The Queen's Most Excellent Majesty in Council

Her Majesty, by virtue and in exercise of Her powers under the
Leeward Islands Act, 1956(a). the Dominica Act, 1938(b), and of all
othi.r powers enabling Her in that behalf, is pleased, by and with
the advice of Her Privy Council, to order, and it is hereby ordered
as follows:-

1. (1) This Ordtr may be citod as the Leeward Islands and Citation. con-
Windward Islands (Courts) (Amendment) Order in Council, 1957, struction and

(3) This Order shall come into force on the 3rd day of January,

2 Subsection (1) of section 2 of the Leeward Islands and Amendment
Windward Islands (Courts) Order in Council, 1939(d) (hereinafter of Section 2
referred to as the principal Order" is hereby amended by the de.pincipal
insertion after the definition of Chief Justice of the following
new definition, that is to say:-

'the Federal Supreome Court' means the Federal Supreme
Court established by the Constitution of the West Indies(e); "

14A. (1) Notwithstanding anything contained in
section 13 or section 14 of this Order or in any
Order made under subsection (2) of section 14 of
this Order, the Court of Appeal shall not have juris-
diction to hear and determine an appeal from the
Supreme Court in any case in which such jurisdic-
tion is exercisable by the Federal Supreme Court to
the exclusion of the Court of Appeal by virtue of
any law made under the Constitution of the West
Indies or under the Virgin Islands (Appeals) Order
in Council, 1957(f).

(2) References in this section to jurisdiction to-
hear and determine an appeal from the Supreme
Court shall be construed as including references to
jurisdiction to hear and determine a question of law
reserved or a case stated by that Court."

This Order amends the Leeward Islands and Windward Islands (Courts)
Order in Council, 1939, so as to provi le-
(a) that the Supreme Court of ihe Windward Islands and Leeward
Islands shall not have original jurisdiction in any case ili which exclusive
original jurisdiction is exercisable by the Federal Supreme Court estab-
lished by the Constitution of the West Indies; and

(b) that the Court of Appeal for the Windward Islands and LeUward
Islands shall not have jurisdiction to hear an appeal from the Supreme
Court in any case in which exclusive jurisdiction to hear such an appeal
is exercisable by the Federal Supreme Court.

THE ADAPTATION OF LAWS (ELECTIONS TO THE HOUSE OF REPRESENTA-
TIVES OF THE WEST INDIES) REGULATIONS, 1957, DATED DECEMBER
31, 1957, MADE BY THE GOVERtNO(R UNDER PARAGRAPH (1) OF
ARTICLE 107 OF THE CONSTITUTION OF THE WEST INDIES.



1. Short Title. These Regulations may be cited as the
Adaptation of Laws (Elections to the House of Representatives of The
West Indies) Regulations, 1957.

2. Interpretation. In these Regulations-

the expression House means the House of Representa-
tives of The West Indies;

the expression "the Ordinance" means the Montserrat
Constitution and Elections Ordinance, 1932, as in
force on the date of the coming into force of these
Regulations.

3. Modifications of Election Laws. In so far as the
Ordinance governs elections to the House it shall apply subject to the
modifications and adaptations specified in the Schedule to these Regula-
tions.

SCHEDULE.


Section. Modification and Adaptation.

PART I.

2 (a) The definitions of the following expressions shall not
have effect-
"Council ", Deputy President ", "electoral
district ", the Executive Council", list of voters ",
meeting ", minister of religion ", public office ",
"public officer ", public service ", revising officer ",
"session and sitting ";
(b) The following definition, which shall be inserted
immediately after the definition of the expression
Administrator ", shall have effect-
deputy returning officer" means an officer
appointed by the Administrator in that behalf under
section 39 of this Ordinance;

(c) In the definition of the expression election in place
of the word Council the word House" shall
have effect;
(d) In the definition of the expression election officer"
in place of the words "a returning officer, every
presiding officer" the words "the returning officer,
every deputy returning officer, presiding officer"
shall have effect;
(e) The following definition, which shall be inserted
immediately after the definition of the expression
"Governor ", shall have effect-
"member" includes alternate member for the
Colony;
(') The following definition, which shall be inserted
immediately after the definition of the expression
"polling day ", shall have effect-
"polling division" means any polling division
constituted in accordance with the provisions
of section 37 of this Ordinance;

returning officer and every deputy returning
officer shall take and subscribe respectively the
oaths in the Forms set out as Forms Nos.

shall transmit such oaths to the Supervisor of
Elections."

75 (8) In place of these provisions the following provisions
shall have effect-
"Equality of 75 (8) (a) Subject to the provisions of
votes. paragraph (b) of this subsection, wherever
there is an equaltiy of votes between two or
more candidates and the addition of a vote
would entitle one of such candidates to be
declared elected as the member or as the alter-
nate member for the Colony, the returning
officer shall forthwith decide between those
candidates by lot and proceed as if the candi-
date on whom the lot falls had received an
additional vote.
(b) Whenever at an election for which
two members are to be returned there is an
equality of votes between three or more
candidates and the addition of a v ,te would
entitle one of such candidates to be declared
elected as the member for the Colony, the
returning officer shall select one of such
candidates by lot and the candidate on whom
the lot falls shall be declared the member for
the Colony, and immediately thereafter the
returning officer shall select one of the re-
mainder of such candidates by lot, and the
candidate on whom the lot falls slihll be
declared the alternate member for the Colony."

3. The voter shall then fold the ballot
paper so that the initials of the presiding officer
and the numbers on the counterfoil can be seen
and the counterfoil detached without opening
the ballot paper; he shall then return the ballot
paper so folded to the presiding officer who shall
in full view of those present including the voter
remove the counterfoil and place the ballot paper
in the ballot box. The voter shall then forthwith
quit the polling station.
4. If the voter inadvertently spoils a ballot
paper, he can return it to the presiding officer
who will, if satisfied of such inadvertence, give
him another paper.
5. If the voter places any mark on the
paper by which he may afterwards be identified
or if-
(i) at a general election he votes for
more than two candidates, or
(ii) at a by-election for which two
members are to be returned and
only two candidates have been nom-
inated he votes for more than one
candidate, or
(iii) at any other by-election he votes
