APPOINTMENT OF COMMISSIONS BOARD-THE WEST INDIA REGIMENT

IT is hereby notified that pursuant to the provisions of section 7 of the Defence Act, 1958, His Excellency
the Acting Governor-General has been pleased to appoint the undermentioned to be members of a Commis-
sions Board:-
The Federal Defence Officer
The Commander West India Regiment
The Commander West Indian Navy
The Commanding Officer 1st Battalion West India Regiment
The Senior Administrative Staff Officer Federal Defence Force
The Senior General Staff Officer Federal Defence Force
The Officer-in-Charge of Recruiting West India Regiment

It is further notified that the notices establishing the Commissions Board and published in The West
Indies Gazette Vol. 2 No. 2, of 2nd January, 1959 and Vol. 2 No. 8, of 20th February, 1959 are hereby
cancelled.


RECRUITING OFFICERS-THE WEST INDIA REGIMENT


IT is hereby notified that under section 11 of the Defence Act (Ch. 101) His Excellency the Acting Governor-
General has authorised Captain W. S. R. HOWES, Officer in charge of the Montserrat Defence Force, to enlist
recruits in the West India Regiment in respect of the Territory of Montserrat during the period ending 31st
December, 1961,,,in the manner prescribed by the Defence (Enlistment and Service) Regulations, 1958,
Statutory Instruments No. 18 of 1958.

MR. GORDON JACK WEBSTER has been appointed on contract for a period of three years, as Chief Technical
Officer (Maritime Services) in the Federal Ministry of Communications and Works with effect from 12th
August, 1961.


VENEZUELAN CONSULAR REPRESENTATION


ADVICE has been received from the Seciretary of State for the Colonies that the Exequatur empowering
Dr. BERNABE PEREZ to act as Consul of Venezuela at Kingston, for Jamaica, received Her Majesty's signa-
ture on the 14th July, 1961.

His EXCELLENCY THE ACTING GOVERNOR-GENERAL has been pleased to accord provisional recognition

THE TRAVEL (EXEMPTION FROM FORMALITIES) (FORM
OF IDENTIFICATION) (AMENDMENT) REGULATIONS, 1961.

ARRANGEMENT OF REGULATIONS
Regulation
1. Citation.
2. Amendment of regulation 4 of principal Regulations.


His Excellency the Acting Governor-General in exercise of
the powers conferred on him by section 3(1) of the Travel (Exemption
Cap. 231. from Formalities) Act, 1958, and of all other powers him thereunto
enabling, hereby- makes the following Regulations:-

Citation. 1. -- These Regulations may be cited as the Travel (Exemption
from Formalities) (Form of Identification) (Amendment) Regulations,
1961, and shall be read as one with the Travel (Exemption from
Formalities) (Form of Identification) Regulations, 1959, hereinafter
referred to as the principal Regulations.

Amend- 2. Regulation 4 of the principal Regulations is hereby amended
ment of by substituting the words "Permanent Secretary, Prime Minister's
regulation Department" for the words "Federal Secretary" appearing therein.

REGULATIONS, 1961

SCHEDULE.

His Excellency the Acting Governor-General on the recom-
mendation of the Judicial and Legal Service Commission established by
S.I. the Windward Islands and Leeward Islands (Courts) Order in Council,
1959/2197. 1959, under section 27(2) of the said Order in Council and all other
powers him thereunto enabling hereby makes the following
regulations:-

Short title 1. (1) These Regulations may be cited as the Judicial and Legal

(2) These Regulations shall come into operation on the 1st day
of September, 1961.

Interpreta- 2. In these Regulations unless the context otherwise requires:-
tion. "the Commission" means the Judicial and Legal Service
Commission established by section 26 of the Order;
"Member" means member of the Commission;
"the Order" means the Windward Islands and Leeward
Islands (Courts) Order in Council, 1959;
"public office" means any offir'e of emolument in the public
service;
"public officer" means the holder of any public office and
includes any person appointed to act in any such office;
"the public service" means the service of the Crown in a
civil capacity in respect of the government of any of the
Colonies to which the Order applies;
"regulation" means one of these Regulations;

"the Supreme Court" means the Supreme Court of the
Windward Islands and Leeward Islands established by
section 3 of the Order.

3. The Chairman and other members shall on appointment takeOath of
an oath or make an affirmation before the Governor-General or theofi
Officer administering th.e Government in any one of the Colonies to
which the Order applies in the Form in the Schedule to these ,
Regulations.

4. (1) The Commission shall meet as often as may b? necessary Procedure
for the purpose of performing its functions and such meetings shall bean"
held at such places and at such times as the Chairman shall determine.

(2) The Chairman if present shall preside at meetings of the
Commission and in the absence of the Chairman from any meeting the
members' present shall elect one of their members to preside at that
meeting.

(3) All decisions at a meeting of the Commission shall be by a
majority of the votes of the members present and voting.

(4) The Chairman shall have an original vote, and in the event
of an equality of votes he shall have as well a casting vote.

5. Notwithstanding the provisions of regulation 4, decisions mayDecisions
also be made by the Commission without a meeting upon circulation of ther than
the relevant papers among the members; but if, on circulation of themeeting.
papers relating to any matter or question, a difference of opinion arises
among the members, or any member so requires, the matter or question
shall be reserved for discussion at a meeting.

6. (1) Minutes of all meetings of the Commission and of all decisionsEecord of

(2) Matters in the minutes which affect any Colony to which
the Order applies shall be forwarded to the Administrator of such
Colony on the direction of the Chairman.

(3) Any member who dissents from any decision may require that
his dissent and reasons for dissenting be recorded in the minutes.

Principles 8. (1) For the 1I1 "-,.': of making recommendations in relation to
election. appointments to vacancies in any offices the Commission shall (without
prejudice to its right to consider the application of any person whether
or not. already in the public service) consider the claims of all public
officers eligible for appointment or promotion may interview candidates
for such appointments and shall in respect of each candidate consider,
amongst others, the following matters-

(a) his qualifications;

(b) his general fitness;

(c) any previous employment of the candidate in public
service (including service in territories other than those
to which the Order applies) or in private practice.

(2) The procedure for making a recommendation in relation to an
acting appointment shall be the same as for making a. recommendation
in relation to a substantive appointment. Every recommendation by
the Commission in relation to an acting appointment shall state whether
or not. the public officer or other person recommended for the acting
appointment is in every way qualified to perform all the duties of the
office in which he is to act.

of the following functions of the Commission in relation to each of the
functions. Colonies of Dominica, Grenada, Saint Lucia and Saint Vincent:-

The functions of consulting with the Administrator in the
appointment of persons to act in the office of principal law
officer (by whatever name called) or in any other office in the
public service the power to make appointments to which vests
in the Administrator acting after consultation with the
Commission, during any period during which any such office
is vacant or the holder thereof is unable to perform the
functions thereof.

OATH (OR AFFIRMATION) OF OFFICE.

1, having been appointed (to act)
as Chairman/Member of the Judicial and Legal Service Commission, do
swear/solemnly and sincerely declare and affirm that I will freely and
without fear, favour, affection or ill will give my counsel and advice
to the Governor-General of The West Indies and to the Administrators
of the Windward Islands and Leeward Islands in connection with all
such matters a may be referred to the Judicial and Legal Service
Commission under the Windward Islands and Leeward Islands (Courts)
Order in Council, 1959, and that I will not directly or indirectly reveal
any such matters to any unauthorised person or otherwise than in the
course of duty.
