1. Citation. This Order may be
cited as the Aid to Pioneer Industries
(Manufacture of Candy) Order, 1958.

2. Manufacture of Candy de-
clared a Pioneer Industry. The
manufacture of candy is hereby de-

The Queen's Most Excellent Majesty in Council

Her Majesty. by virtue of the powers conferred on Her by section 3
I' of the Leeward Islands Act, 1956(a). and all other powers enabling
Her in that. behalf. is pleas-.d, by and with the advice of Her Privy
Council, to order, and it is hereby ordered, as follows:-

1. This Order may be cited as the Leeward Islands (Emergency Citation
Powers) Order in Council, 1958.

Sf 2.--(1) In this Order the expression "the Governor" means the nlabrpeita-
Governor and Coinmander-in-Chief of the Leeward Islanda and tlna.
Sinoluoles any person for the time being discharging the functions of
,'f that office by virtue of the provisions of article 4 of the Leeward
lilanids Letters Patent, 1956, and exceptt in subsection (4) of the
next following section) any person appointed to he a Deputy to the
Governor nnler article 5 of those Letters Patent.

(2) The colonies to which this Order applies are the colonies of
Antigua. Saint Christopher Nevis anil Anguilllit, MAntserrat and the
Virgin Islands.

I'he Governor may. during a period of emergency in any

each of the Colonies in such manner as the Governor shall think fit.

1. This Ordinance myv be cited as the Fire short tie.
Brigades Ordinance, 1957.
2. In this Ordinance unless the context Interprets
otherwise requires- tion.
Brigade means n Fire Brigade established
under section 3 of this Ordinance;
"Town means the Town of Plymouth;
Commissioner means the Commissioner of
Police;
"fire engines includes all vehicles, tools,
iiimphrnents, nose or hose-pipes, appli-
anccs arnd apparatus necessaryy I'or the
maintenance of an efficient tire brigade;
"owner" includes occupier or tenant.

consist of such persons residing within the limits

8. When nany Brigade shall consist wholly
or in part of the police officers the Conm issioner
may, with the approval of the Gdovernor .appoint
as many policp'officers to such Brigade as he may
from time to time think fit.

9. (1) Every police officer stationed in the
Colony may he trained in -the;dhtie. in Connection
with a Brig:de and shall be liable for service in
any Brigade at any time or in any place within the
Colony.

(2) On every occasion oF, fire every police
officer shall, if lawfully commanded so to do, act as
if he were a member of the Brigade:

10. (1) On every oce:~ion of a fire the
operations o'f a Brigade shall be directed by the
senior officer of the Brigade.

(2) The order of seibiority of the officers of a
Brigade shall be as follows--

(a) t'he Commissioner or other Ga:atted
Police Ullicer, where the Brigade has, under
the provisions of section 6 ofthis Ordinance,
been placed under his command;

(b) the Fire Officer;

(,) the Captain of the Volunteer Brigade
or other senior volunteer oillcer;

(d) die.other volunteer officers in order
of seniority;

(r) the senior' Inspector or subordinate
police officer attached tr the Brigade.

16. (1) The ,Goiernor'in Council may innke Ponrkta

sions of this Ordinance and without prejudice to
such general power may make regulatinns-

(a) prescribing the requirement for the
admission of members into a Brigade, the
periods of service and of training, and the
discipline, good conduct and discharge of the
members of a Brigade;


(b) prescribing the uniform to be worn
by, the hours and places of training and
exercise of, and the distribution of duties
S among the members of a Brigade;


(c) prescribing the services required of
S members of a Brigade and the manner of their
performance of such services;

(d) prescribing the classification and
rank, and promotion and reduction in rank of
the volunteer members of a Brigade;

(s) for the speedy attendance of members
-of a Brigade with fire engines on the occasion
of any alarm of fire;

(df) for the maintenance of a Brigade in
a due state of efficiency;

(.y) in relation to the insurance of the
lives of the volunteer or paid members of a
Brigade;

(h) in relation to the compensation pay-
nble to any volunteer or paid member of a
Brigade in the evilt of his being injured
while on duty, or to his legal personal repre-
sentative in tht event of his death from subh
injury;

(i) in relation -to the gratuities and
rewards pnyable to any member. of a Brigade
for extraordinary, and meritorious services
performed by hini on the occasion of u fire;

of enquiry into breaches of any regulations

Penaltimuor (2) Every member of a Brigade who commits
breach of
egulaon. a breach of any regulation referred to in parnigruph
S(J) of subsection (1) of this section shall-
(a) if a volunteer member, be liable, on
conviction before the Captain or other senior
volunteer officer, subject to an appeal to the
Governor, to a penalty not exceeding twenty-
four dollars or to dismissal from the Brigade;
and
(b) if a paid member. be liable, on con-
viction before the Fire Officer, subject to an
appeal to the Governor, to a penalty not
exceeding twenty-four dollars or to a recorm-
mendation by the Fire Officer to the Gover.

(3) Where a member of a Brigade is a police
officer-
(a) he may be tried for a breach of any
regulation made under subsection (1) of this
section before the Fire Officer, and in such
case, he shall be liable, on conviction before
such Fire Officer and confirmed by the Com-
missioner, subject to an appeal to the Gover-
nor, to a penalty not exceeding twenty-four
dollars; or
(b) if the said breach is an offence to
. which the provisions of any regulations for
securing proper discipline in the police Force
continued in force by virtue of section 6M of
i3l/si. the Police Act, 1951, or made under section 67
of the said Act, are applicable as well as the
provisions of any regulations made under sub-
section (1) of this section, and the Commie-
sioner requires, or such police officer elects,
that he be tried in accordance with the
provisions of section 33 of the Police Act, 1951,
he shall be liable on conviction, to any of the
punishments prescribed in subsetion (1) of
the said section 33 for offences for breach of
any disciplinary regulations made under the
said Act, and in that case the provisions of









section 34 of the said Act (which relates to
appeals) shall apply to any such conviction of
such police officer as if such breach were a
breach of the aforesaid disciplinary regulations:
Provided that a police officer who is a
member of a Brigade shall not be liable to be
tried more than once in respect of the same
offence.
(4) Every appeal to the Governor under the
provisions of paragraph (a) or (b) of sub.
section (2) of'this section or paragraph (a) of
subsection (3) of this section shall be in
writing and the Governor, after considering
the appeal and the notes of evidence and
statements and other documents submitted to
or required by him in relation to such appeal,
shall either-
(a) allow the appeal; or
(b) dismiss the appeal; or
(c) vary the punishment by subsituting
such greater or less punishment as might have
been awarded in respect of the offence.
(5) All fines inflicted under paragraphs (a) or
(b) of subsection (2) of this section or paragraph
(a) of subsection 3 of this section shall be paid into
the Public Treasuary aRnl if not paid within four.
teen days shall be recoverable sumimarily a civil
debt under the Magistrate's Code of procedure
Act-
(a) as regards fines inflicted under
paragraph (a) of the said subsection (2),
by the Captain or other senior volunteer
officer or other officer deputed in that
behalf by the Captain or other senior
volunteer officer; and
(b) as regards fines inflicted under
paragraph (6) of the said subsection (2)
or paragraph (a) of the said subsection
(3), by the Fire Officer.
17. Every person who- offneme.

officer or member of a Brigade while acting in
the execution of his duty;

under the authority of this Ordifiance;

(d) not being a member of a Brigade,
wears the uniform of a.Brigade at any fire;

(e) obstructs the use of any fire plug or
hydrant, by placing or causing to be placed
thereon or thereby any matter or thing what-
soever, or in any other manner whatsoever;

(f) wilfully damages. or injures any fire
engine, fire plug, hydrant, fire alarm, or any
other apparatus of a Brigade;

() without the authority of an officer
of a Brigade or of a police officer or of the
owner of a building on fire or in danger of
fire removes or is concerned in removing any
furniture or goods 'from. any such building;

(A) gives or causes to be given in any
manner whatsoever to a Brigade any false
alarm of a fire without good reason;
shall be guilty of an offence against this Ordi.
nance and shall be liable on summary convic-
tion -to a fine not exceeding one hundred
dollars or to a term of imprisonment not
exceeding three months,

18. The Fire Brigade Ordinance, 1930; is

on such day as the Governor may. appoint by

be shown, the Court is satisfied
from the deeds or other documents
accompanying the request that the
applicant has the right to claim
the land as owner and that he
himself has been in undisturbed
possession of the same continuously
du ing the period of twelve years
next before the date of the presen-
tation of the request under this
Act;

(c) if the applicant has, by
descent or by will or deed, acquired
a title to the land from a person
who would have been entitled
himself to have the land registered
in accordance with the provisions
of paragraph (6) of this subsection;

(d) if the land has been in the
sole and undisturbed possession of
the applicant alone in his own
right or as executor, administrator
or trustee, or partly in the sole
and undisturbed possession of the
applicant in any such right and
partly in tlhe sole and Iundisturbed
possn ision of any other person
through whom he claims, contin-
uously for a period of thirty years
next before the date of the presen-
tation of the request under this
Act.

(2) The application to bring
land under this Part of this Act shall
be made by thL owner who shall
present a request to the Registrar of
Titles for the issue to him of a first
certificate in respect of the land
described in the request.

(3) Where the owners of the
land are joint tenants, tenants in
ucmmon or coparceners, the request
shall bhi made in the names of, and
shall he signed by, all of them.

(1.) The request shall be in Form
1 in the Second Schedule and shall
I 1 accompanied at the time of presen-
t;ition by all the titles. deeds or
other documents under which the
applicant claims to be the owner of
the land.

(5) Forthwith upon the presen-
tation of the request, the Registrar
(f' Titles shall tlereupon proceed to
give public information of such
application by exhibiting on the door
of the Court House and in public
im tices throughout the Colony a
copy of tLhe Schedule of applications
in Form 3 in the Second Schedule,
and no sucl certificate shall he
isnsuid until the expiration of four
weeks from thio date of exhibiting
the schedule.

(6) The applicant shall also
within seven days after the presen-
tation or the request cause notice of
the application to Iw served person-
ally upon all Owners or occupiers of
land adjoining the land for which a

An Ordinance to provide for the services of the
Colony -of the Virgin Islands for the year
ending on the thirty-first day of December,
1958.
[1st January, 1958.]
ENACTED by the Legislature of the Colony
of the Virgin Islands.
1. This Ordinance may be cited as the
Appropriation Ordinmnce, 1958.
2. There shall be and there is hereby granted
to Her Majesty the Queen for the services of the
Colony of the Virgin Islands for the yenr
ending on the thirty-first day of December, 1958,
the sum of eight hundred and ninety-four thousand,
seven hundred and eight dollars, over and above
the sum granted and provided under the Acts and
Ordinances in force in the Colony to be applied and
expended in the manner and for the services set
forth in the Schedule thereto.
3. The said sum of eight hundred and ninety-
four thousand, seven hundred and eight dollars
shall be and the Raime is hereby declared to be
charged upon and made payable from and out of
the General Revenue and other funds of the
said Colony.
4. The Treasurer of the said Colony is
hereby nuthorised and required from time to time
upon the order or warrant of the Governor to pay
the several sums appropriated by and in the said
Schedule to the several services therein mentioned,
as the said order or warrant shall direct, out of the
General Revenue and other funds of the said
Colony without further order or formality,

Article I of the Leeward Islands Letters Patent, 1958, passed
under the Great Seal of the Realm on the 8th day of May,
1958. I, ALEXANDER THOMAS WILLIAMS, a Knight Comman-
der of the Most Distinguished Order of Saint Michael and
Saint George. a l ember of the Most Excellent Order of the
British EI'pire, Governor and Commander in Chief in and over
tle Liewa\ard Islinds undl Vice Admiral of the sane, do hereby
ord'-r and proclaim that the Suid Letters Patent shall oome into
operation in the Colony of Antigua on the ltith day of June,
1958.

BY THE GOVERNOR UNDER REGULATIONS 6 AND S OF TIL
DEFENCE (FINANCE) REGULATIONS, 1942, AS HAVING
EFFECT BY VIR-TU OF THE SUPPLIES AND SERVICES
(TRANSITIONAL POWEIIS) ACT, 1945 (IMPERIAL) THE
SUPPLIES AND SERVICES (TRANSITIONAL POWERS).
(COLONIES, ETC.) ORDER IN COUNCIL, 1946 (IMPERIAL)
TIE SUPPLIES AND SERVICES (TRANSITIONAL POWERS)
ORDER, 1946, AND THE SUPPLIES AND SERVICES (CONTIN-
UANANCK) ORDER, 1957 (IMPERIAL).


1. Citation. This Order may be cited as the Impor-
tation and Exportation of Notes (Exemption) (Amendment)
Order, 1958, Ian shall be read as one with tile I[mportatiio
and Exporraciun of Notes (Exemption) Order, 1952 (Leeward
Islands S.R.& 0. 1952 No. 22) us amended, hereinafter called
the Principal Order.
2. Amendment.. (1) Sub-paragraph (1) of para-
graph 2 of the Principal Order is hereby amended-
(u) by deleting the word "and occurring arter
the words issued in the Colony, ";
(b) by deleting the words without any limitation
as to iinount, "; Ind
(c) by deleting the words to an amount not
exceeding ten pounds sterling in value ".
(2) Snb-paragraph (2) of paragraph 2 of the Principal
Order is hereby amended-
(a) by deleting the comma occurring after the
the words "issued in the Colony and inserting the
word "and immediately thereafter;

(b) by deleting the comma and the word and"
occurring after the words legil tender in the Colony "
and by substituting therefore the words to an amount
not exceeding ten pounds sterling in value, and in
addition thereto "; and

(r) by substituting the words and foreign cur-
rency notes to such amount that the sum of such notes
does not exceed in total t wanty-five pounds sterling in
value or the amount brought by such person into the
Colony whichever is the greater" for all the words
occurring between the words or in any part thereof"
and the colon occurring immediately before the proviso to
the sub-paragraph.

WHEREAS by section 16 of the Cotton Marketing
Ordinance, 1955 (No. 6 of 1955) it is provided that the said
Ordinance shall come into operation on a day to be appointed by
the Governor by Proclamation published in the Gazette.

NOW, THEREFORE, I, ARTHUR FRANCJS )AWKINS,
Administrator of the Colony of Montserrat, dc. by this my
Proclamation declare that the said Ordinance shall come into
operation on the first day "f Septmnher, 1958.

And all Her Majosty'-s Offirers and loving sutjects in the
Colony of Montserrat antl all others whmrn it mity cirncern are
hereby required to take due notice hereof and give their ready
obedience accordingly.
