An Ordinance to control the Development of certain
lands in the Colony.
[24th October, 1961] Commenoe-
mnient.
Be it enacted by the Queen's Most Excellent
Majesty, by and with the advice and consent of the
Legislative Council of Antigua, and by the authori-
ty of the same as follows:-
1. This Ordinance may be cited as the Land short title.
Development (Control) Ordinance, 1961.
2. In this Ordinance unless the context Interpreta-
otherwise requires- tion.
agricultural purposes includes all purposes
directly connected with the use of land as
arable, meadow or pasture land, or or-
chard, or for market gardens, or for raising
stock or poultry;
"the Minister" means the member of the
Executive Council for the time being
charged with the responsibility for the
subject of Lands.

ANTIGUA. 2 Land Development (Control) No. 7 of 1961.
dicenc to 3. (1) Subject to the provisions of subsection
(2) of this section, from and after the date of the
coming into operation of this Ordinance no person
shall commence to construct any building upon any
land, or subdivide or otherwise develop any land
for building purposes, except under and in accord-
ance with the terms of a licence granted for the
purpose by the Administrator in Council.
(2) The foregoing provisions of this section
shall not apply to lainds being used or developed
solely for agricultural purposes.
(3) Any person who contravenes the fore-
going provisions of this section shall be guilty of
an offence and shall be liable on summary convic-
tion to a fine not exceeding two hundred and fifty
dollars, and in lie case of a continuing offence to a
further fine not exceeding twenty-five dollars for
every day during which the offence is continued.

Appointment 4. (1) The Administrator may appoint either
Inspe tors. temporarily or permanently Inplectors whose duty
it shall be to ascer'taii whether the provisions of this
Ordinance or the terms of any licence issued there-
under are being oscrved, and to report thereon to
the Minister.

(2) Every such Inspector shall be furnished
with a letter of appointment under the hand of the
Administrator and if so required, an Inspector shall
produce his letter of appointment to the occupier or
person in charge of any premises or lands which he
inspects.

(3) Any such letter of appointment purporting
to be signed by the Administrator shall be accepted
in all Courts of ,law as primajfacie evidence of the
appointment until the contrary is proved.

(4) An Inspector shall, for the purpose of
carrying out his duties under this Ordinance, have
power to enter (vith such assistants or workmen as
he may deem necessary)-at all reasonable times any
premises or lands, and to carry out thereon such
examination and inquiry as may be necessary for
the performance of his duties under this Ordinance.








No.'7 of 1961. Land Development (Control) 3 ANTIGUA.

5. (1) The Minister may with the approval power to
of the Administrator in Council make Regulations ~mak Regula-
prescribing-
(a) the form of application to be submitted
for the grant of a licence under this Ordinance;
and
(b) the form of such licence.
(2) The form of application may require the
applicant to give information with regard to the
construction of any, proposed building and the use
to which it will be put, and the nature of any other
development which he intends to undertake.
(3) Any applicant who wilfully fails to supply
any information as may be required of him when
submitting his application or refuses to answerpor
fails to answer truthfully any further question which
may be addressed to him in writing on behalf of the
Administrator in Council in connection with the
subject matter of his application, shall be guilty of
an offence and shall be liable on summary conviction
to a fine not exceeding fifty dollars.

6. Any person who wilfully hinders or as- Assaulting of
saults an Inspector appointed inder this Ordinance Inipeotors
in the lawful execution of his duty shall be guilty
of an offence, and shall be liable on summary con-
viction to a fine not exceeding one hundred dollars.

7. The Administrator in Council may by Exemption
Order declare that any land, buildings or type of
buildings shall be exempt from all or any of the
provisions of this Ordinance.
