Pinellas News Staff Report
CLEARWATER A Tampa

charge of attempted murder, after
he allegedly stabbed a man with a
screwdriver as he walked through
a park.
Police were
sent to Glen
Oaks Park, at the
corner of Mark
Drive and Druid
Road, at 11:40
a.m. after a 911

Richard James,

lodged in his neck.
Witnesses say Rico Nash, 26,
of Tampa, appeared hostile and
aggressive, and had verbal con-
frontations with others before he
approached James, who was on a
routine walk through the park.

Don't want holiday shopping regrets?

Don't play Santa

for yourself

Holiday sales are
tempting, but
they can put
you in a hole

By MICKIE ANDERSON
University of Florida
GAINESVILLE With more
than half of us expecting to play Santa
for ourselves this holiday season, a
University of Florida family finance ex-
pert warns that being self-indulgent -
even at bargain prices can lead to a
bad case of buyer's remorse.
According to an annual consumer
survey conducted for the National Retail
Federation, 56 percent of us expect to
treat ourselves this season, taking ad-
vantage of holiday sales. Another 30
percent aren't sure, and 13 percent say
they can resist temptation.

"If you get someone a
video game system, it's
not like you saved the
world. It's a nice gesture,
but you might even feel
better about yourself
sometimes to give some
of that money away."
MICHAEL GUTTER
Assistant professor of family financial
management, University of Florida

On top of the $816 the average con-
sumer expects to spend on the holidays
this year, they'll tack on another $106
treating themselves, the survey said. The
trend has held steady. The same survey
in 2002 showed 55 percent of respon-
dents intended to spend on themselves.
"If you start buying for yourself
while you're buying for other people,
especially, you really run the risk of
overspending," said Michael Gutter,
an assistant professor in family finan-
cial management with the Institute of
Food and Agricultural Sciences.
"You're just going to likely spend
more than you intended and you're
only going to end up being frustrated
in the result."
Gutter's No. 1 rule for avoiding a fi-
nancial holiday hangover: Before you
ever step foot in a store, make a budget.
Either jot down specific gift ideas for
those on your list or the amount you can
spend on each person.
See GIFT I Page 4

* If you haven't started saving for your
purchases start now.
* Build a list of people to buy for and
stick to it.
* Avoid charging on credit at all costs;
if something needs to be purchased on
plastic, make sure you can pay off the
full amount within 30 days.
* Avoid impulse buying and shop
around. Chances are, you'll find the
same product cheaper elsewhere.
* If you are purchasing something
online check the shipping charges
carefully.
* Plan a route. Knowing where you are
going and how you are going to
navigate your day ahead of time can
help you avoid long traffic lines, or long
lines at stores. Starting earlier in the
day usually helps avoid the last minute
rushes.

* Start preparing for next year now.
Calculate what it took for you to have a
successful shopping experience this
year. Use the knowledge gained from
this year's experience to prepare for
next year.
* Set predetermined spending
amounts.
* High-tech products usually don't
come cheap around the holidays.
Chances are the same product you paid
full retail price for will be much cheaper
to purchase a few months after the
holidays.
* Finally, take a deep breath, relax and
pace yourself. Overly rushing can lead
to poor purchasing choices that can
cost you in the long run. Check a stores
return/exchange program before you
make your purchases.

Magnet

school

bids

at issue

Already a month
late, decision may
delay reassignment
students to 2009

Pinellas News Staff Report
ST. PETERSBURG After
months of meetings, discussions
and hearings, Pinellas County
Schools' new student-assignment
plan may face another delay.
The county school board was
to approve the plan Tuesday, but
instead, Superintendent Clayton
Wilcox pulled it from the agenda.
The board's decision had already
been delayed a month.
The "choice" plan of the last
five years will be set aside if the
board approves the new plan. The
first reading was in November,
and both readings were pushed
back from the original October
and November dates to allow
changes to be made to the plan.
Board members decided on a
last-minute change to offer seats at
magnet schools to students who
live in close proximity, instead of
forcing them to be bused further
away to another school.
Students will be assigned to
"close-to-home," neighborhood
schools, much as the county did
before 1971. Court-ordered bus-
ing began that year.

Two Pinellas
attorneys
disciplined
Pinellas News Staff Report
ST. PETERSBURG Two
Pinellas County attorneys were
disciplined recently by the Florida
Bar one suspended, the other
disbarred.
The two are among 23 who
were disciplined by disbarment,
suspension, probation, reprimand
or restitution. Some attorneys
were given more that one form of
discipline.
The court orders for discipline
are not final until time expires to
file for a rehearing, or if the re-
hearing is determined.
As an official agency of the
state Supreme Court, The Florida
Bar and its department of lawyer
regulation administer a statewide
disciplinary system to enforce
rules of professional conduct for
more than 80,000 lawyers admit-
ted to practice law in Florida.

Seven ways to ensure you

arrive on time every time

Pinellas News Staff Report

Ever been delayed on the tar-
mac for over an hour? Maybe you
filed a consumer complaint and
never received so much as a
phone call. Now is your chance as
a consumer to speak out.
U.S. Department of Trans-
portation figures for the first
seven months of 2007 show only
72.23 percent of flights arrived
on time, a lower percentage for
this period than in any of the past
12 years.
The DOT proposes a new
seven-point rule to improve air-
line passenger rights and they
want comments from you. They
will accept public input until Jan.
22.
These new measures would in-
corporate the Internet.
Airlines would be required to
publish their delays online. Along
with the delays the percentage of
arrivals that were on time, the per-

centage of arrivals that were more
than 30 minutes late, special high-
lighting if the flight was late more
than 50 percent of the time, and
the percentage of cancellations.
Another area bulking up on
their area of responsibility is the
consumer complaint department.
This rule would require customer
service departments to contact the
customer within 30 days of the
complaint.
Each carrier would have to dis-
close the number of consumer
complaints it has received within
a defined time frame concerning
subjects such as tarmac delays,
missed connections, and the fail-
ure to provide amenities to pas-
sengers affected by a delayed or
canceled flight.
The DOT is looking for com-
ments in regards of to cost, per-
sonal opinion and even other sug-
gestions to in addition to or
instead of this proposal.

The seven-point plan
The Enhanced Airline Passenger Protections Rule attempts to
benefit passengers in these ways:
* Require carriers to adopt contingency plans for lengthy tarmac
delays and incorporate them in their contracts of carriage
* Require carriers to respond to consumer problems,
* Deem operating a chronically delayed flight to be unfair and
deceptive
* Require carriers to publish delay data
* Require carriers to publish complaint data
* Require on-time performance reporting for international flights
* Require carriers to audit their compliance with their customer
service plans.

Pinellas News

It takes the

individual,

not the

village
You may have heard
about "Da Hood Gone
Wild," the video shot in
the North Greenwood section of
Clearwater, a video full of fight-
ing, violence, debauchery, you
name it. Seems like it raised a
stink in the local media a month
or two ago, when it debuted.
You can bet there were some
red faces at City Hall when that
tape came to light.
"Da Hood Gone Wild" was
also the subject of an editorial
from Florida's Best Newspaper,
an opinion found in the paper's
Clearwater edition on Wednes-
day.
The paper says, "It will take
a village to save a generation of
young people... it will take more
than the city Police Department's
best community policing tech-
niques... More than a mayor
who now recognizes how deep
the trouble runs in that neighbor-
hood...."
Forget the village cliche.
Where were these people's par-
ents? What went wrong in their
upbringing, where such misbe-
havior is acceptable?
And the editorial also asks:
Where are the school administra-
tors? Where are the churches
throughout Clearwater? Where
are the youth programs? Where
are you?
It's not up to the police, ex-
cept to arrest those who break the
law, right? It's not up to the
mayor, or to school administra-
tors. And midnight basketball pro-
grams aren't the answer. When
these people were younger, their
parents should've taught them
right from wrong, and given them
a sense of pride. No one else bears
that responsibility.
Mayor Frank Hibbard was
quoted as saying that a city is
like the human body, in that if
one part is sick and untreated,
the rest of the body becomes in-
fected.
Unfortunately, there's more
than one infection plaguing
Clearwater. One is the 'hood
gone wild, but apparently there's
a reputation as being Heaven's
Waiting Room (thank you,
America Online, for that one)
that needs to be lived down.
Oh, yeah, there's also that
science-fiction cult that's chasing
everyone out of the city's down-
town, but you don't dare say any-
thing bad about them, lest they
threaten you with their space-
alien leader, or maybe a lawsuit,
or whatever. At least maybe they
can scare the old folks from up
north from moving to Clearwater.
I hear The Villages is nice this
time of year, and besides, it's
Florida's Friendliest Hometown -
just ask them.
What Florida's Best News-
paper, which has reported itself
as a target of the aforementioned
religion, was saying to Clearwa-
ter's civic groups was a simple
message step up to the plate
and do what your organizations
intend to do, face the challenge
that is North Greenwood, and
give those residents some hope.
Unfortunately, it's not just
North Greenwood that needs
help St. Petersburg's de-
plorable homeless problem
comes to mind, too but it's
something the people of Clear-
water can get behind.

Along with the helping hand
from the community, there needs
to be a message of personal re-
sponsibility.
If the Lord helps those who
help themselves, ultimately, it's
up to the people who live in
North Greenwood to help them-
selves out of the fix they're in.
Maybe then, the 'hood will
go mild.

Columns and editorials are
supposed to spur readers
to rise into some euphor-
ic state of hysteria and action
over some issue of cataclysmic
consequence or announcement
of righteous indignation over
some personal tragedy of
myopic importance to the near-
est bovine, equine, or Feline and
Canine. Simply, I am at a loss
for words, writers block, spirit
of nothingness, brain freeze, etc.

The Spirit of Christmas has
not arrived, or is still in transit.
Maybe shipping hasn't con-
firmed whether it left the ware-
house, or it got caught by the
spam filter.
I partly blame Bright House
Networks for changing the chan-
nel lineup.
No longer having the dexter-
ity or visual acuity of my youth,
I endured countless nights of
frustration and heckling by fam-
ily and pets in the dark to finally
be able without looking for
glasses and light or extreme
squinting recognize which re-
mote button on which remote
would turn on which component,
switch channels, jump to previ-
ous channel, mute, volume, info,
vote for turkey stuffing with or
without celery, the number se-
quence was like a telephone or
an adding machine, and order a
movie not Elka's hip and flab,
blaster and reducer.
Channel 40 was CNN. Now
it's the Disney Channel.
Finally, I found CNN, only
to discover that CNN looked like
C-SPAN's coverage of the Iowa
Republican presidential debate.
I watched in amazement as
former U.S. Sen. Fred Thomp-
son, R-Tenn., responded by
changing the question the mod-
erator asked to "what do I feel is
the greatest impediment to edu-
cation" by answering "the NEA"
...or was it "NIE," a.k.a. "News-
papers In Education."
Regardless, according to the
ACT college-admissions test,
Iowa students' college prepara-
tion is in the top 10.
If his other answers were as
enlightening, he might be the an-
swer to former Arkansas Gov.
Mike Huckabee's prayer and surge
in the polls. Now Thompson's
home state's educational testing re-
flected the results more toward the
answer he was trying to convey.

A St. Petersburg Times edi-
torial condemned the destruction
of the interrogation tapes which
would have showed whatever
techniques of torture the CIA
used and "obstructed justice."
The CIA head, Air Force
Gen. Michael Hayden, made the
excuse that he wasn't with the
CIA when it happened.
The U.S. Justice Department
absolutely refuses to call water
boarding torture, even though af-
ter World War II, soldiers were
prosecuted for violated the
Geneva Convention including
the Japanese, who were at the
time not a signatory to the
Geneva Convention.
The point is this: The char-
ter and design of the CIA and
NSA allows them to operate out-
side the laws, charters, treaties
and accords of everyone and
everywhere and with accounta-

ability left up to itself. What
should we expect them to do?
If you are outside these or-
ganizations and you question
their tactics, you may get an of-
fer you cannot refuse, because it
is also their job not to be caught
breaking our laws.
So, you'd better watch out,
you'd better not cry, you'd better
not pout. I'm telling you why ....

Rein in your holiday spending

GIFT I From Page 1

N .ikiii; those lists in advance
can help people really kind of set
limits, set boundaries for them-
selves," he said. "And if your
name isn't on the list of people
that you're buying for, then that
can sometimes be helpful."
Gail Cunningham, spokesman
for the Silver Spring, Md.-based
National Foundation for Credit
Counseling, says not sticking to
a budget is one of the biggest
consumer mistakes. "People are
well intentioned," she said.
"About half of the people that go
out shopping make a budget, and

half will exceed that dollar
amount."
Once you're out shopping, in-
stead of grabbing those half-price
shoes that go perfectly with your
new black skirt, pass the buck,
Gutter says. Go home and drop a
hint about the shoes to a relative or
friend who may be looking for a
good gift idea.
"If there's a sweater you really
like and you really wanted to get it
for yourself, or a video game or
whatever it is... there's nothing
wrong with letting people know,"
he said. "In fact, I find that if you
do that, people are grateful, be-
cause no one knows what to get

anyone, most of the time."
If no one takes your well-
placed hint, evaluate the gifts you
do get. Often you can go back and
buy those perfect shoes with a gift
card or cash. Or you can take back
a present you don't like and ex-
change it for the shoes, he said.
Other rules on Gutter's list to
avoid a depressing January:
If you can do your holiday
shopping with cash or a debit
card, leave the interest-accruing
credit cards safely at home.
"It's the ultimate stopgap," he
said. "No matter how much
you're using the debit card,
you're going to think 'whoa,

whoa, whoa, did I go over my
balance?' With the credit cards,
we may not think about it at all."
But many consumers don't
have the bank balance available
to pull off a cash-only Christmas,
he said. And for them, here's an-
other rule:
Do not, under any circum-
stances, use credit cards to
charge more than you can pay
off by the end of February with-
out ignoring other bills, he said.
"We hear that the average
American has $9,000 in credit
card debt, well, this is why," he
said. "We don't ever let ourselves
pay it off because we're con-

Therapists test 'bionic knee'

to four other products at USF

USF News Service

TAMPA Forget running 60
mph or jumping 20 feet into the
air. Those feats of cyborg super-
heroes like The Six Million Dol-
lar Man are not what people look
for when selecting mechanical
replacement limbs.
For those who've lost a leg
above the knee, they just want to
be able to get up from a chair
without assistance or contor-
tions, or to simply climb a flight
of stairs, said M. Jason High-
smith, a visiting assistant profes-
sor at the University of South
Florida's School of Physical
Therapy & Rehabilitative Sci-
ences.
kiRli now, we're not at the
point of superhuman abilities,"
said Highsmith, who is perform-
ing tests on the Ossur Power
Knee. "We just want to restore
function."
The Power Knee is being
compared to four other pros-
thetic knees to see how well it

helps the user stand up, sit down
or walk stairs. Those activities
most people take for granted can
be an incredible chore that puts
strain on the remaining parts of
the body.
"When we stand or sit, we
keep our bodyweight more or
less equal," Highsmith said,
demonstrating how a person with
both legs rises and sits. "But tra-
ditionally, a person with a pros-
thetic leg would have to shift to
their sound side in order to get up
or sit down."
Favoring one side over the
other can cause problems in the
long run. One side will atrophy
while the other becomes over-
developed, increasing the risk for
injury. Also, there will be in-
creased wear-and-tear to the re-
maining leg, Highsmith said, po-
tentially causing an early onset
of arthritis.
The Power Knee works by
means of sensors hidden in the
sole of the shoe on the sound leg
and in an ankle bracelet on that

same leg. When the amputee sits
or rises, the sensors send a mes-
sage to the prosthetic leg telling
it to move, Highsmith said.
One of those Power Knee
users taking part in the test is Ed
Salau, the east coast area director
for the Wounded Warrior Project,
an organization that helps veter-
ans injured in Iraq or
Afghanistan settle back into a
normal life. Salau, a 37-year-old
from New Bern, N.C., lost his
left leg three years ago outside
Tikrit, Iraq, when a rocket-pro-
pelled grenade struck his vehicle.
"This leg is unique," Salau
said. "It's the only leg that pow-
ers me around. The other legs
are great products, but they're
very passive. I have to move
them." While it's not perfect,
Salau said he's glad to be able to
take part in testing that may con-
tribute to a new generation of
prosthetics.
Highsmith said this research
has other implications besides
improving the prosthetic. Insur-
ance companies have been re-
luctant to pay for Power Knees
because they are considered "ex-
perimental." With a price tag of

$100,000 to $125,000, these new
prosthetics are five to six times
as much as the current mechani-
cal legs that cost around $20,000.
"Until we can prove their ef-
ficacy, the insurance companies
are not onboard," he said.
Another test subject, Randy
Thran, 45, lost his right leg as a
result of injuries he incurred as a
police officer in Savannah, GA.
During his career, he'd endured
14 operations on his knees which
suffered repeated beating on the
job. But it was the last beating
that cost him his leg.
"He was just a drug suspect,"
Thran recalled. "I was trying to
apprehend him and my legs were
hitting these big chunks of as-
phalt. Then he gave me a good
sidekick to the leg and snapped it
right in half." Thran said his doc-
tor told him there was no way to
save the leg and it would have to
be amputated.
Like Salau, Thran said get-
ting a Power Knee has helped
him. "It's got good qualities, like
for getting up stairs," Thran said.
"And if you have to do a lot of
longer walking, it doesn't tire
you out as much."

And Gutter urges everyone to

There is enormous pressure to

he said. "I think people as they

SCHOOLS I From Page 1

The plan also provides what educators
call "predictable feeder patterns," meaning
that grade-school students can expect to at-
tend a particular middle school and high
school, unless they move to a new neigh-
borhood.
The plan recommends the closure of Riv-
iera Middle School and three elementary
schools South Ward, Clearview Avenue
and Largo Central.
Principles of the plan are based on what
the board calls aspirationall goals:"
Multiple school options to address in-
dividual family circumstances;
Student access to peers from multiple
cultures and diverse backgrounds;
Reduction of transportation issues for
parents, families and the school district;
A simple application process; and
A commitment to equitable funding
based on concentrations of economically
and educationally disadvantaged students.
Funding strategies may include lower
teacher-student ratios, redistribution of some
federal funds, and the addition of materials,
staff and services to schools.
The plan stipulates that each year, school
administrators will assign students based
on population density, school capacities and
maintenance costs, transportation costs,
class offerings and the placement of coun-
tywide programs.
