expedient in the public interest so to do:
Provided that he shall not so act without first obtaining the
approval of a Secretary of State unless, in his individual judgment,
the urgency of the matter requires him to act before such approval
could be obtained.

(3A) Paragraph (1) of this article shall not apply to the exercise
by the Governor-General of-
(a) any function which he is empowered (in whatever terms) to
perform on or in accordance with the recommendation or
advice of, or with the concurrence of, or after consultation
with, any person or authority other than the Cabinet; and
(b) any function which he is empowered (in whatever terms) to
perform in his discretion.".
(2) Paragraph (7) of article 60 of the Constitution is revoked.
Amendment 4.--(1) In paragraph (2) of article 92, article 92D and paragraph (1)
of articles of article 92E of the Constitution the words the Governor-General"
92, 92D and are substituted for the words the Minister responsible for finance ".
92E of the
Constitution. (2) References to the Minister responsible for finance in any law
of the Federal Legislature enacted in pursuance of paragraph (1) of
article 92E of the Constitution and in force immediately before the
date of this Order shall be construed as if they were references to
the Governor-General.

EXPLANATORY NOTE
(This Note is not part of the Order, but is intended to indicate
its general purport.)
This Order amends the Constitution of the West Indies with respect
to the extent to which the Governor-General is to act in accordance
with the advice of the Cabinet in the exercise of his functions and
so as to substitute references to the Governor-General for references
to the Minister responsible for finance in certain provisions dealing
with the authorisation and meeting of expenditure.
