The Federal Supreme Court (Appeals from the Virgin Islands) Rules,
1961 are published below for general information.

THE FEDERAL SUPREME COURT (APPEALS FROM
THE VIRGIN ISLANDS) RULES, 1961.

Rules made by the Chief Justice and two other Judges of the
Federal Supreme Court under Section 7 of the Virgin Islands (Appeals)
Order in Council, 1957.

SCHEDULE.


The Chief Justice and two other Judges of the Federal
Supreme Court, selected by him, in exercise of the powers conferred
upon them by Section 7 of the Virgin Islands (Appeals) Order in Council,
1957, and of all other powers enabling them in that behalf, hereby make
the following Rules:-
Citation. 1. These Rules may be cited as "The Federal Supreme Court
(Appeals from the Virgin Islands) Rules, 1961", and shall come into
operation upon the date of the publication of these Rules in the Official
Gazette of The West Indies.

Interpreta- 2. In these Rules unless the context otherwise requires -

"the Colony" means the Colony of the Virgin Islands;

"The Federal Supreme Court (Appeal) Rules" means the
Cap. 2. Federal Supreme Court (Appeal) Rules, 1959, made by the
Chief Justice of The West Indies and two Judges of the
Federal Supreme Court under the Federal Supreme Court
Regulations, 1958, and under Articles 85 and 110 of the
Constitution of The West Indies, and any Rules amending,
adding to, or substituted for, the same;

"the Regulations" means the Federal Supreme Court
Cap. 1. Regulations, 1958, made by the Governor-General under
Section 2 of the West Indies (Federation) Order in Council,
1957.

3. Subject to the provisions of these Rules, the practice andApplication
procedure of the Federal Supreme Court in the exercise of its appellate of the
Federal
jurisdiction conferred on ,it under Her Majesty's Virgin Islands supreme
(Appeals) Order in Council, 1957, and under any law of the Federalcourt
Legislature enacted pursuant to Section 3 of such Order in Council shall (Appeal)
be regulated, with all necessary adaptations, by the Federal Supreme Rules,1959.
Court (Appeal) Rules.

4. In the application of the Federal Supreme Court (Appeal)Modifica-
Rules to appeals from the Colony application
of rule 3.
(a) references to "Territory" shall be construed as including
references to the Colony;

(b) references to "the Territory from which the appeal is
brought" or "the Territory in which each appeal arose"
shall be construed as references to the Colony;

(c) references to the "Governor" of a Territory shall be
construed to include references to the Administrator of
the Colony;

(d) references to the "Attorney General" shall be deemed
references to the principal law officer of the Colony (by
whatever name called);

(e) "legal representative" shall mean any barrister, advocate,
solicitor, attorney or legal practitioner admitted to
practise as such in the Colony or in any part of the
Federation whether or not he has the right of audience
in the Court.

5. The Forms contained in the Schedule hereto, with such Forms for
v reception,
variations and additions as the circumstances of the particular case may detention
require, or forms to the like effect, may be used in the cases to which and return
they respectively apply, and shall be deemed good, valid, and sufficient. of prisoners
from the
Virgin
Islands.
