1963, made by the Adminis-
trator under section 3 (1) of the Aid to
Pioneer Industries Ordinance, 1950 (No. 9
of 1950).

1. SHORT TITLE. 'this Order Order may be
cited as the Aid to Pioneer Industries (Manufacture
of Cans and Containers) Order, 1963.
2. MANUFACTURE OF CANS AND CONTAINERS
DECLARED A PIONEER INDUSTRY. The Manufacture
of cans and containers is hereby declared to be a
pioneer industry for the purposes of the Aid to
Pioneer Industries Ordinance, 1950, and the follow-
ing products are hereby declared to be pioneer
products for the said purposes:-
Metal and Plastic Cans and Containers.

Made by the Administrator acting in accordance
with the advice of the Executive Council this
day of 1963.

1. SHORT TITLE. This Order may be cited
as the Aid to Pioneer Industries (Canning) Order,
1963.
2. CANNING DECLARED A PIONEER INDUSTRY.
Canning is hereby declared to be a pioneer indus-
try for the purposes of the Aid to Pioneer Indus-
tries Ordinance, 19!50, and the following products
are hereby declared to be pioneer products for the
said purposes:-
Canned solid and liquid substances for Com-
mercial purposes.
Made by the Administrator acting in accord-
ance with the advice of the Executive Council this
dav of 1963.

The appellant, in this case, was sued on a bond
executed for $4,056 (B.W.I.) under which the
appellant 11i lertook to pay weekly sums of one
dollar for each of six chiildr.t in whose favour
maintenance orders were ::a; in the M.agistrate's
Court against the appella.i s son. The payments
fell in arrears and th bi-ind ,e.:nae !i.blie to
forfeiture for the am i;i s-ated reini. The
respondent instead of suinTg Oir tht' am lnt stated
in the bond sued for foinv ,ioilars, the arrears of
weekly payments then due. There was no provi-
sion in the conditions set out i!i th: bond for suing
in that manner, the bond bAin__. liable to forfeiture
if the conditions as to w, .kly payments \vere not
met.

evidence, not to contradict the written
instrument but to show the real contract

In the instant case there is no ambiguity in the
bond and the intention of the parties is clear.
Chitty on Contracts at p:ie 169 states clearly the


principle to be applied here. It is as follows-
Parol evidence will not be admitted to
prove some particular term, which had
been orally agreed upon, had been
omitted, (by design or otherwise) from a
written instrument constituting ; valid
and operative contract betw, en the
parties."

the intention of the parties."
In our opinion, the evidence admitted at the
trial sh',,wi:2 the intention of the par:-ies was

that th.' i) nd lwas uien-nforceable failed.

respondent could not sue for small sums represent-
ing weekly airears of payments but must sue for

Counsel for respondent submitted that the
condition in the bond was the part properly
enforceable :n I since this wns ,o ricspondent could

bond is a contract and when there is a breach the
forfeiture clause operates as there is no provision
.aip. iw.iing thl: forfeiture ti allow the respondent
to sie on arrears for weekly payments. If the
respondent intended to sue in this manner then that
provision should have been made a term of the
contract.
To sue for weekly payments as they fell in
arrears would, in opinion, be to split one cause of
action in many. The appeal is accordingly allowed.
