THE FEDERAL SUPREME COURT (VIRGIN
ISLANDS APPEALS) (AMENDMENT) BILL


OBJECTS AND REASONS

The object of this Bill is to delete paragraph (a) of
section 2(3) of the Federal Supreme Court (Virgin Islands
Appeals) Act, 1958, which provides that for the purposes of
that Act references in Part III of the Federal Supreme Court
Regulations, 1958 (Cap. 1) to the Attorney General of a
Territory shall mean the Attorney General of the Leeward
Islands. This amendment is consequential on the substitu-
tion, by clause 6 of the Federal Supreme Court Regulations
(Amendment) Bill, of a new definition for that of Attorney
General in regulation 20 of the Federal Supreme Court
Regulations, 1958, made necessary by the abolition of the
offices of Attorney General of the Leeward Islands and
Attorney General of the Windward Islands as from 1st
January, 1960.

A BILL intituled

AN ACT to amend the Federal Supreme Court (Virgin
Islands Appeals) Act, 1958.

Be it enacted by the Queen's Most Excellent Majesty,
by and with the advice and consent of the Senate and the
House of Representatives of The West Indies, and by the
authority of the same, as follows:-

Short title. 1. This Act may be cited as the Federal Supreme
Court (Virgin Islands Appeals) (Amendment) Act, 1960, and
shall be read as one with the Federal Supreme Court (Virgin
cap. 5. Islands Appeals) Act, 1958, hereinafter referred to as the
principal Act.

Amendment 2. Subsection (3) of section 2 of the principal Act is
of section 2
of principal hereby amended-
Act.
(a) by deleting paragraph (a) thereof; and

(b) by relettering paragraphs (b) and (c) thereof
as paragraphs (a) and (b) respectively.

OBJECTS AND REASONS

The object of this Bill is to amend the Federal Supreme
Court Regulations, 1958 (Cap. 1) in certain minor respects,
the most important of which are the insertion of provisions
for an Assistant Registrar and for the qualifications required
for appointment as Registrar or Assistant Registrar, and the
substitution of a new definition for that of Attorney General
consequent on the abolition of the offices of Attorney General
of the Windward Islands and Attorney General of the
Leeward Islands.

A BILL intituled

AN ACT to amend the Federal Supreme Court
Regulations, 1958.

Be it enacted by the Queen's Most Excellent Majesty,
by and with the advice and consent of the Senate and the
House of Representatives of The West Indies, and by the
authority of the same, as follows:-

of the Registrar except where otherwise
provided by Rules of Court; and".

Amendment 5. Paragraph (4) of regulation 15 of the principal

"(b) No appeal shall lie under this regulation
from a decision of the Full Court of a
Territory upon appeal from any order such as
is referred to in subparagraph (g) of para-
graph (2) of this regulation, made by a judge
of a superior court of that Territory, except
with the leave of the Full Court of the Federal
Supreme Court.

(c) No appeal shall in any case, other than that
referred to in subparagraph (b) of this para-
graph, lie under this regulation from any
order such as is referred to in subparagraph
(g) of paragraph (2) of this regulation made
by a Full Court or a judge of a superior court
of ,a Territory except with the leave of the
Full Court or judge making the order or the
Federal Supreme Court.

(d) In this paragraph, the expression "law" means
any order of Her Majesty in Council or an
order made thereunder or any law of the
Federal Legislature or of the Legislature of
a Territory."
