TENDERS


Tenders are' hereby invited for the
transport by motor-car of public offi-
cers travelling on duty for the year
ending 31st December, 1962.

2. Such tenders should in the
respect of single journey from the
place where the public officer enters
the car to the place at which he leaves


it (i.e. so much a mile for the single
journey) and charge for waiting, if
any, should he stated. 1'rovided that
where the officer enters or leaves the
car outside the city limits a charge
may be made for the distance be-
tween that point and St. John's.
3. Government will rnot ,e pre-
cluded from hiring seats for public
officers in Public service. vehicles
which would otherwise be proceed-
ing to the officer's destination where
this will result in any econonn e.g.
for customs officers going to Coolidge
Airfield on duty in a car hired or used
by the Airline Agents.

4. Government reserv-s the right
to hire or use cars, or seats in cars,
other than the contractor's curs, for
public officers proceeding on citiess
connected with the Customs or
revenue.

5. Government does not hind it-
self to accept the lowest or any tender.

6. The contractor will be expected
to provide prompt and efficient Ser-
vice and any agreement entered into
with a contractor will be subject to
the following conditions:

(i) The Contractor shall when-
ever required furnish a oar.

(ii) If due notice of the require-
inent of a car has been given
and failing any satisfactory
explanation the Contractors'
car arrives more than five
minutes after the required
time, Government shall have
the right to deduct a penalty
not exceeding $2.40 from
any of the sums due and
owing to the Contractor.

(iii) In the event of the Contrac-
tor's car being more than 15
minutes later after the
required time, Government
may cancel the contract on
giving the Contractor one
week's notice in writing.

(iv) Government shall also have
the right to terminate the
contract on giving one week's
notice in writing if the ser-
vice is generally unreliable
through repeated unpunctu-
ality, defective cars or other
cause.

7. The Tenders should state the
number of cars to be at the disposal
of Government.

8. All tenders should be addressed
to the Minister for Public Works &
Communications in a sealed envelope
marked "Tender for Official Trans-
port" and should be lodged at the
Administration Building not later
than 4.00 p.m. on Thursday, 30th
November, 1961.

An Ordinance to provide for the licensing of
persons who carry out the electric wiring of
buildings, the regulation of such operations,
and generally the prevention or minimising of
danger to persons or property which may arise
from the electric wiring of buildings.

ENACTED by the Legislature of the Colony
of the Virgin Islands.
1. This Ordinance may be cited as the Elec. short title.
trick Installations (Buildings) Ordinance, 1961.
2. (1) In this Ordinance- Interpretation.
"licensed wireman" means a person
who is the holder of a valid
licence as such issued to him
under the provisions of this
Ordinance;
"licence includes a duplicate licence.
(2) For the purposes of this Ordinance a per-
son shall be deemed to act as a wireman who, on
any occasion, installs, fixes, repairs, alters, replaces,
connects, disconnects or removes the whole or any
part of the electric wiring of any building not being
the wiring of any telephone or radio-diffusion ser-
vice or a lightning conductor or the wiring (includ-
ing the earthing) of any wireless aerial:
Provided that a person shall not be deemed to
act as a wireman by reason only of the fact that he
manipulates a switch, or connects or disconnects a
plug, or replaces or installs a lamp in a socket, or
replaces a fuse so long as such replacement is in

conformity with the relevant provisions of any
rules in force by virtue of section 10.
Appointment of 8. The Administrator may by notification
Licensing published in the Gazette, appoint one or more
Authority. persons to be the Licensing Authority for the pur-
poses of this Ordinance.
Licences. 4. (1) It shall be lawful for the Licensing
Authority to grant a licence to act as a wireman to
any person who-
(a) makes application therefore in the
prescribed manner to the Licensing Authority;
and
(b) satisfies the Licensing Authority that
he is qualified as hereafter provided to receive
such licence; and
(c) is not less than 18 years of age; and
(d) pays the prescribed fee.
(2) Every such licence to act as a wireman
shall be in the prescribed form and shall have
attached thereto one of two recent photographs of
the holder thereof which shall be supplied to the
Licensing A thority by the applicant for a licence
when making his application; and every such licence
shall be valid for a period of five years from the
date on which it is granted unless sooner cancelled
as hereinafter provided.
(3) If, within fifteen days from the expiry of
any such licence, the holder thereof makes applica-
tion in the prescribed manner for a new licence, he
shall be deemed to be still a licensed wireman until
he is served with a notice to the effect that a new
licence has been refused by the Licensing Authority.
Qualifoations 5. Any person shall be qualified to receive a
for lioences. licence to act as a wireman who-

(a) satisfies the Licensing Authority by
written examination or otherwise both as to his
practical and theoretical knowledge of the
electrical wiring of any building; or

(b) is in possession of a certificate to the
effect that he has received outside the Colony
training which in the opinion of the licensing
Authority qualifies him to act as a wireman; or

(c) is in possession of a certificate or un-
expired licence granted by any competent
authority in any territory outside the Colony; or
(d) has previously held a licence to act as
a wireman issued under this Ordinance; or
(e) satisfies the Licensing Authority that
he has been practising as a wireman in the
Colony for two years immediately preceding
the commencement of this Ordinance provided
he applies for a licence within six months
from the commencement of this Ordinance:
Provided however that the holder of any certi-
ficate or licence under paragraphs (b) or (c) of this
section may be required to satisfy the Licensing
Authority as to his knowledge as provided by
paragraph (a) of this section.


6. The Licensing'Authority mny, on pay-
ment of the prescribed fee, issue a duplicate of any
unexpired licence as a wirenman which is proved to
his satisfaction to have been lost or destroyed and
which has not been cancelled.
7. (1) It shall be lawful for the Licensing
Authority to refuse to issue a licence under this
Ordinance, or to cancel licence held by a licensed
wireman, if it is established to his satisfaction, after
giving the applicant or licensee an opportunity of
being heard, that the applicant, or licensee-
(a) is prevented from acting efficiently
as a wireman by infirmity of mind or body; or
(b) has been convicted of an offence
involving dishonesty which he committed in
the course of acting as a wireman; or
(c) has been convicted of any offence
against this Ordinance or the rules there-
under; or

(d) has been guilty of gross negligence
or inefficiency in the course of acting as a
wireman; or
(e) has previously been refused a licence
under this Ordinance, or has previously had
his licence cancelled on any'grounds specified
in this section.
(2) Whenever the Licensing Authority refuses
to issue a licence or cancels a licence he shall cause
notice of such refusal or cancellation to be served
on the applicant or licensee, as the case may be,
either personally or by letter addressed to him it
his usual or last known place of abode.
(3) Whenever notice of cancellation of a licence
shall have been served in accordance with subsec-
tion (2) of this section, it shall be the duty of the
licensee forthwith to surrender his licence to the
Licensing Authority and, if any licensee shall fail
in this obligation he shall be liable on summary
conviction to a fine not exceeding fifteen dollars in
the currency of the United States of America.
(4) The refusal of a Licensing Authority to
issue a licence and the cancellation of a licence by
the Licensing Authority shall be subject to appeal
to the Administrator in Council whose decision
shall be final.

fence against this Ordinance who-
(a) in any application for a licence under
this Ordinane, makes any statement which is
materially false, or tenders in support of any
such application any certificate or licence which
does not relate to him or which is false in any
material particular; or
(b) not being a licensed wireman or a
person working under the direct and continuous
supervision of a licensed wireman acts as a wire-
man or offers directly or indirectly so to act; or
(i) ermpoys. to act as a wireman any per-
son who is not a licensed wireman and who
does not work under the direct and continuous
supervision of a licensed wireman and whom he
either knows not to be a licensed wireman or
has no reason to believe to be a licensed wire-

(d) being a licensed wireman, lends his
licence, or makes the use of his licence available,
to any other person; or
(e) borrowed, or uses as his own, a licence
not granted to him under this Ordinance.
(2) Any person guilty of an offence by virtue
of this section shall be liable on summary conviction
therefore to a tine of thirty-five dollars in the cur-
rency of the United States of America or to
imprisonment for a term not exceeding one month,
and on a second or subsequent conviction to a fine
of sixty dollars in the currency of the United States
of America or to imprisonment for a term not
exceeding three months, or to both such fine and
imprisonment.
9. Any person who refuses to produce his Duty to
licence as a wireman for inspection on demand by pf~od1
a the Licensing Authority, or by a police officer, or by
a person to whom he has offered or is giving his
services as a wireman, or by a person to whom he is
employed or is about to be employed as a wireman,
shall be guilty of an offence and shall be liable on
summary conviction to a fine not exceeding fifteen
dollars in the currency of the United States of
America:
Provided that if within forty-eight hours after
the production of his licence was so demanded the
holder himself produces the licence to the person
demanding it, or at the office of the Licensing
Authority, where the demand was made by the
Licensing Authority, or at such Police Station as
may be specified by him at the time the production
of the licence was demanded, where the demand was
made by a police officer, he shall not be convicted
under this section.
10. (1) 'I'he Administrator in Council may Power to
make rules for carrying out the purposes of this makes rules.
Ordinance and, in particular and without prejudice
to the generality of this power, such rules may make
provision for-
(a) prescribing any matters authorized by
this Ordinance to be prescribed; and

(b) regulating the performance of their
duties by persons acting as wiremen; and

(c) prescribing the measures to be taken
to prevent or minimise danger to persons or
property which may arise from electric wiring
of buildings or the manner of installing, fixing,
wiring, repairing, altering, replacing, connect-
ing, disconnecting, or removing the same; and

(d) prescribing a penalty on summary
conviction not exceeding a fine of thirty-five
dollars in the currency of the United States of
America or to imprisonment for a term not
exceeding three months for breaches or con-
contraventions of any such rule.

(2) Rules made under this section shall not
have effect until confirmed by resolution of the
Legislative Council.

(3) The rules in the Schedule hereto shall be
deemed to have been made and confirmed in accord-
ance with this section.
(4) Rules under paragraphs (b), (c) and (d)
of subsection (1) of this section may be made to
apply throughout the Colony or to specified areas.of
the Colony, and shall have effect notwithstanding
anything to the contrary in any law.

THE SCHEDULE

1. These Rules may be cited as the Electric
Installations (Wiremen's Licences and Fees) Rules.
2. In these rules the expression "the Ordi-
nance means the Electric Installations (Buildings)
Ordinance, 1961.
3. Application for licences under the Ordi-
nance shall be in the appropriate form in Schedule
A hereto and shall be accompanied by the certificate
or previous licence (unless surrendered on cancella-
tion) on which the applicant bases his claim to be
qualified under section 6 of the Ordinance.
Such certificate shall be returned by the
Licensing Authority to the applicant when or before
the licence is granted or refused as the case may be
and such previous licence shall be so returned if it
has not expired.
4. Licences under the Ordinance shall be in
the appropriate form in Schedule A hereto.
5. The fees to be taken for things done under
the Ordinance shall be in accordance with Schedule
B hereto.

Regulations, 1960, made by the Administrator in
Council under section 103(f) of the Virgin Islands
Constitution and Elections Ordinance, 1954 (No. 7 of
19 54), as amended,


1. CITATION. These Regulatiols may be cited as the Legisla.
tive Council (Remuneration of Election Officers) Regulations, 1960,
2, INTERPRETATION. In these regulations-
"the Ordinance" means the Virgin Islands Constitution and
Elections Ordinance, 1954, as amended.
"(U.S.)" means in the currency of the United States of
America.
3. RATES OF PAY. The following amounts shall be paid to
election officers for their services in the performance of such duties as
may be assigned to them under the Ordinance:-


(a) To the Supervisor of Elections
(b) (i) To every registering officer
for each name entered on a
preliminary list
(ii) To every registering officer
for compiling preliminary list
in alphabetical order for every

4. TRAVELLING. For travelling in connection with an elec-
tion, election officer shall be paid at the rate prescribed for public
officers by any Travelling Allowance Regulations in force.

5. REVOOATION. The Legislative Conncil (Remuneration of
Election Officer Regulations. 1957 (S. R. & 0. 1957, No. 19) are hereby
revoked.

an institution for the purposes of the said Ordinance:

THE MOTOR VEHICLES (AMENDMENT) REGULATIONS, 1961,
DATED 17TH MAY, 1961 MADE BY THE ADMINISTRATOR IN
COUNCIL UNDER SECTION 43 OF THE VEHICLES AND ROAD
TRAFFIC ORDINANCE, 1954.

1. CITATION. These Regulations may be cited as the
Motor Vehicles (Amendment) Regulations, 1961, and shall be
read as one with the Motor Vehicles Regulations, 1956
(S. R. & 0. 1955, No. 3) as amended, hereinafter called the
Principal Regulations.
2. AMENDMENT OF REGULATION 2 OF THE
PRINCIPAL REGULATIONS. Regulation 2 of the Princi-
pal Regulations is hereby amended by the substitution of the
following for the definition of the word "Ordinance":-
Ordinance" means the Vehicles and Road Traffic
Ordinance, 1954;'
3. AMENDMENT OF REGULATION 23 OF THE
PRINCIPAL REGULATIONS. Regulation 23 of the Prin-
cipal Regulations is hereby amended by the substitution of the
following for paragraph (2) thereof:-
"(2) OVERALL WIDTH AND LENGTH.
The motor vehicle, not being a motor cycle, does not
exceed seven feet in overall width or twenty-two feet
in overall length or such greater width or length as
the Commission in its discretion may allow."
4. AMENDMENT OF FORM 3 OF THE FIRST
SCHEDULE TO THE PRINCIPAL REGULATIONS.
Form 3 of the First Schedule to the Principal Regulations is
hereby amended as follows:-
(a) by substituting the following Item 9 in the said
Form:-
"9. MAXIMUM LOAD
(b) by adding the following Item as Item 10;-
