RECRUITING OFFICERS-THE WEST INDIA REGIMENT


IT is hereby notified that under Section 11 of the Defence Act (Ch. 101), His Excellency the Governor-General
has authorised Major J. SERRETTE, O.B.E., Garrison Quartermaster, St. James Barracks, Trinidad, to enlist
recruits in the West India Regiment in respect of the Territory of Trinidad and Tobago during the period from
the 1st day of January to the 31st day of December, 1961 inclusive, in the manner prescribed by the Defence
(Enlistment and Service) Regulations, 1958 (S.I. 18/1958).

OBJECTS AND REASONS

The object of this Bill is to confer corporate status
on the Minister of Finance for all purposes so that in his
corporate capacity, he may execute documents and take
proceedings and act generally in matters relating to the
Ministry of Finance on behalf of the Government of The
West Indies.

A Bill intituled

AN ACT to incorporate the Minister responsible for
Finance.

Be it enacted by The Queen's Most Excellent
Majesty, by and with the advice and consent of the Senate
and the House of Representatives of The West Indies, and by
the authority of the same, as follows:-
Short title. 1. This Act may be cited as the Minister of Finance
Incorporation Act, 1961.
Application 2. (1) This Act shall apply to the Cayman Islands and
to Cayman
Islands and the Turks and Caicos Islands.

and the Turks and Caicos Islands, come into operation on
such day as the Governor-General may appoint by pro-

Financial Secretary or of any person authorised by the
Minister to act in that behalf.
(2) The seal of the Minister shall be officially and
judicially noticed and every document purporting to be an
instrument made or issued by the Minister and to be sealed
with the seal of the Minister authenticated in the manner
provided by this section, or be signed by the Financial
Secretary or any person authorised as aforesaid, shall be
received in evidence and be deemed to be so made or issued
without further proof, unless the contrary is shown.

(3) A certificate signed by the Minister that any
instrument purporting to be made or issued by him was so
made or issued shall be conclusive evidence of that fact.

OBJECTS AND REASONS

The object of this Bill is to amend the definition of
public service so as to safeguard the superannuation rights
of officers transferred to or from the service of countries,
such as Ghana, which upon independence became a republic
but remained within the Commonwealth, and also so as to
effect certain other minor changes in the form of the
definition.

AN ACT to amend the Pensions Act, 1958.

Be it enacted by The Queen's Most Excellent Majesty,
by and with the advice and consent of the Senate and the
House of Representatives of The West Indies, and by the
authority of the same, as follows:-

Short title. 1. This Act may be cited as the Pensions (Amend-
cap. 512. ment) Act, 1961 and shall be read as one with the Pensions
Act, 1958 (hereinafter called the principal Act).

(2) This Act shall, in relation to the Cayman Islands
and the Turks and Caicos Islands, come into operation on such
day as the Governor-General may appoint by proclamation

Telecommunications Administration;

(c) service which is pensionable-

(i) under the Oversea Superannuation
Scheme;

(ii) under any Acts relating to the super-
annuation of teachers in the United
Kingdom;

(iii) under a local authority in the United
Kingdom; or

(iv) under the National Health Service of the
United Kingdom;

(d) any other service that the Governor-General
acting after consultation with the Secretary
of State may determine to be public service
for the purpose of any provision of this Act;
and

(e) except for the purpoess of computation of a
pension or gratuity and of section 9 of this
Act, service in respect of which a pension may
be granted under the Governor's Pensions
Act, 1957.

THE EXCHANGE CONTROL (AMENDMENT) BILL

OBJECTS AND REASONS

The object of this Bill is to amend the Exchange
Control Act, 1959 (Cap. 712) in two respects. In view of the
uncertainty surrounding the future constitutional relation-
ship of the Cayman Islands to the Federation, it seeks to
replace section 1 (3) of the Act by a provision which will
enable the Act to be applied to the Cayman Islands, and its
application terminated, with effect from such dates as may
be determined.

The Bill also seeks to introduce -a new provision
designed to regulate real estate transactions involving non-
residents in order to avoid foreign exchange losses that
might take place through compensatory deals and other
similar devices.

AN ACT to amend the Exchange Control Act, 1959.

Be it enacted by the Queen's Most Excellent Majesty,
by and with the advice and consent of the Senate and the
House of Representatives of The West Indies, and by the
authority of the same, as follows:-

short title. 1. (1) This Act may be cited as the Exchange Control
(Amendment) Act, 1961 and shall be read as one with the
Exchange Control Act, 1959, hereinafter referred to as the
principal Act.

(2) This Act shall apply to the Cayman Islands and the
Turks and Caicos Islands.

Amendment 2. Section 1 of the principal Act is amended by the

(a) declare that this Act shall apply to the Terri-
tories of the Turks and Caicos Islands or the
Cayman Islands with effect from such date as

applied to the Cayman Islands under para-

Territory with effect from such date as shall
be specified in the proclamation".

3. The principal Act is hereby amended by the"of new

"Restriction 32A.(1) Except with the consent of the Authority

the scheduled territories; or

(b) for any person resident outside the
scheduled territories, or any person acting
on behalf of any person so resident, to
transfer, convey or do any act forming part
of a series of acts calculated to result in the
transfer or conveyance by way of sale,
exchange, gift or mortgage of any land,
buildings or other hereditaments situate
in the Federation or any instrument, or
certificate of title relating thereto, to any
person wherever resident; or

(c) for any person wherever resident to pur-
chase or agree to purchase or to accept a
transfer or conveyance by way of sale,
exchange, gift or mortgage of any land,
buildings or other hereditaments situate
in the Federation from any person resident
outside the scheduled territories or any
person acting on his behalf, or to pay any
money to any other person in consideration
for, or in connection or association with,
any such transfer or conveyance.

(2) Subsections (2) and (3) of section 21 of
this Act shall apply in relation to a transfer or
conveyance prohibited by this section as they apply
in relation to a transfer prohibited by this Act of a
security."
