minuation of Sancti Spiritus. Mr. Rainmn Verdura y
Santoya. has been granted a leave of absence on a'-

a. lawyer, it is proIper, in accordance with the prov-
isions of Article 37 of the Compilation of Organic
Provisions for the Administration of Justice and
Order No. 30. of 1902. to designate an Acting Judge
having such qualifications;
Therefore. on the reconllnenidation of the Acting

The proceedings instituted upon the applica-tion
for pardon in the case hereianufter mentioned, includ-
ing the report of the trial court, having been exam-
ined, and,
Whereas the reasons which appear in said pro-
ceedings. as stated below, justify the extension of
clemency,
On the recommendation of the A'cting Head of
the Department of Justice 'and upon the request in
writing of the injured party,

I RESOLVE:

To grant a total pardon to
Mantel Bacna Franco,
remitting the unexecuted portion of 'the penalty im-
posed upon him by the Audiencia of Havana, in
April 10th, l.st in cause No. 695. 1907, of the Cen-
tral Court taking into consideration the cilurrm-
stances attending the tlomnission of the offense.

Havana, October 14th. 1908.

Upon the recommendation of the Acting Secre-
tary of Government, the resolution adopted by the
Executive Commnittee of the Central Board of Chari-
ties accepting the resignation tendered by Dr. Gu-
briel Casuso as member of the "Junta de Patronos"
of Hospital Number One, by reason of the fact that
he had been appointed Dean of the Faculty of Me-
dicine, which fact makes it necessary for him to
'become la member of "Mercedes" Hospital Junta
de Patronos, and the appointment of Dr. Enrique
Porto as his substitute, is hereby approved.

to be exhausted.
On the recommendation of the Acting Seere-
tary of l'ublic Works,

I IHAVE REROTLVED:

That the sum of thirty eight thousand dolars
($38.000) l.e and the same is hereby appropriated
from any funds in the Treasury not otherwise ap-
propriated. for the construction of the above men-
tioned road. which shall he placed at the disposal of
the Department of Public Works. provided that
payments to he made from this appropriation shail
not exceed the sum of Twelve Thoisand Dollars
($12.000) in any month.

DECREE NO. 1008.
Havana, October 16th, 1908.

I, Charles E. Magoon, by virtue of the powers
vested in me as Provisional Governor, hereby

ORDER AND DECREE:

Article 1.

Decree No. 882, current series, is hereby amend-
ed by striking out the words "Ootober 15th" in
Artieli(cs 1 and 3 and substituting thcrefoar the words
"Octolbr 18thi".
Article 2.

From October 16th to October 18th. 1908. both
(lays inclusive. Municipal Judges ,as Keepers of the
Civil Reg-isters, shall give 'precedence to such peti-
tions for inscription in the Seotion of Citizenship of
the Civil Register as are supported by certificates
issued by the Department of State and bearing date
on or before October 15th, 1908.

Article 3.

Municipal Judges as Keepers of the Civil Re-
gisters, shall at once forward to the proper Muni-
cipall Electoral Boards. certified copies of all ins-










criptions made from the 11th to the 15th days of Oc-
tober, 1!)08, both inclusive in the Section of Citi-
zenship of the Civi'l Register, and shall from October
16th to October 18th, 1908, both inclusiive, forward
without delay to the proper Municipal Electoral
Boards .like certified copies of such inscriptions as
may, during said period, be made in the Section of
Citizenship of the Civil Register upon tile basis of
certificates issued by 1he Department of State on or
before October 15th.

Article 4.

The execution of Article 5, Decree No. 838,
current series, is susliended until October 19th,
upon which datla said article shall be carried into
execution. In carrying said article into execution,
Municiipall Electoral Boards will take into considera-
tion and give fu'I1 force and effect to all certified
copies of inscriptions in the Sr'etimo of citizenshipp
of the Civil Register transmitted to said boards
under the provisions of this Decree.

Article 5.

This Decree shall become effective on October
16th, 1908.

sional de Cuba,


ORDENO Y DECRETO:

Articulo 1.

El Deereto n6mero 882, de la series corriente.
queda por el present modificado en el sentido do
sustituir las palabras "15 de Octubre", que apare-
cen en los articulos 1 y 3 por las dde "18 de Oc-
til)re".

Articulo 2.

Del 16 al 18 de Oetubre de 1908, ambas feehas
inclusive, los Jueces Municipales Encargados del Re-
gistro Civil, darn preferencia A las solicitud.es para
inscri'pei6n en 'la Secei6n de Cinda-dania del Registro
Civil que se basaren en certifieaciones expedidas por
el Departamento de Estado con feeha 15 de Octulro,
de 1!08. 6 anterior.







Articulo 3.


Las Jueces Municipales Encargados ,del Regis-
tro Civil enviarAn inmedi-atamenite A las Juntas Mu-
nici'pales Electorailes correspondientes, copies certi-
ficadas de todas .as inscripciones hechas desde el 11
al 15 de Octubre .de 1908. aimbos inclusive, en la
Secci6n de Ciud-aadania del Registro Civil; y desde
eq 16 all 18 de Octubre, amboss inclusive, enviaran,
sin demora, A 1as Juntas Munieipales Ellectora-les co-
rrespondientes, copias oertificadas de las inscripeio-
nes que se hagarn en la Seccion de Ciud'adania del
Registro Civil durante 'dieho period, basadas en cer-
tificaciones expedidas por el Departamento de Esta-
do con fecha 15 de Ootubre. 6 anterior.

Articulo 4.

Se slspende el cumplimiento del Articnlo 5 del
Decreto nfimero 838, 'de la serie corriente, hasta el
dia 19 de Octubre, en ,la cua1 fecha se cumplirA lo
dispuesto en dieho a;rtienlo. Al dar cnmplimiento
al expresado articulo, 'las Juntas Municipales Elec-
torales tomarAn -en considderacei'6n y darn ,toda fuer-
za y efecto A las copias certificadas de inscripeiones
en la Seeei6n de Ciudadania .del Regist.ro Civil re-
mitidas A dichas Juntas de acuerdo con 'lo dispuesto
en este Decreto.
Articulo 5.

E.ste Deereto surtirA sus efeetos desde el 16 de

that the cession in usufruct made in favor of the
commercial firm of Garriga. Sureda and P. Casta-
fio. should he uimlerst.o(;1 to have been made in
favor of Mrs. 31'recedes Garriga. VYIa. de Garri-
ga. and:
Whereas: The petition for s:lid cession was pre-
sented to the Avyntamniento by Mr. Salvador Ga-
'riga. in representationil of his legitimate mother. Mrs.
Mercedes Garriga, Vda. de Garriga, alleging in favor
thereof that said lady was the owner of the lands
whereas the warelhouses of the firm of Garrir'a. Su-
reda y C." are lncated, and;
Whereas: The Ay'nfita iiento of C'iefiiuegn~ cnm-
initted an error when rerqlestinii the Superior author-
ity to grant said concession ini usufruct for lands
in favor of said commercial firm, which has neither
requested it nor was duly entitled thereto, and;

Resultando: qne la solicitud d& dicha ceesin fu6
presentada al Aynntainiento par el Sr. Salvador Ga-
rriga en representaciOn de su legitima madre doiia
Meri'edes Garriga. vinda de Garriga, alegando en su
apoyo ser diha sefiora ]a propietaria de los terrenos
donde estan emplazados los alnacenes de la sociedad
Garriga. Sureda y C.a
Resultando: que el Ayuntamiento de Cienfue-
gos padeci6 un error de hecho al solicitar de la Sn-
perioridad la mencionada coneesi6n de usufrueto de

'Conceder la autorizaci6n solicitada por el Ayun-

vested in me, I, Charles E. Magoon, Provisional Gov-
ernor of Cuba, do hereby

RESOLVE:

1st. That Paragraph 4 in Clause 11 of Article
97 of the existing Customs Regulations. le and the
same is hereby alie.dcd :to read as follows:

admitted except the original signed one of the ma-
nufacturer. producer. seller. owner, or shipper of

elude Sunday, October 18th, 1908.

Article 2.

The period prescribed by the eighth paral'raphi
of Article 91 of the Electora'l Law for filing ap-
peals froni resolutions adopted 1)y Muiniripala Elec-
toral Boards in respect of inclusions. exclusions or
corrections in the electoral register is hereby ex-
tended to 10:00 a. m. on Wednesday. Octoler 21st,
1908. On October 21st. each Municipal Electoral
Board shall convene and shall cause to be properly
prepared all appeals which 'have noat theretofore been
forwarded. which appeals shall be transmitted to the








presiding justice of the proper Andiienia on said
day or upon the following day.

Article 3.

'This Decree ishall go into effect on October 17,
1908, and shall be construed as having reference

eultades de que me hallo investido como Gobernador
Provisional, por el present

ORDENO Y DECRETO:

Articulo 1.

El pdlazo sefialado en el Articulo 90 de la Ley
Electoral para la resoluci6n de solicitudes pendien-
tes para inelnsi6n. exclusion y reetifieaci6n del Re-
gistro EAectoral. que fueron presentadas antes de las
seis de la tare del jueves 15 de Octubre, por el pre-
sente se prorroga hasta el domingo 18 de Octubre de
1908. inclusive.

Artliclo 2.

El plazo sefialado en el octavo pArrafo del Ar-
tiunlo 91 de -la Ley Electoral para la interposici6n
de apelaciones contra acuerdos de las Jun-tas Muni-
cipa(les Electorales en materials do in'lusiones. excliu
siones y rectificaciones del Registro Electoral, por
el present se prorroga hasta las diez de la mafiana
del miereols 21 de Octubre de 1908. En el eitado

Havana, October 17th, 1908.

Having examined the appeal made by the Ayun-
tamiento of Placest'.s from the decision rendered by
the Acting Provincial Governor of Santa Clara un-
der -date of July 28th, 1908, whereby be revoked
the resolution adopted by said Corporation on the
3rd of the same month and year, which granted a
period of thirty days for the demolition of 'a house
situated on West 2nd 'Stret. between West Central
and South 1st streets, owned by Mr. Jose Roche
Nieto. and;
Whereas: A complaint having been presented
to the effect that said house was in ruins. the Ayun-
tamiento resolved that it should be demolished on
August 20th. 1907, which resolution was revoked 'by
the Governor because the experts designated to in-
spect said building had no titles and there were no
titled experts in the town, and Door-e No. 1263 is-
sited by this Provisional Government on December
20th, 1907 (GAZETTE of the 22nd) directed that the
Engineer of Public Works of the Provincial Coun-
cil of Santa Clara should proceed to inspect said
house, in order that the Ayuntamiento should later
resolve the matter in whatever manner it should be
considered expedient, and;
Whereas: In view of said inspection the En-
gineer,reported on May 23rd. 1908. that the house





was not in any imminent danger of ruins although
it was in fairly bad condition; ,bt that the parts
demolished could be repaired and reconstructed in
accordance with the Building Ordinan:-es of that
locality. and ;
Whereas: The Council took note of this report
at the session held on the following 3rd of July
antd resolved to grant Mr. Roche a period of thirty
days wherein to demolish it herause pursuant to ar-
ticle 8th of the Ordinances houses built within the
Central Zone should be provided with a ga'ble roof
and said house did not meet this requirement and a
building in inmi'nent d'Anger of falling down should
not he permitted to stand. thus obviating the .pos-
sibility of an accident at any given moment, and;
Whereas: Mr. Ro he took exception thereto and
appealed to the Governor of the Province who. in
decision dated July 28th. 1908. already mentioned,
admitted the appeal aInd revoked tile appleahle from
resolution on the ground that, in aweordlanee with
the expert's report, the house was in no imminent
peril of falling. and;
Whereas: As regards the immin' ient danger of
falling mentioned in said resolution. such appreeia-
tion should not be taken into consideration because
the report submitted by the Engineer of the Prov-
incial Council states otherwise, an'd;
TUpn the recommendation of the Acting Secre-
tary of Government.

I IHEREBY RESOiLVE:
To dismiss the present appeal. thus confirming
the governmental decision appealed from and, con-
sequently. suspending the 'municipal resolution in
question.

DECREE No. 1024.

Havana, October 20, 1908.

Whereas, Section III of Decree 894 of August
26, 1907, known as the National Sanitary Depart-
ment Act provides: "It shall see to the enforcement
of the Sanitary Laws, including the laws governing
the admittance of persons to the practice of medicine,
veterinary medicine, pharmacy, dentistry, ........
........, and laws for the control of offensive and
dangerous industries or occupations": and
Whereas, The Law of Executive Power now be-
ing drafted by the Advisory Law Commission makes
provision for the pharmacies of Cuba to be subject
to the jurisdiction of the National Sanitary Depart-
ment; and
Whereas, An emergency exists for disposing of
the existing controversies regarding the interpreta-
tion of existing laws and providing-new rules and
regulations governing pharmacists and pharmacies
and as the interest of all concerned, especially the
general public health, will be promoted by definitely
fixing the permanent jurisdiction at this time; and
Whereas, The exercise of the profession of Phar-
macy directly affects public health, and as potent
reasons exist which demand the adoption of measures
for properly regulating the exercise of that profes-
sion and serve to prevent the recurrence of infrac-





tions which are now committed in its practice, and
which at the same time aid and protect interests
created by long established custom, and such infrac-
tions having been developed with the tacit consent
of the public administration; and
Whereas. It is necessary that such measures
should be so adjusted as to be in harmony with the
others which have been recently dictated for the
regulation of the operations of all of the different
organizations which affect the sanitary interests of
the Republic,
Therefore, I, Charles E. Magoon, in the exercise
of the faculties in me vested, as the Provisional Gov-
ernor of the Republic of Cuba. in conformity with
the report of the National Board of Health, and the
Adviser to th, Sanitarhy )Department,

RESOLVE:

I.-The exercise of the profession of Pharmacy,
the commerce in drugs and medicinal preparations.
the compounding of pharmaceutical specialities, and
the preparation and sale of scrums and vaccine ma-
terials, are 'placed by this Decree under the im-
mediate inspection and jurisdiction of the National
Board of Health in accordance with the provision of
paragraph (h) Section III of Decree No. 894, of
August 26, 1907.
The Sub-Delegates of Pharmacy at present in
office and who now report to the Provincial Gov-
ernors of the Island are hereby transferred to the
National Sanitary Department and will report in
writing for duty to the Chief Sanitary Officer of the
Island, it being strictly understood that no compen-
sation other than that now received shall be paid to
them. It shall 'be o understood that the manner of in-
spection hereby i lered shall be considered tempor-
ary unless adopted by the Commission provided for
in Article III of this Decree when it prepares and





prescribes the rules and regulations governing the
profession of Pharmacy.
II.-That every person duly authorized by the
laws of the land to engage in commerce or industry,
can establish and become proprietor of a Pharmaceu-
tical office or Apothecary establishment. provided
that such person complies with the requisite condi-
lions and provisions which will he duly expressed in
the Pharmaceutical Regulations. inscribing himself
as owner in the Mercantile Register, under his own
name. exercising in it all acts of ownership. provided
that a graduated Pharmacist of the University of
Havana. or one endorsed by that Institution, or
otherwise authorized by law, personally performs or
superintends all of the operations connected with the
compounding ani delivery of medicines. and the
filling of prescriptions, who shall be held criminally
responsible for whatever crime or fault in respect to
the exercise of the profession of Pharmacy may be
committed, and the proprietor of the establishment
will he also held snlbsi;liirily responsible in tl:., civil
legal proceedings.
IIT.-The compiling of a new Code of IPharma-
ccutical Regulations or Ordinances in accordance with
present requirements will be immediately proceeded
with. in order io regulate in a stable lmaillner the
exercise of this profession in consonance Awth the
modern conception of it, of the commerce in drugs,
medicinal preparations. and of preparation and dis-
Iribulion of series a'il vaccine materials. In order
to realize this work. a Commission shall be consti-
tuted. presided over by the National Chief Sanitary
Officer, and made up of two additional members of
the National Board of Health, to be designated by
the said Board, a professor of the School of Phar-
macy of the University, to be named by that School,
two Delegates from the National Pharmaceutical As-
sociation. and one Delegate from the Association of





Practices Owners of Drug Stores, tile Secretary of
the National Board of Health acting as the Secretary
of this Commission. The Delehgate from the National
Pharmaceutical Association and the Delegate from
the Association of Practicos Owners of Drug Stores.
shall receive a remuneration of three hundred dollars
each. for all their work as such delegates.
The Commission shall finish its labor within
thirty days from the date of its first session and
submit the draft of the regulations or ordinances it
has formulated, to the National Board of Health.
which Board in its turn, after approving or modifying
the draft, shall deliver it to the Adviser to the Sa-
nitary Department, who will transmit it to this
Government for its final disposition.
TV.--TTnlil the promulgation of the new Phar-
*nmitenli-nIl regulations, thle present existing Or-
dinances shall remiiin in force in all masters wherein
they do not conllHit with the xecrntion of the re-
quiremenis expressed in this )Deree.
V.-The National Board of Health is authorized
to create a corps of assistants in Pharmacy, based
upon a suitable corresponding technical examination
and other requisites, which shall be specified in the
regulations governing the exercise of the profession
of Pharmacy. These assistants or practitioners shall
render their services in the manner and in the cases
which will be specified in the above mentioned re-
gulations.
VT.--Tn order to carry out the provisions of this
Decree a credit of $2.000 is hereby appropriated
from any disposable funds in the National Treasury
not affected by other obligations.
VII.-The Adviser to the Sanitary Department
and the Secretary interino of the Treasury are
charged and expressly authorized to cause the execu-
tion of the dispositions contained in this Decree,
each one in his own proper sphere of action.







VIII.-All acts or parts of acts in conflict with
the provisions of this Decree are hereby repealed.

"exigira el eumplimiento de las leyes sanitarias,
inoluyendo las que reguilen la admisi6n al ejercicio
de la medicine y cirugia, voterimaria, farmacia, ciru-
gia dental.... ... . asi como las leyes que re-
gulan las industries y ocupaciones peligrosas y no-

Por cuanto. la Ley del Poder Ejecutivo que en
la actualidad redact a la Comisi6n Consultiva somete
las farmacias de Cuba A la jurisdioci6n del Depar-
tamento Nacional de Sanidad, y
Por cuanto, es -de today urgencia resolver las du-
das existentes respeeto a la interpretaciiin de las vi-
gentes eyes de farmacia y promuilgar nnevos regla-
mentos sobre farmac6uticos y farmacias y como ha-
brA de resultar en pro de los interests de todos
aquellos A quienes concierne. y muy especialmente en
beneficio de la sallud piiblica. establecer de una vez
y para siempre las respectivas jurisdicciones; y
Por cuanto, el ejercicio de Tla profesi6n de far-
macia directamente afecta la salud pfiblica,, y exis-
ten poderosos motivos que exigen 'la adopci6n de





medidas que regulen debidamente el ejercieio de di.
cha profesi6n y sirv.an A evitar la repetici6n de las

Havana, October 19th, 1908.

Whereas. the contract entered into between the
Cuban Government and Messrs. Sussdorff, Zaldo &
Co. in connection with the purchase and deli very of
arms and ammunition as mentioned in 'said contract
was cancelled or rescinded by Decree N. 7, issued
by the Provisional Governor of Cuba under date of
October 6. 1906, reserving to the aforesaid firm the
right of claiming from the State such indemnity as
may be due them by reason of this rescission; and,
Whereas, the following letter dated September
30, 1908. has been addressed by Messrs. Sussdorff,
Zaldo & Co. to the Adviser to the Department of
Government:
"We take pleasure in informing you that the
following proposition made by your office will be
acceptable to our firm, that is that we will accept
$21,700.00, U. S. Currency, in fuli payment of our
claim against the Cuban Governmeldt for 'oods deIMliv-
ered under orders from the Cuban Government and
also for all damages occasioned by the rescission or
cancellation of orders for arms, ammunition and
munitions of war which were pending delivery and
which were cancelled by the Decree of Hon. Willamn
Taft, or other authority.
In consideration of the above -mentioned amount,





we hereby agree to deliver to the Government ol'
Cuba, C. O. B. New York:

Six (6) Machine guns, complete, with fit-
tings and extra parts, at $1.000.00
IT. S. Cy. each. ...... .$ 6,000.00
Six (6) Loading machines for the above
at $75.00 each. ... . .. 450.00
Two hundred (200) feed belt at $3.50,
U. S. Cy. each. . . . 700.00

Total . . . $ 7,150.00

the remaining $14,550.00 being the balance due on
the payment of all -pending claims".
Whereas, the offer made in the letter above
quoted would benefit the interests of the State, now.
therefore. 1. Charles E. Magoon, by virtue of the
powers vested in me as Provisional 'Governor of
Cuba, and upon the recommendation of the Acting
Secretary of Government,

RESOLVE:
1. That the offer made by Messrs. Sussdorf.
Zaldo & Co. in their above mentioned letter of Sep-
tember 30. 1908. he, and the same is hereby accept-
ed by the Government as definitely settling the
questions which arose between Sussi.orff. Zaldo &
Co. and the Government of Cuba on account of
their contract to supply arms and ammunition.
2. That the sum of seven thousand one hun-
dred and fifty dollars ($7.150.00) be. and the same
is hereby aprprpriated from any funds now exist-
ing in the Treasury not otherwise appropriated, for
the payment upon delivery to the satisfaction of the
Government. of the six machine guns. six loading
machines and two hundred feed belts which Messrs.
Sussdorff. Zaldo & Co. agree to deliver pursuant to
the offer made in the above mentioned letter.







3. That the sum of fourteen thousand five
hundred and fifty dollars ($14,550.00) be, and the
same is also hereby appropriated from any funds
existing in the Treasury not otherwise appropriated,
for the purpose of paying said sum to Messrs. Suss-
dorff, Zaldo & Co. upon delivery to the entire
satisfaction of the Government, of the above men-
tioned machine ggns. loading machines and feed
belts, in full ,payment of all claims made by said
'firm against the Cuban Government for goods deliv-
ered under orders of the Cuban Government, as
well as for all damages occasioned by the recission
of orders for arms. ammunition and munitions of
war which were pending delivery and which were
'cancelled by Deeree No. 7 of the Hon. William H.
Taft under date of October 6. 1906. or other au-
thority.
4. The Treasnry Department and the Depart-
ment of Government shall adopt the necessary meas-
ures attendant uponi the compliance with the pro-
visions of this Deeree.

res Sussdorff, Zaldo & Co. para la adquisici6n de
arnas y otros pertreehos de guerra que en el mis-
mo se meneionaban. y so reserve A di'ehos sefiores el
dereeho de reclainar al Estado la indlemnizacion que
pudiera corresponderles por virtnd tde la expresada
rescision; y
Por cuanito: los seniors Snsslorff. Zaldo & Co.
han dirigido al Consejero de ]a Secretaria *de Gober-
nacidn in siguiente earta, feehada en 30 ,de Septiem-
b)re 'de 1908:
"Tenemos el iusto de manifestarle que la si-
guiente oferta becha por ese Centro ser6 acceptable
por nnestra clsa, cs deeir. (qne estamos dispuestos a
aeeplar la sunma de $21,700.00 Cy, en pago complete de
nuestra reelamiacion contra el Gobierno Cbano, asi
como por cualquier perjuicio que pudiera haber oca-
sionado la rescisi6n 6 cancelaci6n de las 6rdenes pa-
ra armas. mnmni'iones y otros pertreehos ide guerra
que estaban pen-dientes de entrega. y las cuales fue-
ron canceladas por Decreto del Honorable William
Taft 6 por otra nutoridad. En consideracfin i la re-

cargadoras y las doscientas fajas alimentadoras que
los sefiores Sussdorff, Zaldo & Co. deben entregar
segfin ofrecen en la carta copiada.
3. Conceder, y tam bien por el present conce-
do, de los fondos del Tesoro no com'prometidos por
otros concepts, otro cr&dito de $14.550.00 (catorce
mil quinientos cincuenta pesos) para abonar la mis-
ma suma A los sefiores Sussdorff, Zaldo & Co., una
vez que hayan entregado al Gobierno, A entera sa-
tisfacci6n, las ametralladoras, minuinas cargadoras
y fajas alimentadoras ya mencionadas, como pago
definitive de today reelanmaci6n de dichos sefiores con-
tra el Gobierno Cubano por efectos entregados A
virtud de 6rdenes del mismo Go'bierno; asi como 'por
cualquier perjuicio ocasionado por la rescisi6n 6
cancelaci6n de 6rdenes para armas, municiones y
pertreehos de guerra que estaban pendientes de en-
trega y que fueron canceladas ipor el Decreto N. 7
del Honorable William H. Taft, de Octubre 6, 1906,

Havana, October 19th, 1908.

Whereas: Decree 916, of September 21st, 1903,
provides that. after Provincial Conneils have ef-
fected their organizations in accordance with law,
the renpective PreHident of the same shall call l said
Councils in special session. for whatever length of
time considered necessary. for the establishment of
the new regime with whatever else may relate there.
to, and;
Whereas: Tt has been brought to the attention of
the Provisional Governor that the duties devolved
upon Provincial Councilmen in said special sessions
are practically of the same character and extent as
those intended. under the provisions of article 46 of
the Provinciall Law, to be performed at a regular
session: and.
Whereas: Article 47 of the Provinciall Law
provides that the per diem for any special session
be paid for one .day only, without regard to the
number of days that the session may 'last.
By virtue of the powers vested in me and upon
the recommendation of the Acting Secretary of Go-
vernment,
I HEREBY RESOLVE:

That, 'during a period of twenty days begin-







ning from the day on which the respective Provin-
cial Councils, in accordance with the provisions of
Article 1, Decree No. 916, of September 21st, 1908,
meet in special session for the establishment of the
new regime with whatever else may relate thereto,
Provinoial Councilmen, or their substitutes when
acting, shall receive, as remuneration, a per diem not
to exceed ten dollars for eadh meeting attended by
them, holding applicable the provisions of article 47
of 'the Provincial Law as to quoruns and double
per diems.

Considerando: Que el Deereto nfimero 916 de
21 d e opptiembhrpe de 1908. dispcne nue nna. vez que
los Consejos Municipales hayan efectuado su organL
zaci6n de aecerdo con la 'ley, sus respectivos presi-
dentes convocaran diehos Consejos en ssi6n espe-
eir l, por el period de tiempo que se estime necesa-
rio. para el establec;miento -del nuevo regimen y
cuanto al mismo concierna, y
Cons:deranto: Que se ha llamado ]a atenci6n de
este Gobierno Provisional al heeho de que los debe-
res deserrpefiados por los Consejeros Provinciales en
sesi6n especial tienen practicamente el mismo carac-
ter y extension que los que debieren desempeiar
en scei6n ordinaria de acuerdo con el Articulo 46
de la Ley Provincial, y
Considerando: Que ol Articulo 47 de la Ley
Provincial d:spone que cuando se celebren sesiones
extrnordinarias s6lo se devengarAn dietas por un s6-
1lo dia. cualquiera que sea el nfmero de dias que
dure la sesi6n.
En virtud de los poderes con que estoy inves-
tido y A propuesta del Secretario interino de Gober-
naci6n








RESUELVO:


Que durante un period de veinte 4iias, que co-
menzarAn A contarse el ,dia en que los respectivos
Consejos Provinciales se rennan en session extraordi-
ria de aeuerdo con el Articulo 1, Decreto nfimero
916 de 21 de Septiembre de 1908 con el fin de esta-
blecer el nuevo regimen y cuanto ai mismo concier-
na, recibirfn los Consejeros Provinciales, 6 los sus-
titutos que ejerzan como tales, la remuneraci6n de
una dieta que no excederi de diez 'pesos moneda ofi-
ciail por cada sesi6n a que asistan, estimAndose apli-
cable Io dispucsto en ?l Articulo 47 de la Ley Pro-
vincial acerca do quorums y dietas doubles.

Whereas: at the present time the appropriation
made to pay conrmissions to the banks as fiscal agents
and depositories of the Government is exhausted for
the fiscal year 1907-1908, and there is due therefore
the amount of $27,563.30 to the National Bank of
Cuba as certified by the Auditor for Cuba.
Whereas: likewise the appropriation made to
pay for general transportation in the same fiscal year
is also exhausted, and hills in the amound of $9,950.02
are pending payment as reported by the Central
Paymaster of this Department in view of tlhe ac-
counts presented and found correct.
Therefore upon the recoilllmenidtion of the Act-
ing Secretary of Finrne, I, Charles E. Magoon, by
virtue of the authority vested in me as Provisional
Governor of Cuba. do hereby

RESOhVE :

That from tihe available funds in the Treasury
not otherwise appropriated, the sums of twenty
seven thousand five hundred and sixty three dollars
and thirty cents ($27,563.30) or so much thereof
as may be required. be and the same is hereby ap-









propriated to pay the National Bank of Cuba for
commission) due. and nine thousand nine hundrel
and fifty doll:lrs and two cents ($9.950.02) to pay
bills incurred for transportation. said appropria-
tions to be considered as additional to the appropria-
tions in the Annual Budget of 1907-1908 entitled
respectively Comisiones ai Baneos y Premios de
Fianzas '1908'' and 'Transportes Generales "1908".

Resultando: que en la actualidad estA agotado
el cr&lito concedido para el pago de "Comisiones
A los Bancos" en carActer de Agentes Fiscales y
depositarios del Gobierno, aiko fiscal de 1907 A 1908,
y que se aodeudan al Banco Nacional por el expre-
sado concept $27.563.30, segfin la certificaci6n ex-
pedida por la Intcrvenci6n General.
Resultando tambi6n que esta igualmente ago-
tado el cr6dito concedido para transported generals'
del mismo afio fiscal y que se adeudan cuentas por
$9.950.02, segfin lo informado por el Pagador Cen-
tral de Hacienda con vista de las obligaciones reco-
nocidas y liquidadas.
A propuesta del Secretario de Hacienda inte-
rino, Yo, Charles E. Magoon, por virtud de los po-
deres de que estoy investido como Gobernador Pro-
visional de Cuba.

RESUELVO:

Conceder y por el present concede con cargi
a los fondos sobrantes del Tesoro, dos cr6ditos, uno
por la eantidad de veinte y site mil quinientos se-
senta y tres pesos. treinta centavos, ($27,563.30) 6









la parte que de ellos fuere necesaria, para satisfa-
cer al Banco Nacional de Cuba las comisiones que
h'a devengado, y otro por nueve mnil novecientos cin-
cuenta pesos, dos centavos, ($9.950.02) ,para satisfa-
cer los adeudos por transported, consilderiindose di-
chas dos consignaciones como amipliaci6n fde los cr6-
ditos: respectivos "Comisi.ones. Bancos y Premios
de Fianzas-1908" y "Transportes Generales-1908".

DECRETO N. ]029.

Havana, October 20th, 1908.

The proceedings instituted upon the applications
for pardon in the cases hereinafter mentioned, in-
cluding the reports of the trial courts, having been
examined, and,
Whereas the reasons which appear in said pro-
ceedings, as stated below in each case, justify the
extension of clemency,
On the recommendation of the Acting Head of
the Department of Justice,

I RESOLVE:

1. To grant a total pardon to
Adolfo Garcia Gonzdlez,
remitting the unexecuted portion of the penalty im-
posed upon him by the Correctional 'Court of the
Second District of this city on the 31st of August
last. in cause No. 2958 of the current year, of the
said court, taking into consideration the circum-
stances attending the commission of the offense.
2. To grant a total pardon to
Catalino Goizilzar Lacallc,
remitting the unexecuted portion of the penalty










imposed upon him by the Audiencia of Havana on
June 17th, last, in cause No. 257 of the current year,
of the Central Court, taking into consideration the
circumstances attending the commission of the crime.
3. To grant a partial pardon to
Jose Garcia y Diaz,
commuting to a fine at the rate of one dollar, of-
ficial currency, for each day of the unexecuted 'por-
tion of the penalty imposed upon him by the Cor-
rectional Court of the Second District of this
city on the fifth instant, in cause number 3327 of
the current year, of said court, taking into consi-
deration the circumstances attending Ihe commis-
sion of the offense.
4. To grant a total pardon to
Raldomero Hernindez y Zayas,
remitting the penalty of confinement in the Reform
School of Guanajay imposed upon him by the Co-
rrectional Court of the Second District of this city,
on the 26th of September last. in cause number
6940, of the current year,, of the said Court, Di-
recting the Department of Government to revoke the
commitment, taking into consideration the circum-
stances attending the commission of the offense.

Vistos los expedientes formados a virtud de soli-
citudes de indulto presentadas en los casos que m'is
adelante se expresan en los que figuran Ilos informed
de los Tribunales sentenciadores.-
Considerando: que las razones que aparecen de
diohos expedientes que se consignan continnaci6n
de cada caso, justifican Ila concesi6n de indulto.
A 'propuesta del Jefe interino del Departamen-
to de Justici'a,

RESUELVO:

1. Indulta-r totailmente A
Adolfo Garcia Gonzdlez,
perdonAndole el resto que le queda per cumplir de
la pena que le impuso c4l Juez Correccional del Se-
gundo Distrito de esta Capital el 31 de Agosto ilti-
mo, en la causa nfmero 2958 del corriente aflo, de
dicho Juzgado; teniendo en cuenta las circunstan-
cias que concurrieron en la 'comisi6n del delito.
2. Indultar totalmente A
Catalino Gonzdlez Lacale,
perdonandole el resto que le queda por cumplir de
Ia pena que ]e impuso la Audiencia de ia Habana,











en 17 de Junio fltimo, en la causa nimero 257 del
corrienee afio del Juzgado del Centro; teniendo en
cuenta las circuristancias que concurrieron en la
comisi6n del delito.
3. Indultar parcialmente A
Jos6 Garcia y Diaz,
conmutAndole ipoi 'multa A razin de un peso mo-
hbda official por cada dia que le queda por cumplir
de da pena que le impuso el Juez Correecional del
Segundo Distrito de esta Capital en cinco del actual
en la causa nfmero 3327 ,del corriente ailo de dicho
Juzgado; teniendo en enenta las circnnstancias que
concurrieron en Ia comisi6n del delito.
4. Indulltar totalmente a
Baldom.ero Herndndez y Zayas,
de la pena de reclusi6n en Ja Escuela Correccional
,de Guanajay, impuesta por el Juez Correecional del
Segundo Distrito de esta Capital el dia 26 de Sep-
tiemlbre l6timo en el juicio nfunero 6940 del co-
rriente aiio, de dieho Juzeado, ordenando al Depar-
tamento de Gobernariin que levante dicla reelu-
sion: teniendo en euenta las circunstancias que con-
currieron en la comni.i6n de la falta.

ries of the farrier and the two grooms of the School
of Veterinary .Medicine which are not included in
Decree No. 796 of July 31st. 1908.

Whereas: There having -been presented and
accepted the resignations of Messrs Victor H. Oln-
sted d and Henry Gannet as Director 'and Assistant
Director respectively of the Cuban Census, by virtue
of the authority vested in me as Provisional Gover-
nor of Cuba,
I RESOLVE:

To appoint Mr. Jos6 de J. Monteagudo, the
present Chief of Supervision of the Cuban Census,
to the position of Director of the Census, and Mr.
I. A. Barnes, the 'present Secretary and Property
Clerk of the Cuban 'Census, to the position of As-
sistant Director of the Census, to perform also the
duties of these respective positions as prescribed by
Decree No. 520 of 1907, both without additional
compensation and to be in effect from this date until
the completion of the Municipal Register work now
being performed by the Census Bureau.
