$)uring the session of legislature of 1901, Hon. Hudson Burr introduced in the House of Representatives a bill fixing railroad fates at .V

three cents per mile in this State. The bill was properly referred to the Committee on Railroads and Telegraphs where after
hearing evidence and careful consideration, the committee reported the bill back to the house. "That it do not pass When the bill
came up on its second reading the Chairman of the Committee moved to indefinitely postpone the bill, as was the custom for the Chairman
of any committee to do when the committee's report was against the passage of the bill. He stated among other things that the
railroad Commission was at that very time considering the advisability of fixing the rate at three cents per mile. That the railroad Commission
did not wish the legislature to interfere and further stated that if the rate was fixed at 3 cents.the ore thousand mile book which
was then sold at 125.00 could be sold for 30.00, and further stated that the Committee had reason to believe that if the rate was
fixed at three cents per mile by statute law an effort would be made to repeal the law. creating the railroad commission on the grounds,
that as the law had fixed the rate the commission would have nothing to dVith this report from the House Committer. who had
made the investigation, and other information before me I took the position that the railroad commission would fix the rate at three
cents when it would stand the test of the courts as the l".5.Supreme Court had long since decided that all quasi corporations was entitled
to a reasonable interest on their investment, and. not knowing what the investment receipts( or expenses were I preferred to leave it
with the people? who did know and who had been elected for that purpose. so voted against the bill. When the bill came up in the Senate
a bigmaJo..it)' of the Senators evidently thought as I did, as the bill was indefinitely postponed by a vote of iS to 10. enatur Carson of
Osceola County who I am sure had as much to do with creating the Railroad Commission as any other man. and whose father-in-law.
Hon. J. :M. Bryan was a commissioner at that time voted against the bill and I am sure he did so because he thought it should Ix lett
to the commission and that he had reason to believe the commission was then considering the question. In Senate Journal
page 099.
Senator Baker of the 20th district (and a more honorable man never lived ) gives i this explanat on of this vote
"Mr. President: My position on such questions as this is a muter of record: and well known to all I have helped to enact into .
law a measure that delegates full power to a Commission elected by the people whose duty it is to pass upon all such questions. I leave
the responsibilit with the commission, and shall vote to indefinitely postpone the bill. "

As further evidence that .m)' position was the correct one. we find the rate was afterwards fixed at three cents and mileage
books kept at two and one half cents.I .

I regret very much to be forced into a newspaper controversy but as some few political agitators and curbstone politicians seem to
have nothing do but walk the streets and endeavor to array one class' of citizens against another and are endeavoring; to injure me in
my race for Representative I have written the above but I promise not to pan)- further attention to them.

If any man wants to know my position either in the past or at present upon any public matter. I will ;gladly tell him. but I ask
them not to take the statement of my political enemies.
