SCHEDULES.


His Excellency the Governor-General in exercise of the
powers conferred on him by section 18 of the Constitution of the West
Indies (Amendment) Order in Council, 1960, and section 5 of the
Constitution of the West Indies (Amendment No. 2) Order in Council,
1960, and of all other powers him thereunto enabling, hereby makes the
following Order:-

Citation. 1. This Order may be cited as the Adaptation of Existing Laws
Order, 1961.

Interpre- 2. .In this Order, "law" means a law of the Federal Legislature
station. and includes any instrument having the force of law made in exercise of
a power conferred by such law.

Adaptation 3. (1) Every law specified in the first column of the First Schedule
of laws in to this Order (being la law in force immediately prior to the 16th day
force of August, 1960) shall be read and construed subject to the adaptations
prior to 16th anidmodifications specified opposite thereto in the second column of the
August, said Scheduile. .
1960.
(2) Where:in any law in force immediately prior to the said
16th day of August, 1960, reference is made to the Council of State such
reference. shall be. construed as a reference to the Cabinet provided for
by article 59 of the, Gonstitution,as amended by the Constitution of the
.West Indies (Amendment) Order in Council, 1960, and references to
a ,member of the Council of State and to the Clerk to the Council shall
be construed respectively as references to a member ;of the Cabinet and
to the Secretary to the Cabinet.

(3) Every law referred to in this article shall be deemed to have
had effect as provided for in this article from the said 16th day of
August, 1960.








The Adaptation of Existing Laws Order, 1961.


4. (1) Every law specified in the first column iof the Second Sche-Adaptation
dule to this Order (being a law in force immediately prior to the 7thof laws in
force
day of December, 1960) shall be read and construed subject to theimmediately
adaptations and modifications specified opposite thereto in the secondprior to 7th
column of the said Schedule. December,
1960.
(2) Where in any law in force immediately prior to the said
7th day of December, 1960, it is provided that moneys are appropriated
from the public funds of the Federation and shall be paid therefrom on
the warrant of the Governor-General, such provision shall be construed
as if such moneys are charged on the Consolidated Fund.

(3) Every law referred to in this article shall be deemed to have
had effect as provided for in this article from the said 7th day of Decem-
ber, 1960.

In regulation 3(b), for the words "article
38(2)" substitute "article 38(3)".



Omit section 3 and the Second Schedule, and
in the First Schedule for the word "Couin-
cillor" substitute "counsellor".

The Audit and Civil Con-
tingencies Act, 1958 (Cap.
152)


(article 4(1))


In section 166(6)(b), for the words "public
funds of the Federation" substitute "Con-
solidated Fund".

Omit section 12 and for section 13 substitute
the following:-


"Contin-
gencies
Fund.


13. (1) The Minister responsible
for finance may establish a Contin-
gencies Fund for the purpose of
defraying urgent and unforeseen
expenditure and, subject to the
provisions of subsection (2) of this
section, all moneys required by the
Minister for the purposes of such
Fund are hereby charged on the
Consolidated Fund.

(2) The aggregate of all
moneys withdrawn from the Con-
solidated Fund for the purposes -of

subsection (1) of this section shall
not exceed the sum of two hundred
thousand dollars.

(3) If the Minister is satisfied
that -

(a) certain unforeseen expenditure
is likely to be incurred in a
financial year upon a service -

(i) thereby causing an excess
on the sum provided for
that service by the Appro-
priation Act for that year;
or

(ii) which being in respect of
a new service, was not pro-
vided for by the Appropria-
tion Act for that year; and

(b) the need for such expenditure
is urgent and cannot without
injury to the public interest be
postponed until adequate pro-
vision is made by the Federal
Legislature, the Minister may
authorise such expenditure to
be met by advances from the
Contingencies Fund.

(4) Where any advance is made
in accordance with subsection (3)
of this section a supplementary
estimate shall be presented and an
Appropriation Bill shall be intro-
duced as soon as possible for the
purpose of replacing in the Contin-
gencies F u n d the amount so
advanced."

The Interpretation Regu- In regulation 25(1) -
lations, 1958 (Cap. 291)
(a) insert immediately after subparagraph
(vii) the following new subparagraph
as subparagraph (viiA) -

"(viiA) "Consolidated Fund" means the
Consolidated Fund of the Federation;";


(b) in subparagraph (xxii) for the words

The Revision of Laws
Act, 1958 (Cap. 292)






The Exchange Control
Act, 1959 (Cap. 712)


"article 3" and "article 4" substitute
respectively "article 4" and "article
4A";

and in regulation 61, for the words "public
funds of the Federation" substitute "Con-
solidated Fund".

For section 15, substitute the following -

"Ex- 15. The expenses of and incidental
penses. to the carrying out of the provisions
of this Act shall be paid out of
moneys provided by the Federal
Legislature.".

In section 41, for the words "public funds
of the Federation" substitute "Consolidated
Fund".
